Accolades for Proskauer Rose


The international law firm Proskauer Rose has been recognized for outstanding achievement in the latest edition of Chambers USA. Individual attorney rankings have increased 30% and practice rankings by 25%. The firm's sports law, ERISA litigation, equity fund formation, employment defense practices, corporate/M&A, healthcare, wealth management, and commercial litigation practices received Chambers' top rankings.

The annual Chambers USA rankings are determined from interviews with clients and attorneys carried out across the country. The results are independently audited based on a number of criteria, which include technical legal ability, professional conduct, client service, commercial awareness, diligence, and commitment.

Asia predicted to become the number one international legal market


According to legal market experts, Asia has become a booming market for top firms looking to expand globally. 2006 has seen a steady growth in the number of American and British firms opening new offices in Asian territories.

Among the firms branching out into Asia are U.S.-based Simpson Thacher & Bartlett and Kirkland & Ellis, who are currently applying for local operating licenses in Hong Kong. While the former has acquired local firm Fangda Partners, the latter has plans of opening for business by the end of 2006. In addition to U.S. and U.K. firms, leading French firm Gide Loyrette Nouel has successfully secured an operating license in Hong Kong and is now eyeing a new office in Beijing to be launched in August.

Baker Donelson joins with Chinese organization


Memphis' largest law firm, Baker, Donelson, Bearman, Caldwell & Berkowitz has allied with the Chinese National Development and Reform Commission (NDRC). Together, they plan to counsel Chinese and foreign companies on investment matters.

Baker Donelson opened a Beijing office in 2001 and, since then, has represented various Chinese companies in government affairs, direct investment and joint venture matters. NDRC is responsible for formulating economic and social development strategies in China and reports directly to the State Council, the highest administrative body of China.

Law firm pro bono efforts rewarded


The Supreme Court has selected three firms as recipients of this year's annual John Adams Pro Bono Publico awards.

Marion E. Broidrick, Esq. and Lawrence A. Zalis, Esq. received honors for their work on behalf of the Barnstable Action for New Direction program. Heisler, Feldman, McCormick & Garrow was honored for its efforts on the Hampden County Pro Bono Housing Project. Samuel B. Moskowitz, Esq., partner of Davis, Malm & D'Agostine also received an award for his work with the Attorney for the Day project in Boston Housing Court and with the Pro Bono Committee of the Boston Bar Association.

E-discovery attorneys in demand


With the emergence of new technology that allows for paperless law practices, a new type of attorney is in demand, the e-discovery attorney. While these attorneys once exclusively held document review positions, the prevalence of electronic litigation documents has afforded them more responsibilities.

Attorneys with a technology background and experience with e-discovery are in great demand, as per American Lawyer. A growing number of Am Law firms are recruiting e-discovery attorneys to manage electronic discovery, process internal data, manage outside vendors and monitor legal issues and rulings.

Another growing trend is for attorneys with knowledge of e-discovery to open their own consulting companies to help clients manage electronic information. In this regard, experts forecast that 2006 may turn out to be the beginning of a new era for litigators.

Plaintiff funding: a growing trend


Law firms requiring loans to grow their practice are increasingly resorting to an innovative technique called plaintiff funding. When there is a cash flow deficit, a law firm may take a loan from a financial body by accepting a non-recourse cash advance. The loan is based on law firm account receivables and the plaintiff has no obligation to repay the advance if he loses the case.

This technique is applicable in civil lawsuits, such as personal injury, negligence, workman's compensation, product liability, among others and some types of commercial litigation cases, including patent claims and other intellectual property matters, breach of contract and fraud.

With the current scenario of court scheduling or fee payment delays, this trend will allow small or financially troubled firms to accept new cases without having to merge with a larger firm.
