VORYS EXPANDS GOVERNMENT RELATIONS GROUP
Vorys, Sater, Seymour and Pease LLP (Vorys) has expanded its government relations practice group to enhance services to its local, regional and national client base. The team, which includes a number of attorneys from the firm, will focus on legislative and executive agency level practices in Ohio and at the federal level. Formerly a group of six, the practice now includes 11 attorneys from the firm.

“Clearly, as the 127th General Assembly begins its work and with a new administration led by Governor Ted Strickland, clients will benefit from the bipartisan and seasoned team of government relations professionals practicing at Vorys,” said Russell M. Gertmenian, Vorys managing partner. “In addition, few Ohio firms can offer the significant expertise at the federal level that Vorys has assembled in Washington.”

Vorys attorneys who are members of the government relations practice include:

* Frederick Mills, a partner with four decades of statehouse experience, including service as Chief of Staff to former Ohio House Speaker Jo Ann Davidson;
* Frederick Ransier, a partner and former Columbus City Council member with significant civic and government service experience;
* William Newcomb, a partner with particular expertise on utility and regulatory issues, a former chairman of the Public Utilities Commission of Ohio;
* Timothy Bechtold, a senior attorney and former association lobbyist with experience in political action committee (PAC) management and legislative representation;
* Karen Cincione, of counsel, who previously served as chief counsel to a state agency and as an assistant attorney general;
* David Hoeffel, an associate and former legislative aide in the Ohio House of Representatives and law clerk and legislative liaison for the Auditor of State Attorney General;

* Anthony Calabrese, a partner in the Vorys Cleveland office who works closely with local, regional and state political subdivisions; and

* Michael Griffaton, a senior attorney in Columbus and former staff attorney for the Ohio Legislative Service Commission, who assists the government relations group with researching and preparing drafts of proposed legislation.

Vorys’s federal government relations practice members include:

* Randal Teague, a partner who coordinates the federal practice and formerly served as chief of staff and legislative counsel to a U.S. House member and as an economic policy analyst in the Executive Office of the President of the United States;
* Brett Kappel, of counsel in the Washington office, a national expert in campaign finance law who represents corporations and trade associations before the U.S. Congress and various executive branch agencies in the development of public policy and legislation; and
* Bradley Smith, of counsel in the Columbus and Washington offices, a former chairman of the Federal Election Commission, is widely recognized as one of the nation's leading authorities on election and campaign finance law.

“Without question, clients looking for excellent representation at the state and federal levels of government can benefit from the experience, diversity and agility offered by Vorys’ government relations group,” said Gertmenian.

University of Alabama School of Law Wins International Trademark Association’s Saul Lefkowitz Moot Court Competition
This year, the International Trademark Association held the national finals for the Saul Lefkowitz Moot Court Competition in Washington, DC, on March 24, at the U.S. Court of Appeals for the Federal Circuit. The competition was based on a mock trademark case that required the students to present arguments on the issues of counterfeiting, the right of publicity and third-party liability for unfair competition. The case highlighted the contemporary nature of reproducing luxury goods and using the Internet as a powerful marketing and advertising tool that contributes to the dilution of brands.

Chris Foley of Finnegan Henderson serves as the National Coordinator of the Saul Lefkowitz Moot Court Competition. He said, “It is truly an honor to be a part of this competition and the students who take part in this exercise take away a tremendous experience that will serve them throughout their careers.

PLC Which Lawyer? has named White & Case to the "Competition Super League" for the first time this year. The Firm was recommended in Czech Republic, EU, Finland, France, Germany, Hungary, Japan, Russian Federation, Sweden and the US, in addition to its "strong competition law network across northern, central and eastern Europe" being specially noted. US Appeals Court Denies Rehearing in Comcast Privacy Case
The United States Court of Appeals for the Sixth Circuit denied a motion for rehearing against the nation's largest cable television operator, Comcast Cable Communications, Inc., consistent with its earlier ruling that affirmed a dismissal of a class action suit. White & Case represented Comcast.

In Klimas v. Comcast Cable Communications, Inc., Comcast's high-speed Internet subscribers alleged violation of the privacy provisions of the federal Cable Communications Policy Act of 1984, enacted to protect the privacy of cable TV customers. The subscribers alleged that by storing IP addresses, Comcast improperly collected their personally identifiable information in violation of the Cable Act. Damages from a nationwide class action could conceivably exceed $1 billion.

The US District Court for the Eastern District of Michigan granted White & Case's motion to dismiss the class action, in which the Firm argued, among other things, that the Cable Act did not apply, because a subscriber's IP address — without additional information — does not constitute personally identifiable information protected by the Cable Act.

The plaintiffs then filed an appeal. In the September 2006 landmark decision involving issues of first impression concerning Internet privacy, the US Court of Appeals for the Sixth Circuit upheld the district court finding, additionally basing its decision on the US Supreme Court's 2005 Brand X decision. In May 2007, the plaintiffs filed a motion for rehearing, which was denied.
