Chair in public service law to recognize Klaus' legacy

In recognition of leading legal luminary William R. Klaus' legacy, Community Legal Services, Inc. (CLS) has set up "William R. Klaus, Esq., Chair in Public Service Law." Klaus was one of the first to advocate legal services for the poor in Philadelphia as well the rest of the country.

The Chair, the first of its kind at CLS, will memorialize Klaus' dedication and initiative in assisting low income residents of Philadelphia with legal services. It will be awarded to an upcoming attorney sincerely committed to public interest law. The nominees must not have worked in public interest practice at CLS for more than 10 years.

Klaus, a chairman emeritus of Pepper Hamilton, LLP, played a key role in the formation of CLS. He was the first to chair the CLS board, and remained in that position for 22 years. Klaus died in 2005. Pepper Hamilton, LLP and CLS have joined their hands to raise $350,000 to endow the Chair. During the initial two-year period, Pepper Hamilton will donate $50,000 for the purpose.

McCarter & English forms climate change law group

Newark-based McCarter & English LLP has recently formed a Climate Change and Renewable Energy Group. The Group will offer legal and business advice to industries about the risks and opportunities associated with climate change.

The firm's decision to form the specific unit is based on its assumption that climate change is going to alter the environment drastically. The firm views climate change not as a separate stream of new regulation but an economic and social upsurge that will transform many industries. The firm anticipates that the climate change will also fetch many opportunities along with problems.

The Group will advise the firm's clients on energy-related regulatory conformity, financial disclosure, and tax plan. It will deal with issues such as establishing corporate carbon footprints, analyzing business risks, foreseeing insurance coverage issues, preparing for emissions trading, and managing "green building" formation. The Group will also take part in the process of evolving public policy on the matter.

The Group, developed over the past six months, will be chaired by J. Wylie Donald and Stephen Humes. The Group comprises lawyers from several offices and legal disciplines within the firm, including Paul Cellucci, a former U.S. ambassador to Canada and governor of Massachusetts, among others.

Kelley Drye & Warren LLP set to battle Google over trademark violation

Kelley Drye & Warren LLP, a 165-year-old multidisciplinary law firm, will take on Google in what is widely being considered a landmark case.

A United States District Court Judge rejected Google's request for summary judgment in a trademark infringement lawsuit brought by the American Blind & Wallpaper Factory Inc. (ABWF). The Court allowed the case to go to jury in the face of evidence that suggested Google intended to maximize its profits through the trademarks.

This is the first time that Google will face a jury for a trademark dispute on AdWords.

ABWF, a company that sells custom blinds and wallpaper, has charged Google with violating trademark laws. The company claims that Google sold ABWF's rivals keywords that included the company's name and other trademarks. Google has won lawsuits of a similar nature in the past.

This time round, the ruling also said that with a large number of businesses affected by Google's AdWords, it could be in the interest of the public to determine if the program violated the trademark law.

The law firm representing ABWF in this battle, Kelley Drye, has international presence with eight locations, including an affiliate one, worldwide. Nike, Daimler Chrysler AG, and the Reader's Digest Association Inc. are also included among the firms' clients.

Law firm to litigate for victims of medical malpractices

Nationally recognized personal injury law firm Weitz & Luxenberg, P.C. has responded to the report referring to the rise of medical errors in 5,000 American hospitals. The report states that nearly 250,000 patients died because of medical errors.

The frightening finding is part of a study conducted by HealthGrades, Inc., a healthcare ratings organization. Allan Zelikovic, head of the Medical Malpractice Dept. at Weitz & Luxenberg is of the opinion that fear of litigation is the only way to stop this tide from rising.

In the words of Zelikovic, legislative barriers, and insurance companies' propaganda proclaiming a so-called malpractice crisis, have moved the fear factor back to the patients' side of the equation.

The fourth annual Patient Safety in American Hospitals Study conducted for the period 2003 to 2005 rated almost every American hospital on 13 patient safety parameters. The patient safety indicators considered in the study included patient bedsores and foreign bodies left in during medical procedures.

"Some of the infections that sicken people to death come from their exposure to dirty hospitals," comments Zelikovic in a press release of the law firm.
