King & Spalding’s September e-Learn to Examine Climate Change Regulation Issues
As part of King & Spalding’s monthly e-Learn series, an hour-long web seminar entitled "Recent Developments in Climate Change Regulation: Are You Ready? Do You Need to Be?" will be offered to King & Spalding clients on September 18, 2007 at 12:30 p.m. EDT. The presentation will provide attendees with a comprehensive understanding of the current state of climate change regulation.

Speakers on the panel will include King & Spalding partners George C. Crawford, Stephen J. Orava and Cynthia A.M. Stroman. Each will bring their unique perspective to the issue of climate change regulation.

Among the issues to be addressed in the May 16 seminar are:

* Federal legislation developments (or lack thereof) on Capitol Hill;
* Carbon Tax vs. Cap-and-Trade: will either pass muster with the WTO?; and
* State-level Regulation: lessons learned about what makes companies targets for regulation and vulnerable to competitive disadvantage.

The seminar will be presented online from 12:30 to 1:30 p.m. EDT. Clients of the firm will be able to participate online, or may view the program at the firm’s offices in Atlanta, Houston, London, New York, and Washington, D.C. Participants in the King & Spalding e-Learn Series generally receive CLE credit for attending the program.

Speakers
George Crawford is a senior government relations advisor in King & Spalding’s government advocacy and public policy practice group where he works with the firm’s clients to develop and implement strategies to successfully achieve their legislative policy goals. Prior to joining King & Spalding, Crawford most recently served as Chief of Staff for House Democratic Leader, Nancy Pelosi (D-CA) where he was the principal advisor on policy, political and procedural matters.

Stephen Orava is a partner in King & Spalding's international trade practice group and is based in the London and Washington offices. He advises clients on a wide range of international trade, market access, investment, and other regulatory matters. Orava has significant experience representing governments and private sector clients in market access and dispute settlement matters under the agreements of the World Trade Organization (WTO), and he has prepared written submissions and presented oral arguments to WTO dispute settlement panels and the Appellate Body. He also advises clients regarding compliance with U.S. and E.U. export controls and sanctions and in Chinese, EU, Indian, Mexican, and U.S.antidumping and countervailing duty (anti-subsidy) proceedings.

Cynthia Stroman is a partner in King & Spalding’s tort and environmental litigation practice and resides in the firm’s Washington, D.C. office. She focuses her practice on complex scientific issues related to hazardous substance exposure and risk assessment in litigation or regulatory matters and on environmental and technical issues pertinent to project development and transactions in the energy, chemical and commercial real estate industries. Her practice also emphasizes Clean Air Act compliance, permitting and enforcement.

Mr. Gilligan is the senior member of the firm’s litigation department. Mr. Gilligan has received professional distinctions in his litigation specialty by being named a Fellow of the American College of Trial Lawyers (1985 to present); and an Advocate in the American Board of Trial Advocates (1989 to present). Ms. Hogan has taught trademark law at the University of Cincinnati College of Law and served as an adjunct professor at the College of Mount St. Joseph. Mr. Irwin has represented creditors’ committees, court appointed legal representatives, and the trustees of mass tort settlement trusts in large mass tort bankruptcy proceedings. Mr. Irwin is lead counsel to the Celotex and UNR asbestos trusts, respectively one of the largest and one of the oldest such asbestos settlement trusts operating today. Mr. Klekamp has been successful in helping to nurture developing businesses and with assisting these businesses in selling their securities to the public in initial public offerings.

Mr. Kreider concentrates his practice in the areas of securities regulation compliance, public offerings, private offerings, mergers and acquisitions and business planning and formation. Mr. Kreider has been an Adjunct Professor in securities regulation since 1977 at the University of Cincinnati College of Law and is Chairman of the Corporation Law Committee of the Ohio State Bar Association for 2003-2004.

Mr. Maxwell represents management in all facets of labor and employment law. He has extensive experience in trials and appeals in federal and state courts and in investigations and administrative proceedings before federal and state agencies, including the NLRB, EEOC, OSHA and OFCCP. Mr. Maxwell frequently negotiates collective bargaining agreements and represents employers in arbitrations involving claims made by unions and individuals. Mr. Muething’s practice is concentrated in the areas of business planning, corporate law and real estate development. Mr. Muething has served as the Managing Partner of the firm since 1995.

Mr. Sanker’s practice is primarily concentrated in the areas of bankruptcy, reorganization and creditors'' rights, but he also represents a number of small businesses on general corporate matters. He is a frequent speaker on insolvency related topics and is currently Chairman of the Executive Committee of the Midwest Regional Bankruptcy Seminar, Inc. Ashley Cummings Secures Pro Bono Victory in the Eleventh Circuit
Nearly seven months after Ashley Cummings presented oral argument, the U.S. Court of Appeals for the 11th Circuit issued an opinion in our client's favor. The Court affirmed a district court's decision which in turn had affirmed a bankruptcy court's opinion in favor or our pro bono client, a homeless man and disabled veteran who appeared pro se before the bankruptcy court seeking a discharge of his student loan debt. To discharge student loan debt, the debtor must prove an "undue hardship." The Eleventh Circuit held that the debtor's credible testimony about his condition is sufficient to support a bankruptcy court's finding of undue hardship. This is an important decision, indicated by the Eleventh Circuit's decision to hear oral argument on the appeal and to publish its opinion. Jason Beach assisted in appeal.

