Kramer Levin Among Top Ranked Firms in Major, Lindsey & Africa Lateral Partner Satisfaction Survey
Kramer Levin was named one of the top nine law firms in lateral partner integration satisfaction in a Major, Lindsey and Africa survey. Surveys were sent to 5,622 law firm partners in 647 firms who changed firms in the past several years; more than 1,000 responses were received, revealing the factors that make such moves successful – or not. The laterals who participated in the Survey indicated that money was not the driving force behind their decision to change firms. It was more about platform: laterals are looking for support – i.e., support for their careers, practices and clients. The Survey measured eight critical factors weighed by laterals in choosing their new firms; contrasted experiences in different practice areas, geographic locales, and by gender; and revealed which firms were rated highest in both lateral partner satisfaction and integration.

Bank Found Liable For Fraud and Possible Missouri Unlawful Merchandising Practices Act Violations For Failing To Disclose An EPA Investigation To Buyer, Even Though Real Estate Contract Attempted To Disclaim Such Liabilities
Buyer purchased real estate from bank at time bank was aware that the property was being investigated by the Environmental Protection Agency (EPA) for possible illegal hazardous waste dumping on the property by its prior owner, on whose deed of trust bank had foreclosed. Bank did not disclose the EPA investigation to the seller. After closing, seller was made aware of the EPA investigation and filed suit for fraud and Missouri Unlawful Merchandising Practices Act violations. The Missouri Supreme Court ruled that seller’s fraud verdict is valid, even though bank had asserted in the sale contract that it “had never seen nor occupied the property,” that it had “not inspected [the] property,” that bank was making “no representations, guaranties, or warranties, either written or implied, regarding the property,” and that “the property is being sold in AS-IS condition with no express or implied representations or warranties by the seller or its agents.” Bank had not completed a seller’s disclosure form, even though required to do so by the sale contract. The court ruled that the jury could find that bank’s failure to disclose the known EPA investigation was an undisclosed material information which was not discoverable through ordinary diligence and constituted fraud by silence. Further, the Supreme Court remanded for consideration of further Missouri Unlawful Merchandising Practices Act violations and damages, as the trial court’s dismissal of those claims prior to trial was improper and buyer had only proven three (3) of the required (4) elements. Thomson Recognized in 40 Under Forty
Blackwell Sanders Partner Spencer Thomson has been recognized in Ingram’s 40 Under Forty, as profiled in the April 2007 issue of Ingram’s Magazine. The purpose of Ingram’s 40 Under Forty is “to identify the young people in our midst most likely to succeed and to lead, those with potential to make this a better community in which to live and work.” Ingram’s 40 Under Forty

Thomson has long had an enthusiasm for politics and public policy. He has served as lead or co-counsel on several major commercial redevelopment projects throughout the Kansas City metro region. In 2005, Governor Matt Blunt selected Thomson to serve on the statewide Eminent Domain Task Force. Subsequently Thomson spent much of the 2006 legislative session helping to craft the new eminent domain legislation that became law in August 2006. He worked closely with the leadership in the state legislature, representatives of the executive branch and numerous other interested stakeholders including the City of Kansas City.

Thompson Hine Ranked as One of Top Four Firms by Lateral Partners
According to a recent survey of lateral partners, Thompson Hine ranks fourth in the country (among firms of 500 lawyers or less) both in general satisfaction and in integration effectiveness. The survey, Lateral Partner Satisfaction: A Decade of Perspective, was conducted by Major, Lindsey & Africa, one of the world's largest legal search firms, specializing in the recruitment of attorneys for law firms and corporate legal departments. The survey was sent to more than 5,000 lateral partners in more than 600 law firms and measures factors such as expectations vs. reality after joining a firm, success in integration and the direct relationship between that success and laterals’ satisfaction.

“We have devoted a lot of time and effort to our lateral integration program at Thompson Hine. Our program has two primary objectives – allowing lateral partners to make a seamless transition to our firm in terms of service delivery to their clients and creating greater opportunities for lateral partners to expand their practice with us.” says Deborah Z. Read, hiring partner and chair of lateral recruiting and a member of Thompson Hine’s Executive Committee. “The rankings in this survey are evidence that our efforts are paying off. We continue to look for ways to differentiate our firm with lateral recruits, and we find that immediate practice and cultural integration are the key to lateral partner satisfaction.”

John Munich Joins the St. Louis Office
Stinson Morrison Hecker LLP announces the addition of John Munich as a partner to its St. Louis office. Though a resident of St. Louis for the past eight years, John has been a partner in the Atlanta and Washington, D.C. offices of Sutherland, Asbill & Brennan, LLP. Prior to joining SAB, John served as Chief of Litigation and Deputy Attorney General in the Missouri Attorney General’s office.

During his time in the Attorney General’s office, Munich successfully argued Missouri v. Jenkins, 515 U.S. 70 (1995), one of the leading school desegregation cases decided by the Supreme Court in recent years. The victory resulted in an immediate savings of more than $90 million per year to the state of Missouri.

“Our clients will benefit from John’s significant experience and national reputation as an outstanding trial and appellate attorney,” said Larry Bauer, St. Louis firm co-managing partner. “His extensive expertise in education, healthcare, government, civil rights and commercial litigation helps us continue to strengthen and build our St. Louis office and the entire firm.”

During his more than 25 year career, Munich has successfully represented public and private clients in numerous trials and appeals in state and federal courts around the country, including the United States Supreme Court. Most recently, he was co-counsel with the Attorney General’s office in the two-month long trial over Missouri’s public school funding system.

Munich has represented the states of Arizona, Florida, Michigan, Minnesota, Missouri, New Hampshire, North Dakota and New York in high-stakes education cases. He also has significant healthcare litigation experience in the areas of long-term care, False Claims Act suits and compliance issues. While serving as Chief of Litigation and later as Deputy Attorney General in the Missouri Attorney General’s office, Munich:

* Served as lead trial counsel in the St. Louis and Kansas City school cases. In the St. Louis case he negotiated a complicated, multi-party settlement agreement that resolved the litigation that had spanned more than two decades.

* Helped create and oversaw the operations of Missouri’s Medicaid Fraud Control Unit, and later was active in the prosecution of False Claims Act cases during his time as Special Assistant United States Attorney for the Eastern District of Missouri.


In 2007, Munich was recognized in The Best Lawyers in America. He earned his juris doctorate with honors from St. Louis University School of Law, and Bachelor of Arts degree from St. Louis University.

Schiff Hardin LLP Welcomes Sony B. Barari as an Associate in the San Francisco Office
Schiff Hardin LLP has added Sony B. Barari as an Intellectual Property Group associate in the San Francisco office. Mr. Barari joins the firm after completing a master's degree at Harvard University.

Mr. Barari focuses on a wide range of intellectual property matters, including a particular emphasis on biotech-related patents and trademarks.

Mr. Barari received his undergraduate degree (B.S., Molecular, Cell, and Developmental Biology, 2002) from the University of California, Los Angeles and his law degree (J.D., 2005) from the College of William & Mary, Marshall-Wythe School of Law. He also is a candidate for a graduate degree (A.L.M., expected in 2007) from Harvard University. He is admitted to practice in California and the U.S. Patent and Trademark Office.

Earlier in his career, Mr. Barari was a patent associate at Curis, Inc., where he handled that corporation's patent portfolio. During law school he interned at the U.S. Patent and Trademark Office.

Mr. Barari is fluent in Bengali.
