SPILMAN THOMAS & BATTLE NAMED 2006 FIRM OF THE YEAR
Legal Aid of West Virginia, Inc. recently named Spilman Thomas & Battle, PLLC the “2006 Firm of the Year” for contributing the most pro bono hours to their Pro Bono Referral Project in the past year.

Spilman attorneys handled a variety of cases including domestic violence, family law, consumer issues and evictions. Eric W. Iskra, Member in Charge of Client Relations, was pleased the firm was recognized at the West Virginia State Bar meeting on April 27. “We believe that it is fundamental for every firm to give back to the community by helping those who need access to legal services. We are privileged to partner with Legal Aid of West Virginia and all of their efforts.”

According to Heidi Holland Seamon, Managing Attorney of the Pro Bono Referral Project for Legal Aid, having corporate firms involved in their cases is pivotal. “The success of the Pro Bono Referral Project is dependent upon our volunteer attorneys. We are excited about partnering with Spilman Thomas & Battle, and hope to serve even more clients in the remainder of 2007.”

Legal Aid of West Virginia provides free advocacy services to West Virginians for civil legal problems; assisting residents living in nursing homes, personal care homes and long term care facilities; and providing services to individuals who live with behavioral health challenges.

Smith Moore Joining with Carter & Ansley to Bolster Broader Capabilities
Two familiar names in the Atlanta legal community are combining their practices. Smith Moore LLP and Carter & Ansley LLP have joined forces effective today, the firms have announced. This is the second expansion move for Smith Moore in as many months; the firm opened a new office in Charlotte on March 1st.

Smith Moore currently has 115 attorneys practicing in offices located in Atlanta, Charlotte, Raleigh, Greensboro, NC and Wilmington, NC. Carter & Ansley, one of Atlanta's oldest law firms, has 13 attorneys, and the move will increase Smith Moore's Atlanta office to 23 attorneys.

"Atlanta is obviously a very important location for a regional law firm like ours," says Smith Moore managing partner, Steve Earp. "By adding the Carter & Ansley lawyers, we more than double the size of our presence in Atlanta. That is an indication of Smith Moore's commitment to be a key firm in this city."

Carter & Ansley partner Sanders Carter says strategic growth opportunities were key to the firm's decision to combine with Smith Moore. "Carter & Ansley is nationally known, particularly for our capabilities in representing life, health and disability insurance companies," Carter said. "Our union with Smith Moore is a step that will enable us to expand our practice to a regional platform that we could not access at our previous size. And the work we do will fit nicely into the full range of service that Smith Moore provides."

K&L Gates’ Emily Won Honored with Professional Achievement Award
Kirkpatrick & Lockhart Preston Gates Ellis LLP (K&L Gates) partner Emily L. Won has received a Professional Achievement Award from the Asian Pacific American Lawyers Association of New Jersey (APALA/NJ).

This honor is presented to Asian Pacific American lawyers who have advanced professionally and added significantly to the law firm or company where they work. Won received the award during APALA/NJ’s annual dinner, where she was also recognized for recently making partner at K&L Gates.

Also at the dinner, K&L Gates Partner David S. Kwon was inducted for a one-year term as APALA/NJ’s vice president in recognition of his active leadership in the Asian Pacific American legal community.

Won and Kwon lead the firm’s diversity initiative in the Newark office.

Perkins Coie Names Miller Denver Managing Partner
Perkins Coie announced today that its Executive Committee has appointed Robert (Bob) N. Miller to succeed Jeff Cowman as managing partner of its Denver office.

Miller joined the firm in 2003. He has more than 30 years of experience in complex litigation and white collar crime. As the former U.S. Attorney for the District of Colorado, he has extensive experience in representing companies and individuals in connection with investigations by federal and state prosecutors. He also routinely conducts internal investigations and advises companies on compliance programs.

"Bob is a natural leader, both within the firm and in the community," said Robert Giles, the firm's managing partner. "He will be a tremendous ambassador for the firm in the Denver area."