Gentry Locke adds Two Associates:
The Roanoke law firm of Gentry Locke Rakes & Moore is pleased to announce the addition of attorneys Joshua C. Johnson and Macel H. Janoschka to the firm.

Macel Janoschka will practice in areas of workers compensation, insurance defense, and related litigation matters.

Prior to joining Gentry Locke, Ms. Janoschka was a Judicial Law Clerk for all four Roanoke City judges in the 23rd Judicial Circuit of Virginia. Ms. Janoschka earned her Juris Doctor from the University of South Carolina School of Law in Columbia in 2006, where she served as articles editor for the ABA Real Property Probate & Trust Journal. Prior to graduating, she held internships at the U.S. Army JAG and with The Honorable Robert M.D. Turk in Christiansburg. In 2003, Ms. Janoschka received her undergraduate degree from Virginia Polytechnic & State University.

Joshua Johnson has joined the firm as an associate and will practice with the Firm’s Commercial Litigation practice group. Prior to joining Gentry Locke, Mr. Johnson was a litigation associate for two years at another local law firm. Prominent Litigator Gregory P. Miller Leads Group of 12 Lawyers to Drinker Biddle
Citing both its outstanding national litigation platform and its traditions of professional excellence and client service, prominent litigator Gregory P. Miller and 11 additional lawyers from premier boutique firm Miller Alfano & Raspanti, P.C., are joining the Philadelphia office of Drinker Biddle & Reath LLP.

Miller, who is managing partner of Miller Alfano, will be joining Drinker Biddle as a partner. Four of Miller’s colleagues, Heather C. Giordanella, Maria L.H. Lewis, Gregg W. Mackuse and Stephen G. Stroup, will be joining as Of Counsel to the firm. Seven other lawyers will be associates at Drinker Biddle when the move becomes official on January 1, 2008. Miller is known nationally for his role in the Fen-Phen litigation. A former assistant U.S. attorney and chief of the Criminal Division at the Philadelphia U.S. Attorney’s Office, Miller has a substantial practice in the areas of white collar criminal defense and securities and accounting litigation.

Since his appointment in 1998, Miller has performed a variety of functions as the Special Master in the Fen-Phen multidistrict litigation (In re: Diet Drugs Products Liability Litigation), including monitoring the progress of discovery in more than 40,000 individual claims. He has frequently been asked to serve as a special master or mediator in federal or state cases, and he is a founding member of the Academy of Court Appointed Masters. Miller’s securities litigation work has included counseling a Big Four accounting firm engagement partner in an action brought by the Securities & Exchange Commission (SEC) and representing directors and officers who are defendants in securities class actions. He has served as outside counsel to the Philadelphia Stock Exchange and is active in representing defendants in SEC actions involving late trading, market timing and improper management of a hedge fund.


Miller entered private practice in 1984 after almost a decade of public service, first as an officer in the U.S. Navy, Judge Advocate General’s Corps, and later with the U.S. Attorney’s Office in Philadelphia. While a federal prosecutor, he became nationally known in the health care enforcement area, prosecuting the landmark health care fraud case United States v. Greber, which established new law in the area of Medicare kickbacks.

Miller is also a frequent author and lecturer in the area of legal ethics. He served six years on the Disciplinary Board for the Supreme Court of Pennsylvania, chairing its Rules Committee. He is currently the chair of the Pennsylvania Board of Law Examiners. Giordanella works extensively on cases involving employment and ERISA disputes, in addition to general commercial litigation and Special Master services. She was recently honored as one of two outstanding members of the year by the National Association of Women Lawyers and has been elected to serve as an at-large member of the group’s executive board. Lewis focuses her practice on employment and commercial disputes. A Harvard Law School graduate, she began her career as an assistant district attorney in the Philadelphia District Attorney’s Office, where she tried hundreds of preliminary hearings and bench trials. Last year, the Philadelphia Legal Intelligencer named her as one of the women “On the Verge” in the city’s legal community.

Mackuse focuses his practice on a variety of complex commercial litigation matters, including complex and health care fraud cases and corporate internal investigations. He has extensive experience in insurance regulatory issues, insolvency proceedings and insurance coverage disputes.

Stroup concentrates his practice on defending SEC regulatory investigations and enforcement actions in addition to commercial disputes. He is both a Certified Public Accountant and Certified Fraud Examiner, with prior experience in the accounting and auditing profession. He is currently a national director for the American Association of Attorney-Certified Public Accountants.
