Loyens & Loeff once again the ‘Benelux Law Firm of the Year
For the second time in three years, Loyens & Loeff has been chosen as ‘Benelux Law Firm of the Year’ by Chambers and Partners. During the annual Chambers Global Awards Gala, held 16 November at the Hilton Hotel on Park Lane in London, chairman Pim Bertels received the award on behalf of Loyens & Loeff. The prestigious Chambers Award was also presented to Loyens & Loeff in 2004.

Garan Lucow Miller Adds Two New Associates
Garan Lucow Miller, P.C., with offices throughout Michigan, announces two new associate attorneys have been hired by the law firm. Matthew S. LaBeau was a law clerk and now he is an associate in the Detroit office. Also, Rachel A. Bissett went from law clerk to associate in the Troy office.
LaBeau graduated cum laude with his B.B.A. from Western Michigan University and earned his law degree from Wayne State University Law School in 2006. He is a member of the State Bar of Michigan. His practice areas include municipal litigation, no-fault automobile defense and criminal defense.
Bissett earned her B.A. at Michigan State University and graduated with honors. She received her J.D. from Wayne State University Law School in 2006. She is a member of the State Bar of Michigan and the American Bar Association. Her practice areas include commercial litigation, real estate litigation and construction lien litigation.

Loyens & Loeff

Paul Visser, attorney, strengthens Loyens & Loeff's real estate practice
The close working relationship between attorneys, tax lawyers and civil-law notaries at Loyens & Loeff was an important factor for him in deciding to join the company, and particularly the fact that real estate transactions are increasingly steered from a tax point of view.

Paul Visser had been an attorney in real estate for Boekel de Nerée since 1988. He specialises in real estate transactions, security rights (mortgages en bank guarantees), tenancy rights, and ground lease. He litigates regularly in these areas. Major real estate transactions in which he has been involved include the sale and lease back of Vendex/KBB, the sale of 223 Edah shops owned by Laurus to Sligro Food Group Nederland and Sperwer Holding, the sale of 41 Konmar shops owned by Laurus to Ahold and Jumbo, and the sale of 100 office blocks owned by MPC Münchmeyer Petersen Capital.

Paul Visser follows the example of Bram Linnartz, who left Boekel de Nerée in October 2006 to become a partner at Loyens & Loeff.

Loyens & Loeff appoints six new partners
Sidney Berendsen (39), attorney
At Loyens & Loeff’s Amsterdam office since 2000.

Sidney Berendsen advises and litigates in corporate law disputes, including directors liability, shareholder disputes and proceedings with the Enterprise Chamber of the court of appeals in Amsterdam. He completed the Grotius Academy’s post-graduate course in corporate litigation in 2005 and is a member of the Dutch Corporate Litigation Association. He specialises in professional liability matters concerning civil-law notaries and lawyers. Berendsen has worked in Loyens & Loeff’s Corporate Litigation department since June 2002. He graduated in Dutch law from the University of Utrecht in 1995 and has practiced as an attorney-at-law since 1996.

Lodewijk Berger (36), attorney/tax lawyer
At Loyens & Loeff’s Amsterdam office since 1997 and, from 1 February 2007, in the New York office.

Lodewijk Berger is a member of the General Tax practice group. He advises on international financing instruments, private equity and M&A transactions. He specialises in structured finance, advising mainly on hybrid financing products and financial transactions, such as project financing, securitisation, repackaging and repo transactions. Berger graduated from the University of Amsterdam in 1997 and is a member of the International Bar Association (IBA) and the American Bar Association.

Harmen Holtrop (35), attorney
At Loyens & Loeff’s Amsterdam office since 2000.

Harmen Holtrop has a transaction-related practice, focussing on assisting private equity houses and management teams in management- and leveraged buy-outs, and financing. He has broad experience in mergers and acquisitions. Towards the end of 2004, he worked for nine months at a large US law firm’s New York office. He completed the Grotius specialist course in Corporate Law in 2002. Holtrop became member of the Bar in 1997, after he had completed his study in Dutch law (civil law and criminal law) at the Vrije Universiteit Amsterdam in 1996.

Rob Cornelisse (48), tax lawyer
At Loyens & Loeff’s Amsterdam office since 1997.

Rob Cornelisse is a member of the General Tax practice group and advises on income tax, corporation tax, and dividend tax, in the national as well as in international practice areas. He was appointed as professor of tax law in 1999 and became chairman of the tax law chair group. He obtained a doctorate in 1992 with his doctoral thesis on tax aspects of goodwill. Since the completion of his study in tax economy in 1983, Cornelisse has been affiliated to the Law Department of the University of Amsterdam. He is an annotator for the FED and BNB tax periodicals.

Serge Zwanen (38), attorney
At Loyens & Loeff’s Rotterdam office since 2003.

Serge Zwanen is a member of the Technology, Media and Litigation practice group. He advises and litigates on information and communication technology, intellectual property and commercial law. After his studies, he completed the Grotius Academy specialist course in IT law, among other courses. Zwanen is a member of the Association of Informatics Lawyers and the Netherlands Litigation Association. He graduated in Dutch law from the University of Maastricht in 1994.

Marja de Best (35), tax lawyer
At Loyens & Loeff’s Rotterdam office since 1994.

Marja de Best is a member of the General Tax Law practice group and mainly advises French and North-American clients (such as multinationals, venture capitalists, and banks). She has worked at Loyens & Loeff’s Paris office for three years. She was also seconded to a Canadian law firm in Toronto and to a tax department of an investment bank in London. De Best graduated in tax law from the University of Leiden in 1994.

European Privacy and E-Commerce Alert
"Mr. Peter Hustinx, the European Data Protection Supervisor (EDPS), issued an opinion on the European Commission’s Communication on the follow-up of the Work Programme for better implementation of the Data Protection Directive which supported the Commission’s conclusion reached in its Communication that the Directive should not be amended at this time — see our E-Alert issue of May 2007. The EDPS pointed out to a more urgent need to improve its implementation by the Member States. In particular, he emphasized the importance of: (1) full implementation of the Directive; (2) considering the impact of technological developments on the Directive; (3) having a global perspective and further developing rules on international data transfers; (4) ensuring that personal data are protected despite law enforcement demands; (5) adopting more sectoral data protection legislation (for example, regarding RFID); (6) greater use of infringement procedures against the Member States; (7) encouraging the use of interpretative communications by the Commission to clarify important questions; (8) enhancing the use of non-binding instruments to increase compliance, such as privacy seals; and (9) better defining the role of institutional actors, in particular the Article 29 Working Party."

Mayer Brown Recognized by Yale Law Women as a Top Ten Family-Friendly Firm
Mayer Brown LLP has been recognized as one of the 2007 Top Ten Family-Friendly Firms by Yale Law Women (YLW), the largest student organization at Yale Law School, which co-sponsored the survey with Women's Law School Coalition groups at Boalt(Berkeley), Chicago, Columbia, Harvard, Northwestern, Stanford and Virginia. YLW seeks to emphasize the need for firm employment policies that facilitate work-life balance for attorneys and work environments that accommodate, as well as support, lawyers with families.

"The list is a way to celebrate those firms that have taken important steps toward helping attorneys have both a family and a successful career," said YLW Activism Co-Chair Katie Wilson-Milne. The top ten were selected from 150 firms that completed workplace questionnaires for NALP, the Association for Legal Career Professionals and were ranked among "the most prestigious" or "best of the rest" law firms by The Vault.

"This recognition is further evidence of our numerous efforts to build a workplace where Mayer Brown people will thrive as professionals," said James D. Holzhauer, Chairman of Mayer Brown.
