Hogan & Hartson Expands Growing Berlin Office With Leading Tax Partner
"Hogan & Hartson LLP announced today that Dr. Jens-Uwe Hinder will strengthen the firm’s Berlin office. Dr. Hinder joins Hogan & Hartson from Hammonds, where he has practiced as a partner and the head of the tax practice since 2002. An experienced international transactions partner, Hinder will play an important role in the further expansion of Hogan & Hartson’s national and international tax practice in Germany.

Dr. Hinder advises national and international businesses and has extensive experience in the structuring of real estate transactions. Additionally, he focuses on international tax planning, advising on tax matters related to M&A transactions, tax structuring of funds, and settlement (transfer) prices.

“We are delighted that Dr. Hinder is joining our Berlin office,” said Dr. Gernod Meinel, managing partner of the firm’s Berlin and Munich offices. “Due to the constant increase of our advisory activities related to international transactions, we are experiencing an increased demand for integrated tax advice. After strengthening our tax practice in Munich with the addition of Sebastian Kost as well as expanding our private equity practice with Dr. Uwe Steininger, we have now gained a highly qualified partner that is the ideal addition to our transactional team in Germany.”

Dr. Hinder, who is both an attorney and a tax consultant, studied at the universities of Bonn and Freiburg and received his doctorate degree at the University of Münster. His legal career started 1991 at Brandi, Dröge, Pilz & Heuer in Detmold, Germany. After completing his Master of Laws degree at the University of San Diego and the second state exam in law 1995, Dr. Hinder worked at KPMG, followed by joining the law firm of Schmidt Hampel-Dorrmann Schmidt in 1999 and joining Hammonds in 2002.

London, Paris and New York Offices Represent Converium in Defense of $2.5B Unsolicited Offer
The firm's London, Paris and New York offices are representing Converium Holding AG in connection with its defense of the $2.5 billion unsolicited offer by SCOR S.A. Under the terms of the offer, SCOR has proposed that each Converium registered share may be exchanged for 0.5 ordinary shares, with a nominal value of €7.8769723, of SCOR and 4 Swiss Francs. Converium AG is an independent international multi-line reinsurer with about 500 employees in 15 offices around the world. Converium is being represented by London partner Gregory Astrachan; New York partners Richard Posen, Tariq Mundiya, Roger Netzer and Robert Stebbins; Paris partner Laurent Faugérolas, Paris Special European Counsel Etienne Boursican, London associate Jonathan Gatsik; and New York associates Lisa Bentley, Scott Eisenberg and Theodore Neos.

Thompson Hine Adds Intellectual Property Lawyer
Roger H. Bora has joined the law firm of Thompson Hine LLP as a member of the firm’s Intellectual Property practice group. He concentrates his practice in trademark law, counseling clients on the selection of new trademarks, trademark clearance, trademark policing and enforcement, trademark practice before the U.S. Patent and Trademark Office, and the preparation of agreements pertaining to intellectual property. Mr. Bora's broad trademark experience enables him to protect clients' intellectual property rights before the Trademark Trial and Appeal Board.

Prior to joining the firm, Mr. Bora was a practicing trademark attorney at a full-service law firm in Portland, Maine. He also practiced as a trademark examining attorney with the U.S. Patent & Trademark Office in Arlington, Virginia.

Mr. Bora earned his J.D. and M.I.P. (Master of Intellectual Property) from Franklin Pierce Law Center in 1999, his B.S. in business management from Saint Michael's College in 1993 and a degree in marketing from Champlain College in 1990.

Thompson Hine Partner to Receive Burton Award for Legal Writing
Thompson Hine LLP partner Leslie W. Jacobs has been selected to receive the 2007 Burton Award for Legal Achievement. The award, which honors excellence in legal writing, is for his article “Criminal Enforcement of Antitrust Laws – Problems with the U.S. Model,” which was written for the Fordham Competition Law Institute on international law and policy. The article focuses on aberrations in the application of criminal law procedures and penalties to collaborative business activities. It was written as a counterpoint to arguments advanced by the Assistant Attorney General in charge of the Antitrust Division of the U.S. Department of Justice, encouraging international adoption of the U.S. model.

Mr. Jacobs is the senior partner in the firm’s Competition, Antitrust & White-Collar Crime practice group. He also is chair of the U.S. Law Firm Group’s International Practice Committee. Mr. Jacobs is a past president of the Ohio State Bar Association and served on the board of governors of the American Bar Association, among numerous other professional, community and business activities. He is a frequently published author and prolific international lecturer on competition law and business topics.

The Burton Awards will be presented in the Great Hall of the Library of Congress in Washington, D.C., on June 4, 2007. Only 30 partners from the top 1,000 firms in the country who competed for the awards will receive the honor. The submissions, which include articles published over the previous year, are nominated by managing partners of law firms and law school deans from across the country.

Rumberger, Kirk & Caldwell Partner Jacey Kaps Wins Trial For Kmart Corporation
The case involved a plaintiff, Suziana James, who claimed that she slipped – but did not fall – on a water spill in an aisle at a West Palm Beach Kmart store. Although the plaintiff originally asserted that the size of the puddle was around three feet, she changed her testimony several times during the trial, stating that the puddle was bigger. The plaintiff claimed that as a result of the accident, she developed a knee problem, which required both arthroscopic surgery and physical therapy. She also contended that she developed herniations in both her neck and back. As a result of these injuries, the plaintiff argued that she was unable to work and would not be able to do so in the future. She sought recovery for her medical expenses, as well as lost wages, future wages, and pain and suffering.

Kaps made several arguments for the defense. First, he asserted that if there was, in fact, a spill, it was not present long enough for the defendant to reasonably know about it. Kaps also pointed out that the plaintiff’s knee injury, as well as her herniated neck and back, were pre-existing conditions proved through medical records and the testimony of her doctors. Finally, Kaps submitted evidence that proved the plaintiff had been working – despite her statements to the contrary.

After only 45 minutes of deliberation, the jury returned with a defense verdict.
