William Schultz and Carlos Angulo Defend Experimental Drug Decision in Legal Times Article
An article by Washington, D.C., partners William Schultz and Carlos Angulo about a recent decision regarding access to experimental drugs appeared in a special issue of Legal Times focusing on FDA matters. Schultz and Angulo, with associate Maryll Toufanian, provided pro bono support to amici in this case, filing a brief in support of the current FDA standards on behalf of patient advocacy groups such as the National Organization for Rare Disorders (NORD), AIDS Action Baltimore Inc., the United Leukodystrophy Foundation, Neurofibromatosis Inc., the Kennedy's Disease Association, the National Ataxia Foundation, and the National Alopecia Areata Foundation.

Ward and Smith, P.A. Welcomes Three New Attorneys
Ward and Smith, P.A. is pleased to announce that financial institutions attorney Matthew A. Cordell, labor and employment attorney Kyle R. Still, and litigation and family law attorney Lauren E. Taylor joined the firm effective September 10. All three of the attorneys will work in the firm's New Bern office.

Matthew A. Cordell received his law degree from the University of North Carolina School of Law in 2007. He was a member of The North Carolina Law Review and a Chancellors Scholar. Mr. Cordell received his M.B.A. and his B.A. in Business Administration from Campbell University in 2004. He was a 2006 Summer Associate at Ward and Smith and an intern for Justice Paul M. Newby of the North Carolina Supreme Court in 2005.

Kyle R. Still also received his law degree from the University of North Carolina School of Law in 2007. He was a member of The North Carolina Law Review and the Sports and Entertainment Law Association. He received his B.A. in Political Science from the University of North Carolina in 2004. Mr. Still worked as a Summer Associate for Ward and Smith in 2006 and served as an intern for Justice Mark Martin of the North Carolina Supreme Court in 2005.

Lauren E. Taylor earned her law degree from Campbell University School of Law in 2005 and her M.B.A. from Campbell University in 2005. She received a B.A. in Journalism and Mass Communications from the University of North Carolina in 2002. Ms. Taylor has routinely drafted opinions, reviewed appellate briefs, and researched legal issues as a law clerk for the Honorable J. Douglas McCullough of the North Carolina Court of Appeals.

Firm Closes $26.2 Million Private Equity Financing
Magavern Magavern Grimm represented Kainos Partners Holding Company, LLC in the closing of a $26.2 million private equity financing. Kainos Partners is a developer and franchisee of Dunkin' Donuts restaurants. Kainos Partners continues to develop numerous Western New York Dunkin' Donuts locations and this financing will allow Kainos not only to accelerate its growth in Western New York, but also to add new markets, including locations in Nevada and South Carolina.

Ms. Gelinas was listed for her work in Appellate Law. She chairs our Appellate Group, and practices in construction, fidelity and surety, and other commercial matters, as well as the representation of lawyers before the Indiana Supreme Court Disciplinary Commission.

Mr. Hartley was honored for his work in Commercial Litigation. His practice includes litigation, representation of business clients, appellate law, administrative law and utility law.

Mr. Kasper was listed for his work in Legal Malpractice Law. He concentrates his practice in litigation, professional malpractice and insurance services, and serves as chair of the firm’s Tort Litigation and Insurance Services Group.

Mr. Milliken was honored for his work in several categories: Appellate Law, Bet-the-Company Litigation, Commercial Litigation, Personal Injury Litigation and Product Liability Litigation. He concentrates his practice in products liability, business litigation and complex tort litigation, and is a former co-chair of the firm’s Products Liability Group.

Mr. Reynolds was also honored in several categories: Bet-the-Company Litigation, Commercial Litigation and Construction Law. He is actively engaged in litigation, primarily concentrating in the areas of fidelity and surety, construction law, products liability and commercial disputes.

Mr. Riegner was honored for Personal Injury Litigation. He is a veteran trial lawyer, having secured defense verdicts for his clients in 40 cases tried to verdict. Eric is chair of the firm's Tort Litigation and Insurance Services Group.

Mr. Riggs was listed for Personal Injury Litigation and Product Liability Litigation. He is chair of the firm’s Products Liability Practice Group, devoting his practice to the defense of juvenile products and vehicle/equipment manufacturers and distributors headquartered in the United States and internationally.

Mr. Roberts was honored for Family Law. He chairs the firm’s Family Law Group, concentrating his practice in divorce, family law, attorney malpractice defense, truck accident litigation and plaintiffs personal injury litigation.

GALLAGHER & KENNEDY ANNOUNCES FIVE NEW ASSOCIATES
Phoenix-based Gallagher & Kennedy, P.A., a full service business law firm, today announced the addition of five associates: Tyrone P. Fields, Robin L. Dugas, Nathan W. Blackburn, C. Lincoln Combs and Flynn Patrick Carey.

Mr. Fields has rejoined the firm’s real estate practice group, specializing in real estate transactional law. Prior to rejoining Gallagher & Kennedy, Mr. Fields served as vice president and general counsel of Trend Homes, Inc. In this position, he managed a variety of complex purchase and sale, financing, joint venture, land banking, subdivision and HOA/condominium association transactions. He also boasts prior positions as general counsel for Ribomed Biotechnologies, Inc. and as an attorney in the U.S. Navy Judge Advocate General’s Corps. Mr. Fields completed his juris doctor in 1997 and bachelor’s degree in 1994 at the University of Arizona.

Ms. Dugas practices real estate law at Gallagher & Kennedy. Her previous work as an attorney includes facilitating like-kind, tax-deferred exchanges. In this practice area, Ms. Dugas reviewed agreements, contracts, Phase I environmental reports, loan documents and insurance certificates to structure exchanges and provide risk assessment. She completed her juris doctor in 2003 and master’s degree in 1995 at Arizona State University. Ms. Dugas graduated with a bachelor’s degree from Albright College in 1993.

Mr. Blackburn joined Gallagher & Kennedy’s real estate practice. Prior to attending law school, he founded a residential real estate appraisal company. Mr. Blackburn’s past experience includes preparing title opinions for corporate clients, conducting title searches of real estate records for mineral ownership, negotiating terms for oil and gas leases, and providing ownership and leasing reports to oil production companies. Mr. Blackburn completed his juris doctor in 2007 and bachelor’s degree in 2000 at The University of Oklahoma.

Mr. Combs practices general commercial litigation at Gallagher & Kennedy. Prior to joining the firm, Mr. Combs clerked for Justice Andrew D. Hurwitz in the Arizona Supreme Court. He has also been published in the Arizona State Law Journal and was a recipient of the legal periodical’s Best Note Award. Mr. Combs completed his juris doctor with honors at Arizona State University in 2006. He earned a master’s degree from Ohio University in 1997 and graduated with a bachelor’s degree from the University of California in 1994.

Mr. Carey practices litigation with an emphasis on criminal defense law and employment law at Gallagher & Kennedy. Mr. Carey has clerked for the United States Department of Homeland Security in Tucson and interned for the Criminal Division of the Arizona Office of the Attorney General. His background also includes work as a systems analyst for the city of Tucson. Mr. Carey earned his juris doctor in 2007 and bachelor’s degree in 2000 from the University of Arizona.
