Cox Smith Matthews Attorney Wins Outstanding Mentor Award
Cox Smith Matthews Incorporated today announced the San Antonio Young Lawyers Association (SAYLA) has awarded Diann Bartek with its Outstanding Mentor Award. This is the first year this honor has been awarded, and it will be presented today at the San Antonio Bar Association’s annual Law Day luncheon.

"Diann is a well-respected lawyer and a exemplary representative of the legal profession, dedicating much of her time to acting as not only as a mentor for young lawyers in the legal profession, but also encouraging young lawyers to build a bridge between the legal profession and the rest of their community. We believe Diann exemplifies the role of an outstanding mentor not only to young lawyers, but the legal profession as a whole,” said SAYLA Board Member Natalie Hall. “She is an example that all lawyers can be proud of and aspire to become one day.”

CBLH Wins at the Federal Circuit for Henkel Corporation
In a rare reversal of the Interference Board, the United States Court of Appeals for the Federal Circuit vacated a decision in favor of Procter & Gamble concluding that the Board’s factual findings actually supported an actual reduction to practice by Henkel. The Federal Circuit remanded the matter for further proceedings consistent with the Court’s opinion. Henkel Corp. v. The Procter & Gamble Co., ___ F.3d ___, ____ USPQ.2d ____ (Fed. Cir. 2007) (Weblink to Slip Opinion provided above).

The interference concerned detergent tablets having compressed and non-compressed regions which dissolved at different rates. The Board ruled in favor of Procter, concluding that Henkel’s inventors did not “contemporaneously appreciate” that the detergent tablets they had produced and tested in April of 1997 met the dissolution rate limitation of the interference count.

On appeal, the Federal Circuit agreed that Henkel’s evidence established appreciation of the different dissolution rates finding that “[t]he limitation in question is a discernible property of the invention that was directly observed by a technician working under the close supervision of one of the inventors. To require a more specific declaration than Henkel has proffered would be to undermine our holding in Mycogen that an inventor can demonstrate appreciation without enunciating the precise language of the interference count.” (Slip op., at 10).

This win for Henkel is the latest in a string of successes for CBLH’s Interference Practice Group. The Group specializes in the complex procedures and trials involved in protecting CBLH clients’ intellectual property in all phases of matters before the United States Patent and Trademark Office. Rudolf E. Hutz argued for Henkel. With him on the briefs were Robert G. McMorrow, Jr. and Aaron R. Ettelman. Of counsel was Mark E. Freeman.

Jane Doe Inc. Honors ML Strategies' Jan Rose
ML Strategies' Director of Government Affairs, Jan Z. Rose is being honored at the 8th Annual Jane Doe Inc. Gala on Monday, May 14, 2007. First Lady of the Commonwealth Diane Patrick is serving as the Event Honorary Chair, and over sixty state elected officials have signed on in support, including Senate President Therese Murray and Speaker of the House Salvatore F. DiMasi.

Veteran lobbyist Jan Rose will receive the M. Patricia Cronin Spirit Award for Activism in Public Policy for her leadership and commitment to ending sexual assault and domestic violence. The award is given in memory of Pat Cronin, who headed up ML Strategies' state government affairs practice and lost her battle with ovarian cancer in 2000. Jane Doe, Inc. (JDI) said it could think of "no better way to honor Pat's legacy than to recognize the accomplishments of her protégés." Also being honored at the event is Nancy Scannell, the Director of Policy and Planning at the Massachusetts Society for the Prevention of Cruelty to Children and former Director of Government Affairs for Jane Doe.

JDI's Executive Director Mary R. Lauby stated, "JDI is leading the charge for increased public resources to keep programs from crumbling after years of budget cuts. We could not be successful without the talent and expertise of people like Nancy and Jan. They have devoted their lives to giving a voice to those who are too often silenced."

Jan Rose, Director of Government Affairs for ML Strategies, has extensive experience representing client interests before both the Massachusetts General Court and the Executive Branch. She provides legislative analysis, strategic political advice and works closely with decision makers in state government on legislative and regulatory issues. Ms. Rose has helped JDI advocate for the needs of survivors and build the organization's reputation and influence on Beacon Hill. She also serves on the Board of Directors of the M. Patricia Cronin Foundation to Fight Ovarian Cancer.

"This well-deserved honor is a testament to Jan's passion and hard work on behalf of Jane Doe," said Stephen Tocco, President and CEO of ML Strategies. "There is no higher merit than recognizing Jan's efforts with an award named after her mentor, Pat Cronin, who dedicated herself to advocating on behalf of the victims of domestic abuse and who was a dear friend both to Jan and all of us at Mintz Levin."

The Jane Doe Gala will be held at the Boston Park Plaza Hotel. Tickets are $150 each.
