Laurence Dunbar and Christian Leblanc of Fasken Martineau to conduct comprehensive study of CRTC broadcasting regulations
Chair Konrad von Finckenstein announced that the Canadian Radio-television and Telecommunications Commission ('CRTC') had commissioned a study of "the whole body of our regulations, covering all elements of television and radio". The study will examine each policy or regulation with regard to: its original purpose; its relevance and effectiveness with respect to present and future needs; and whether it should it be retained, improved, streamlined or eliminated in order to serve the purposes of the Broadcasting Act most efficiently and economically.

Laurence Dunbar of the Ottawa office and Christian Leblanc of the Montréal office of Fasken Martineau will conduct the study over the next several months and deliver their report to the CRTC in August for public comment.

Ohio State University Physicians, Inc. Select Taft for General Counsel
Taft Stettinius & Hollister LLP has been selected by the Ohio State University Physicians Inc. as its general counsel, representing OSUP and all its subsidiary limited liability company departmental entities. The physician practice group is comprised of approximately 550 physicians practicing at The Ohio State University. David L. Johnson, Timothy P. Nagy, Robert E. Rich, Michael A. Byers, and Emily E. Williams made the firm’s presentation to a group of Ohio State University Physicians' representatives on April 30, 2007. The engagement will begin June 1, 2007.

O’MELVENY & MYERS LLP ANNOUNCES SIGNIFICANT EXPANSION OF FIRM’S BANKRUPTCY PRACTICE
O'Melveny & Myers LLP announced today that Michael J. Sage, formerly the co-chair of Stroock & Stroock & Lavan LLP's Financial Restructuring Group, along with fellow former Stroock partners Gerald C. Bender, Doron Lipshitz, and Patricia M. Perez, have joined O'Melveny's New York office. Michael Sage will be co-head of O'Melveny's Business Restructuring and Reorganization Group, along with San Francisco-based partner Suzzanne Uhland.

Michael J. Sage, formerly the co-chair of Stroock's Financial Restructuring Group, has a restructuring practice that focuses on the representation of funds, with a particular emphasis on the M&A aspects of bankruptcy practice. Private equity and distressed debt funds are a focal point of his expertise and he is recognized as a leading lawyer with a strong national reputation in this area. He represents ad hoc bondholder committees, official creditors' committees, acquirers, and debtors in bankruptcy proceedings and out-of-court restructurings. An active component of Michael's practice is the representation of financial institutions that have acquired substantial strategic positions in debt securities, and the bankruptcies, out-of -court restructurings, and divestitures relating to such acquisitions.

Gerald C. Bender has a practice encompassing all aspects of financial restructuring. He represents unofficial and official bondholders' and creditors' committees, institutional investors, secured and unsecured creditors and debtors in out-of-court restructurings and chapter 11 reorganizations. Gerald also has significant experience in the litigation of complex bankruptcy and commercial disputes.

Doron Lipshitz concentrates on public and private M&A transactions, venture capital and other private equity investments and divestitures, and corporate restructurings. He regularly represents corporations and private funds in such transactions and advises corporations and their boards of directors regarding corporate governance matters and the fiduciary duties of officers and directors.

Patricia M. Perez regularly represents private investment firms and bondholder committees in corporate restructuring transactions. She has extensive experience in advising corporations and private funds on public and private M&A transactions, joint ventures, and private equity investments and divestitures.

Tim McClain Appointed To Veterans Advisory Committee
Womble Carlyle attorney Tim McClain has been appointed to a new VA advisory committee to improve services for veterans of current combat operations in Iraq and Afghanistan.

U.S. Secretary of Veterans Affairs R. James Nicholson appointed the 17-person committee, including McClain, on Tuesday, May 8th. The appointments follow the recent recommendations of a Presidential Task Force to better assist the nation’s newest combat veterans.

Helping veterans has long been an interest of McClain. Before joining Womble Carlyle in early 2007, McClain served as General Counsel for the U.S. Department of Veterans Affairs (VA) from 2001-2006. In 2005, he also served concurrently as the Chief Management Officer for VA with overall responsibility for the department’s budget formulation and execution, procurement policy and acquisitions management, real property acquisition and management, and business process oversight.

