Jordan Yarett Named a "Dealmaker of the Year" by The American Lawyer
Corporate partner Jordan Yarett was named a "Dealmaker of the Year" as announced in the April issue of The American Lawyer. Jordan was selected for his representation of Lehman Brothers Inc., the lead underwriter and sole structuring agent for Dunkin’ Brands Inc., which franchises the Dunkin’ Donuts, Baskin-Robbins and Togo’s brands in the United States and throughout the world, in its $1.7-billion securitization of substantially all of its revenue generating assets. The article notes the deal was extremely complex and required Dunkin’ Brands to contribute its existing assets to several bankruptcy-remote special purpose vehicles and contribute all future revenue generating assets to these various entities. The article notes that the securitization posed unique challenges because Dunkin' Donuts and Baskin-Robbins have franchises in more than 100 countries, with more than 100 different legal systems governing the franchises, and had to address issues surrounding franchise royalties, real estate leases and environmental concerns for each of its stores. The article notes that Jordan's team was able to convince the rating agencies that they could execute a deal as complex as this – $1.5 billion of the notes got the highest rating from S&P and Moody's. The article also highlights some of Jordan's other notable deals, including representing Arby's Restaurant Group, Inc. in 2000 in one of the first intellectual property securitizations, The Quiznos Master LLC in a complex securitization in 2005 and the Sonic fast-food chain in an $800 million offering in 2006. Jordan was among 16 lawyers selected by The American Lawyer, which noted that "when the circumstances demanded innovative solutions, these lawyers distinguished themselves.

When It Comes Down To A Fight These 10 Attorneys Are Tops At Winning Business Disputes In The Courtroom
Finnegan Henderson lawyer J. Michael Jakes was profiled in the Legal Times as one of the top ten business litigators in the Washington metro area. When clients talk about hiring J. Michael Jakes to handle their patent litigation, the relief in their voices is palpable. Not only does the Finnegan Henderson partner have an outstanding reputation for winning cases, he exudes an infectious sense of calm.

Tim Crean, chief IP officer at SAP, had worked with Jakes at Finnegan in the 1990s and has hired him for several cases since going in-house, first at Sun Microsystems Inc. and now at SAP. “Mike is the litigator to choose when you need the best, whether it’s delivering a flawless closing argument or crafting an appellate brief,” says Crean. “He’s also incredibly easy to work with.”

Leonard Metheny, Jr., president and CEO of ApplyYourself Inc, a Fairfax, VA-based technology service provider turned to Jakes in 2004 to handle a Federal Circuit appeal in a difficult patent dispute with College Net Inc. “A number of legal minds I’d consulted had recommended him,” says Metheny. “And after interviewing him—among other litigators—I felt he had a way of speaking to me as a businessperson that gave me a lot of confidence. Also, his record of litigation is outstanding.”

Like many other patent lawyers, Jakes came to the field armed with hard-science experience. He majored in electrical engineering in college, worked for a few years at Westinghouse, and earned a master’s degree in computer science in 1983. After graduating from Georgetown University Law Center in 1986, Jakes took at clerkship with Federal Circuit Judge Giles Rich. From Rich’s chambers, Jakes joined Finnegan Henderson. In years since, he has become particularly sought after for his appellate work before the Federal Circuit. He co-writes a treatise on Federal Circuit practice and procedure, published by Matthew Bender.