In November, Miller successfully led the charge in the "No on 40" campaign against term limits for Colorado Supreme Court justices and Court of Appeals judges. He also sits on the board of trustees for the Colorado Bar Foundation, a non-profit organization that promotes the advancement of jurisprudence and the administration of justice in Colorado through grants to help educate the general public and provide assistance to the State's legal institutions. In addition, Miller sits on the Board of Directors of the Colorado Judicial Institute which promotes the independence and educational programs for the judiciary.

Messerli & Kramer Attorney Completes Boston Marathon
Messerli & Kramer P.A. attorney Nicholas J. Eugster has completed the 111th Boston Marathon held April 16 with a finish time of two hours, 49 minutes and 52 seconds.

To qualify for the Boston Marathon, runners must meet standard time minimums at other certified marathons throughout the previous year. The legendary Boston Marathon course follows a point-to-point route (26 miles, 385 yards) from rural Hopkinton, Massachusetts to Boston.

Nick is an associate attorney in Messerli & Kramer's General Litigation group. When he's not running marathons, Nick focuses his practice on business litigation, contract disputes, land use disputes, condemnation, construction and mechanic's lien litigation, creditor's rights and remedies, and landlord-tenant law.

Federal Court Certifies Washington Consumer Class Action Against Carrier Corporation For Concealing Defects In High-Efficiency Carrier, Bryant And Payne Furnaces
Class counsel announced that today United States District Court Judge Ronald B. Leighton ordered that a case filed by current and past Washington State owners of high-efficiency furnaces manufactured by Carrier may proceed as a class action lawsuit.

The class action complaint alleges that in the mid to late-1980s Carrier stopped using high-grade stainless steel secondary heat exchangers in favor of cheaper polypropylene laminated ("PPL") mild steel. Carrier switched to the cheaper material despite the fact that the industry standard was (and still is) to use high grade stainless steel for condensing heat exchangers to prevent corrosion.

Carrier has never disclosed to consumers that the new heat exchangers are not as robust as ones manufactured from stainless steel or that their furnaces would not last as long as consumers typically expect. The case was filed on behalf of tens of thousands of Washington individuals and entities who purchased Carrier, Bryant and Payne high efficiency furnaces since January 1, 1989.

"In Washington, homeowners run their furnaces for at least five months of the year," stated Kim D. Stephens, counsel for plaintiffs with the Seattle law firm of Tousley Brain Stephens PLLC. "It is of great concern that Carrier would sell a furnace that could potentially malfunction in the dead of winter."

"Carrier's warranty does not cover labor charges for replacement of the failed part," explained Jonathan D. Selbin, plaintiffs' counsel with the national law firm of Lieff Cabraser Heimann & Bernstein, LLP. "Homeowners who bought their furnace on the assurance by Carrier that it would last a lifetime have been forced to spend hundreds or even over a thousand dollars on the repair of their faulty furnace, or have had to spend thousands on a brand new furnace."

High-efficiency condensing (or 90%) furnaces maximize efficiency by employing a second heat exchanger to extract more heat from the hot gases through condensation. These furnaces are typically more expensive than non-condensing (or 80%) furnaces.
The complaint charges that the PPL degrades and disintegrates due to the high temperatures in the furnace. When the PPL separates from the steel, it exposes the underlying mild steel to acidic condensate. In some cases, the corrosion proceeds to the point of actually perforating the outside wall of the heat exchanger.

In the United States, Carrier warrants the heat exchanger for the lifetime of the original purchaser and for 20 years for subsequent purchasers. Despite this warranty, the complaint charges that Carrier's condensing furnaces fail prematurely and well before their warranted and expected life, resulting in consumers having to incur substantial charges on the labor to repair their furnace or on the purchase of a new furnace.

The Washington lawsuit is part of litigation in a number of jurisdictions against Carrier Corporation for concealing defects in its condensing furnaces. Homeowners in Wisconsin, Michigan and Ontario, Canada have also filed class action complaints against Carrier Corporation, each setting forth similar allegations, and additional cases will be filed shortly.