The Advisory Committee on OIF (Operation Iraqi Freedom) and OEF (Operation Enduring Freedom) includes veterans advocates such as McClain as well as former soldiers, family members and wounded veterans. The panel will report directly to the Secretary of Veterans Affairs.

"This group of people have experienced war and our system of care and can advise me from first-hand experience on how we are doing and what we need to do better," Nicholson said.

The new committee will hold its inaugural meeting on May 14th. Their agenda includes scheduling future site visits to VA facilities around the country.

Tim McClain is a member of the firm's Federal and State Government Affairs team, where he assists clients with government affairs, health care and data security issues. He brings 35 years of legal experience to the firm, including experience as a litigation trial attorney and a military judge in the Navy's Judge Advocate General’s (JAG) Corps.

Firm Helps Win Settlement in Pro Bono Student Civil Rights Matter
Willkie has helped win an important settlement in a high-profile pro bono civil rights matter involving a New Jersey high school student who blew the whistle on a teacher who was proselytizing in class, a violation of the Constitutional separation of church and state. Willkie has been representing pro bono high school junior Matthew LaClair and his family in their effort to get the Kearny School District to implement a policy to ensure that the teacher’s classroom religious advocacy is stopped and would not be repeated, and that his erroneous statements regarding evolution and the Big Bang theory be corrected.

On May 8, a settlement agreement was signed in which the School Board agreed to hire the New Jersey Anti-Defamation League to conduct training of both its teachers and its students on the doctrine of separation of church and state and on the scientific principles of evolution and the Big Bang theory. The Board also agreed to create a new policy which provides a means for students to address complaints, and has agreed to conduct an independent investigation into Matthew LaClair’s allegations of harassment and retaliation in school. The lawyer for the School Board stated in the May 10 New York Times that “the settlement created remedies that go further than any court has gone.”

Upon entering the settlement, the Board read the following statement: “The Board wishes to publicly express their appreciation to Matthew LaClair for his efforts in bringing to the School Board’s attention a serious situation in the Kearny schools regarding the Constitutional mandate of separation of church and state. Because of Matthew’s exemplary actions in standing up for his Constitutional rights and the integrity of education, often at the cost of his own popularity in the community and the school, the Board was able to take action to correct this situation and improve the educational environment for all students. The Board commends Matthew LaClair for his courage and integrity in taking the responsibilities of citizenship seriously and acting accordingly. We thank him for calling attention to this important issue. The Board reaffirms our commitment to the core academic curriculum standards relating to the Big Bang and evolutionary theory.”

The matter was handled by partner Richard Mancino and associates Gustavo Gonzalez and Samuel Leaf.

Winners Announced in the 2007 Utah Innovation Awards
Seven technology innovations and the Utah companies that created them were announced as winners in the fifth annual Utah Innovation Awards program, presented by Stoel Rives LLP and the Utah Technology Council. This program is sponsored by Connect magazine and Hewlett-Packard. Winners were announced during a special Awards Luncheon today at the Marriott City Center.

A committee of nearly 60 experts from private industry, government and higher education selected the award winners, one in each of the program’s seven categories. Votes were tallied by the accounting firm PricewaterhouseCoopers.

"This years finalists and winners are a great representation of the variety of innovation taking place throughout the state among companies of all sizes from small start-ups to well established, large corporations," said Scott Young, Stoel Rives attorney and 2007 Utah Innovation Awards chairman. The program received nearly 100 nominations. Two finalists and a winner were selected in each category.

"The Utah Innovation Awards program serves as a tremendous venue and opportunity for Utah’s entrepreneurs to showcase their innovations and receive statewide recognition," said Richard Nelson, Utah Technology Council President and CEO. "UTC is proud to be part of that effort and support the incredible innovation that is driving Utah’s technology industry."

More than 300 individuals attended the Awards Luncheon at the Marriott City Center. Governor Jon Huntsman Jr. provided welcoming remarks and entrepreneur Larry D. Rigby, founder of several companies including ZARS Pharma, Inc. delivered a keynote address titled "The Art of Innovation: Past, Present and Future."
