Baker & Daniels in Indiana Top 20 for "Best Places to Work"
Baker & Daniels LLP was named among the top 20 Hoosier large companies in "Best Places to Work in Indiana," according to a 2007 survey sponsored by the Indiana Chamber of Commerce. Final winners were announced during an awards luncheon May 2, and recipients were featured in the May/June issue of BizVoice magazine.

Baker & Daniels was the only law firm employer listed among the large-sized companies, which included businesses consisting of 250 or more employees. The program is designed to honor businesses that create a productive environment in which employees feel valued.

Honorees were chosen through employer reports and comprehensive employee surveys. The Best Companies Group, which conducts similar programs in 18 other states, produced the "Best Places to Work in Indiana" list with ModernThink LLC, a workplace excellence consulting firm who handled the selection process. All companies that participated in the "Best Places to Work" program receive an in-depth evaluation identifying strengths and weaknesses according to their employees. In turn, this report can be used in developing or enhancing employee retention and recruitment programs.

One of Baker & Daniels' best practices spotlighted by the Indiana Chamber was the firm's employee volunteer program with Indianapolis Public School 39. Since 2000, Baker & Daniels has provided paid volunteer time as a benefit. Hourly employees are given up to eight hours of paid leave per semester to tutor elementary students at School 39.

Wainwright successful in federal civil rights trial.
McCormick Barstow attorney, Daniel L. Wainwright, successfully defended a Modesto, CA attorney in a federal civil rights trial.

The Plaintiff in this case, an African-American male, claimed that the Defendant was part of a race-based conspiracy to deny him of his civil rights (i.e., access to the state court of Stanislaus County). In addition, the Plaintiff claimed that the Defendant conspired with another local attorney, a Stanislaus County Superior Court Judge, the Court's Chief Executive Officer, a courtroom bailiff and others involved in Stanislaus County’s Family Court to deny him access to the state court system, because he was African-American (as provided for by 42 U.S.C.1985). The Plaintiff also alleged that the Defendant was aware of this race-based conspiracy and failed to stop it (as permitted by 42 U.S.C. 1986).

All of this stemmed from an ongoing family law dispute, in which the Defendant represented the mother of the Plaintiff's child. The Plaintiff alleged that the Defendant, and others, made horrible race-based epithets, insults and threats of physical violence on multiple occasions. The Plaintiff claimed that because of this alleged race-based conspiracy and threats of physical violence, he withdrew two pending contempt proceedings and had not been able to return to the state court since the last claimed racial threat was made by the Defendant in April 2004. The Plaintiff claimed physical injuries and sought monetary damages (in excess of a million dollars) because of the deprivation of his civil rights and inability to go to state court to litigate any disputes.

In defense of these claims, Mr. Wainwright called the Stanislaus County Superior Court Judge, the court’s Chief Executive Officer, the deputy sheriff, other local attorneys and numerous character witnesses. Each of the alleged co-conspirators and percipient witnesses denied each and every claim made by the Plaintiff. Furthermore, the character witnesses (some of whom were African Americans) each stated that the use of the alleged language was not consistent with the Defendant’s character and were appalled by the Plaintiff's claims.

The matter went to the Jury at 4:30 p.m. on Thursday, May 10, 2007. After deliberating for only 15 minutes, the Jury returned an 8-0 verdict in favor of Mr. Wainwright and his client. Furthermore, the Jury found that the Defendant had not exhibited any of the conduct described by the Plaintiff, nor was the Defendant a participant in any sort of conspiracy to deprive the Plaintiff of his civil rights because of his African-American heritage. The trial, which took place in U.S. District Court, Eastern District (Fresno) before the Honorable Oliver W. Wanger lasted three days. The case is entitled Jones v. Tozzi, et al. 1:05 cv 00148 OWW DLB.
