Canada within reach of US patent litigation


Canadian organizations with significant operations and clients in the United States now stand susceptible to U.S. patent litigation.

While IP protection once only applied to tangible inventions, it now also covers applications concerned with business methods, like check processing, bond trading and systems for tracking the market value of life insurance policies. The number of U.S. patent applications relating to financial institutions has risen phenomenally. From less than 50 applications a few years back, it has moved to more than 600 a year, though many are in dispute.

Citigroup has been among the most aggressive in registering patents, registering about 200. Canadian financial institutions have been a slower in catching up.

Milberg Weiss Bershad & Schulman faces indictment


Milberg Weiss Bershad & Schulman LLP, a respected law firm with offices in New York City, Boca Raton, Wilmington, Washington, DC, and Los Angeles is facing charges for their alleged involvement in a scheme to pay kickbacks to clients. A six-year federal investigation could result in an indictment for the firm. Though the indictment would not prevent the firm from practicing law, it could potentially affect business. Efforts are being made to avert the indictment, but no consensus has been reached so far, as both sides are at odds over a deferred prosecution agreement.

Founded in 1965, the firm has more than 120 lawyers nationwide, practicing commercial litigation involving securities, corporate fiduciary, consumer, insurance, healthcare, antitrust, mass tort and human rights.

DLA Piper: Top of the heap


Philip F. Zeidman, a senior partner with DLA Piper Rudnick Gray Cary US LLP, has been named global Franchise Lawyer of the Year at the Who's Who Legal Awards. DLA Piper also had the honor of being named Franchise Law Firm of the Year.

Zeidman, who chairs the Franchise and Distribution practice in Washington, DC, devotes his practice to domestic franchising law and the rapidly growing field of international distribution, licensing and franchising law. This is the second year in a row he has received the award for the year's best franchise attorney by Who's Who.

DLA Piper's Franchise and Distribution practice includes clients in more than 100 countries, spanning a wide range of industries, including high-tech and life sciences to manufacturing, franchising, distribution and retail. Earlier this year, 15 DLA Piper franchise lawyers were named top "go-to" lawyers by Franchise Times.

Stroz Friedberg expands to the West Coast


Stroz Friedberg, LLC, a national consulting and technical services firm, has opened a new office in Los Angeles.

Located in Century City, the new office contains a fully-equipped forensic laboratory, and is staffed with top-flight digital forensic examiners and investigators. Based on their work in the areas of digital forensics, cyber-crime response and electronic discovery consulting, the firm has developed a global reach. With the new office in place, the firm will be better equipped to serve its clients throughout the West Coast and Pacific Rim.

Founded in 2000, the firm provides technical assistance and strategic advice, as well as assistance in the prevention of computer crime and abuse. The firm incorporates technology law and a unique understanding of behavioral science in its civil and criminal litigation, regulatory and corporate practices.

Pay raise for associates at Clifford Chance


Maintaining their competitive edge in the legal marketplace, Clifford Chance has announced salary hikes for associates. First-year attorneys in the firm's London office will now earn £55,000. This makes the raise an increase of 7.8% from their previous salary of £51,000. In addition to the salary increase, Clifford Chance is in the process of determining individual bonus awards as part of its total reward package for lawyers.

The move puts CC on par with Linklaters, Freshfields Bruckhaus Deringer, Herbert Smith, Norton Rose and Simmons & Simmons, all of whom pay in the same range. With 28 offices in 19 countries throughout America, Asia, Europe and the Middle East, the firm combines in-depth local knowledge and a uniquely global perspective.

DLA Attorney on the Top-10 list


Perrie M. Weiner, partner and International co-chair of DLA Piper Rudnick Gray Cary US LLP's Securities Litigation practice, has been named among the "Top 10 Legal Superstars" by Securities Law360.

The list, published by Portfolio Media of New York, profiles 10 litigators they believe to be the top securities and white-collar litigators in the U.S.

Weiner is a partner with DLA Piper's Los Angeles office and represents private equity funds, including hedge funds, broker-dealers and issuers in SEC and NASD enforcement proceedings, white collar criminal matters and individual and class action securities fraud claims. He also represents private and public companies in both national and international business disputes.

Attorneys questioning immigration system


The state of immigration affairs in the United States is widely considered inefficient and unfair according to a recent poll of immigration attorneys.

A predominance of respondents stated while documentation of immigrant workers is necessary for taxation, not enough immigrants are being taxed. Immigration attorneys also stressed the shortage of H-1B visas for highly skilled foreign workers. Other complaints about the current immigration system included its complexity.

Several respondents claimed that the stress and difficulty in immigration work had caused them to consider switching practice areas.
