David T. Shapiro Speaks at ABA Teleconference on Rockwell Decision
David T. Shapiro, of counsel with Pepper Hamilton LLP, recently participated as program faculty in a teleconference entitled “Relators After Rockwell: What the Supreme Court’s Latest Qui Tam Decision Means For Your Clients.” The teleconference, which was hosted by the American Bar Association (ABA), was held on April 25, 2007.

The conference centered on the March 27, 2007, U.S. Supreme Court decision in Rockwell International Corp. v. United States, which addressed the jurisdictional status of relators – and their rights to a share of the recovery – when the government pursues allegations as to which the relator was not an “original source” under the False Claims Act.

Mr. Shapiro is of counsel in Pepper’s Health Effects Litigation Practice Group. He focuses his practice on the defense of companies and individuals who are under government investigation, and advising corporate officers and directors on related matters.

Mr. Shapiro has an extensive and varied depth of experience in the health care industry. Prior to joining Pepper, Mr. Shapiro served as a trial attorney in the Civil Division of the Department of Justice, Commercial Litigation Section, where he worked closely with attorneys and special agents in the United States Attorneys’ offices throughout the country, the FBI, and offices of the inspector general for HHS, FDA, OPM, FDA, USDA and GSA, from whom he received an “Award of Excellence” in 2005. At DOJ, he primarily handled cases involving health care fraud and abuse issues, including matters involving the False Claims Act, the Anti-Kickback Statute and the Stark Laws.

Andrew Rose Appointed Managing Partner of Nixon Peabody LLP Albany Office; Rose is a community leader and graduate of Albany Law School and Union College Business School
Rose is a 22-year veteran of Nixon Peabody, with a practice focusing on commercial and intellectual property litigation and technology development and commercialization. He also represents print and broadcast media entities in business, newsgathering, and litigation matters.

Attorneys in the Nixon Peabody Albany office also work in the areas of health care, government compliance, labor and employment, corporate transactions, venture capital, private equity, public finance, energy, and environmental.

Active in the Albany community, Andrew Rose is a director and counsel to the Doane Stuart School, past director of the Capital District YMCA, and past chair of the Albany-Colonie Regional Chamber of Commerce Capital Chamber Foundation. He remains involved in a number of Tech Valley initiatives sponsored by the Chamber of Commerce and the Center for Economic Growth, and he is a past recipient of the Chamber’s Volunteer of the Year and the Community Leadership Association’s Distinguished Leadership awards.

Andrew Rose earned his J.D. from Albany Law School of Union University, where he was editor-in-chief of the Albany Law Review. His M.B.A. is from the Union University Institute of Administration and Management, and he has a B.S. and a B.A. from the University of Southern California.

As managing partner for Albany, Rose succeeds Andrew Gansberg, who led the office since 1994. Gansberg will continue his practice, which concentrates on energy regulatory and public utility matters. Office managing partners are appointed by the chair of the firm.

Mayer, Brown, Rowe & Maw LLP advises AIB on financing of The Gate in Newcastle
Mayer, Brown, Rowe & Maw LLP's London real estate finance team has advised Allied Irish Banks plc London Capital Markets Real Estate team on its recent financing of the purchase by Glenn Maud's PropInvest of The Gate in Newcastle for £76.5 million.

Formerly owned by Land Securities, The Gate, which opened in 2002, includes restaurants, bars and clubs, an Aspers Casino and an Odeon cinema.

The Mayer, Brown, Rowe & Maw team was led by London real estate partner Iain Thomas and finance partner Nigel White assisted by finance associate Sahba Akhavan.

Ashurst advised PropInvest and Davies Arnold Cooper advised Land Securities.

Trademark Litigator Kathleen McCarthy Joins King & Spalding
King & Spalding, a leading international law firm, announced today that Kathleen E. “Katie” McCarthy, an intellectual property lawyer with an extensive background in copyright and trademark litigation and unfair competition law, has joined the firm’s trademark litigation practice as a partner in the firm’s New York office.

“Katie has built a reputation as a successful trademark and copyright litigator and an IP transactional lawyer, particularly in the multimedia and luxury goods sectors,” said Courtland L. Reichman, leader of King & Spalding’s Intellectual Property practice. “She not only increases the IP team’s litigation strength in New York, but also adds depth to our New York trademark practice.”

Michael J. O’Brien, managing partner of King & Spalding’s New York office, said, “We welcome Katie to our New York practice and look forward to the contributions she will make to the firm and our clients.”

McCarthy joins King & Spalding from Morgan & Finnegan LLP, where she was a partner. She represents clients in the areas of copyright, trademark and false advertising litigation. She also provides clients in various business sectors, including multimedia and luxury goods, with licensing and due diligence work, opinion practice, management of worldwide trademark portfolios, as well as trademark searching, clearance and prosecution.

McCarthy earned a B.A. degree in Psychology at The College of the Holy Cross and a J.D. degree at Columbia University School of Law.

Thirteen Jackson Walker partners named "Top Lawyers" in Houston

Hunton & Williams Partner Vance Salter Recommended For Florida Bench
Commercial litigation partner Vance E. Salter was recommended to Florida Governor Charlie Crist to succeed outgoing Third District Court of Appeals Judge John G. Fletcher, who will retire in late July. Salter, one of six named by the court's nominating commission, joined Hunton & Williams in 2000. His practice covers problem commercial real estate, creditors' rights (lender/lessor representation), insurance law, construction disputes, defaulted securitizations and appellate advocacy.

A graduate of Brown University, Salter received his law degree from the University of Virginia. Following college, he was a Captain in the US Army Reserves. He began his legal career in Miami with Steel Hector & Davis before moving to Coll Davidson Smith Salter, and then to Hunton & Williams LLP.

The Third District Court of Appeal, located in Miami, will celebrate its fiftieth anniversary on July 1.

GARDERE PARTNERS AMONG D MAGAZINE’S BEST LAWYERS
Six partners at Gardere Wynne Sewell LLP are among “The Best Lawyers in Dallas” according to D Magazine.

In its May 2007 issue, D Magazine features 239 attorneys in 20 practice areas who have been selected by their peers as “The Best Lawyers in Dallas.” Among the honorees are Gardere partners:

Compiled every two years, the 2007 edition marks D Magazine’s fourth “Best Lawyers in Dallas” list. Mr. Dyer and Mr. Schoenbrun were also honored in 2001, 2003 and 2005. Mr. Nicewander was also among those honored in 2005.

To compile its “The Best Lawyers in Dallas” listing, D Magazine solicited nominations from more than 2,000 of the city’s attorneys. Voters were required to nominate only those attorneys whose work they had firsthand knowledge of, including firm colleagues, co-counsel, lawyers they had observed in court and opposing counsel. An outside firm tabulated the ballots, with an executive panel finalizing the list.
