William Josephson to Receive Public Service Citation from University of Chicago
Fried, Frank, Harris, Shriver & Jacobson LLP retired partner William Josephson will receive a Public Service Citation from his alma mater, the University of Chicago, on June 2, 2007. The Public Service Citations honor those alumni who have fulfilled the obligations of their education through creative citizenship and exemplary leadership in service that has benefited society and reflected credit on the University.

Early in his career at the U.S. State Department Josephson co-wrote a paper that became the basis for the creation of the Peace Corps. He served as its founding counsel and later general counsel. As a partner at Fried Frank, he represented New York City’s pension funds in refinancing the city debt in the 1970’s. In 2004, he retired after five years as assistant attorney general-in-charge of the New York State Law Department’s Charities Bureau, where he led investigations of nonprofit organizations and supported federal and state legislation to improve oversight.

Freshfields China group wins four China Law Awards
International law firm Freshfields Bruckhaus Deringer's China group won four awards at the Asian Legal Business (ALB) China Law Awards 2007, held in Shanghai on 27 April. The ALB China Law Awards recognise and promote outstanding professional achievement and some of the best legal work of the year throughout China.

Freshfields Bruckhaus Deringer won:

Equity market deal of the year for the initial public offering (IPO) of Industrial and Commercial Bank of China (ICBC) which raised US$21.9bn, making it the largest IPO in the world to date. This is also the first ever simultaneous A + H share listing on the Hong Kong and Shanghai stock exchanges. Freshfields acted as Hong Kong counsel to Merrill Lynch, China International Capital Corporation, Credit Suisse, Deutsche Bank and ICEA Capital, the joint bookrunners on the IPO. The Freshfields team was led by partner Teresa Ko.

Energy & Resources deal of the year for the IPO of China Coal Energy Company Limited (China Coal). China Coal is one of China's largest coal suppliers. Total proceeds of the IPO was US$2bn. Freshfields Bruckhaus Deringer acted as counsel to the underwriters on this IPO, led by China International Capital Corporation (CICC), Citigroup and Morgan Stanley. The Freshfields team was led by partner Ng Kay Ian.

IT/Telecommunication deal of the year where Freshfields advised China Unicom Limited (Unicom) in relation to its issue of US$1bn convertible bonds to Korea's SK Telecom Co., Ltd. (SKT) and the proposed cooperation between the two companies in certain CDMA cellular communications business areas in Mainland China. The US$1bn bonds issued to SKT are convertible into shares in Unicom one year after issue. Upon full conversion, the bonds will be convertible into approximately seven per cent of the issued share capital of Unicom. The Freshfields team was co-led by finance partner Patrick Lines and corporate partner Teresa Ko.

International Dealmaker of the year which was awarded to Hong Kong based partner Teresa Ko for her role in advising on the mammoth US$21.9bn Hong Kong IPO, global offering and the simultaneous A + H share listing of of ICBC on the Hong Kong and Shanghai stock exchanges. Teresa commented "I am thrilled and very honoured to receive this award. Thanks to all those clients and peers and other intermediaries who have supported us through our growth to where we are today. The ICBC deal helped China to make its mark on the world and we are tremendously proud to have been a part of it."

Jody Newman featured in Massachusetts Lawyers Weekly
Jody Newman, Managing Partner at Dwyer & Collora, is featured in Massachusetts Lawyers Weekly as part of an article on female managing partners in Boston.

The newest of the female managing partners is Jody L. Newman, who, at 49, took the reins at Boston's Dwyer & Collora in January. A member of the firm since 1984, Newman says the challenge for her and her managerial counterparts in other Massachusetts firms "is not doing the job but getting the job."

The fact that so few women have attained the post, Newman says, is a function of the small number of women achieving partnership status. "Only 17 percent of partners, nationally, are women," she reports.

The lack of term limits for managing partners at many firms also is seen as an obstacle for women seeking to break into management. Newman's predecessor at Dwyer & Collora, William H. Kettlewell, held the post for 11 years until, she says, "he asked me if I wanted to do it."

Davis & Gilbert announced today that partners Ronald R. Urbach and Joseph J. Mr. Urbach is considered one of the country's leading advertising, promotion and marketing lawyers. His clients include numerous multinational, national and regional advertising agencies, including those agencies that are viewed as being the top creative agencies in the world.

Mr. Lewczak also is a partner in the Advertising, Marketing and Promotions Department of Davis & Gilbert. He will discuss “IP structures and business models in other Creative/Service industries.”

Mr. Lewczak represents numerous multinational, national and local advertising agencies, promotions agencies, advertisers, direct marketers, and telemarketers in connection with all aspects of advertising, promotions, marketing, direct marketing and telemarketing. He has considerable experience in all areas of advertising, direct marketing and promotions, and he is an expert in the areas of games of chance, complex skill contests, telemarketing, direct mail and charitable solicitations.

“Motivation, Teaching, Suggestion” Test Removed from Obviousness Analysis in KSR v. Teleflex, Future Patent Cases
The Supreme Court’s decision today in KSR International Co. v. Teleflex Inc. will have “broad implications” for everyone seeking patent protection on their innovations says Dr. Shannon Mrksich and Ms. Meredith Addy, partners at Brinks Hofer Gilson & Lione, one of the largest intellectual property law firms in the U.S. In November 2006, Dr. Mrksich and Ms. Addy filed an Amicus Brief in the case, arguing that the “Federal Circuit for decades had correctly applied a teaching, suggestion or motivation (“TSM”) test that worked across a range of industries.”

“Today, the Supreme Court called the TSM test a ‘helpful insight,’ but held that it was being applied too narrowly and rigidly,” says Dr. Mrksich. “Going forward, we now know that an invention is obvious if a skilled person would pursue a solution to the problem based on known options within their technical grasp.” Ms. Addy, a former Federal Circuit clerk, believes that this decision, along with other recent Supreme Court decisions on patent matters, “will have far-reaching ramifications as patent holders and competitors reevaluate existing patents.”
