JEFF SMITH TO SPEAK AT SUSTAINABLE GOVERNANCE FORUM ON CLIMATE RISK
Cravath partner Jeffrey A. Smith will speak at the Sustainable Governance Forum on Climate Risk, a New York City conference for corporate board members sponsored by Marsh, Ceres and Yale. In his presentation, entitled "Legal Perspective: Corporate Fiduciary and Disclosure Obligations in Changing Times", Jeff will discuss how the legal duties of board members are evolving in the context of climate change and what board members should do to protect themselves and their firms.

Clark Hill Attorney Jeffrey DeVree To Present New Michigan Business Tax Seminar Series
Clark Hill Attorney Jeffrey DeVree will present two seminars in conjunction with Hungerford, Aldrin, Nichols & Carter, PC on September 26 and October 11 in Grand Rapids. The seminars are free of charge, and will cover the new Michigan Business Tax, replacing the Single Business Tax, on January 1, 2008. The MBT consists of two taxes both significantly different than the SBT.

The September 26 seminar will be hosted at the University Club in Downtown Grand Rapids, beginning at 7:30 a.m. The October 11 seminar will be hosted at Noto’s Old World Restaurant at 3:30 p.m., with a reception immediately following. DeVree is a member with the Corporate Practice Group in Clark Hill’s Grand Rapids office. He has 25 years of experience in tax and employee benefits practice, and works with clients firm-wide on federal, state, local and international tax matters.

DeVree received a bachelor of arts degree in economics summa cum laude from Hope College, and his law degree cum laude from the University of Michigan Law School. Mr. DeVree is an active member of bar association sections and committees involving tax and employee benefits, having recently served as a member of the Council of the Tax Section of the State Bar of Michigan and having previously served as chairman of the Business and Tax Section of the Grand Rapids Bar Association. He is a frequent speaker at seminars for business and professional groups. He is a member emeritus of the IRS Great Lakes Area Tax-Exempt and Government Entities Council. He is also a member of the Tax Policy Committee of the Michigan Chamber of Commerce, and a member of the Tax and Regulatory Affairs Committee of the Grand Rapids Area Chamber of Commerce, and worked with both organizations to analyze and develop proposals for Michigan business tax reform. He currently serves as a member of the board of directors of Baxter Community Center, a nonprofit inner-city service organization, and the board of directors of The Grandville Education Foundation, having served as the chairman of both organizations.

BROWN RUDNICK HELPS TO SUCCESSFULLY SECURE $21.25 MILLION GLOBAL SETTLEMENT IN LATEST EPHEDRA-PRODUCTS
Brown Rudnick, a premier international law firm, today announced, on behalf of its client, the Official Committee of Unsecured Creditors, the successful confirmation of a Plan of Reorganization in the N.V.E., Inc. bankruptcy case pending in the United States Bankruptcy Court for the District of New Jersey. The N.V.E. Chapter 11 case represents the third ephedra-products bankruptcy case -- after the ephedra related bankruptcy cases of Twinlab and Muscletech -- in which Brown Rudnick has successfully represented unsecured creditors and, on their behalf, obtained consensual plans which resolved the Product Liability Claims of tort plaintiff creditors who claim injury from their use of the debtor’s ephedra-related products.

In the N.V.E. matter, the Chapter 11 Plan of Reorganization was confirmed by Bankruptcy Judge Novalyn L. Winfield on August 22, 2007 and became effective by its terms on September 5, 2007. Under the Plan, N.V.E.’s 126 Product Liability Claims, which arose from the sale of N.V.E.’s ephedra products prior to 2004 (when the FDA banned the sale of such products), will be settled through the payment into a trust of 21,250,000.00 and the allocation of those moneys to the tort claimants under a process agreed to by the tort claimants and supervised by Carmin Reiss, of Resolutions, LLC. N.V.E.’s trade creditors, who hold approximately $8,000,000.00 in trade claims, will receive a payment directly from N.V.E. (not from the tort trust) equivalent to 35% percent of their claim. The Chapter 11 Plan of Reorganization was filed on April 20, 2007, and the confirmation hearing was held before the Judge Winfield on July 25, 2007.

The Brown Rudnick legal team, led by David J. Molton, a partner in the firm’s Litigation Department, and Steven B. Smith, an associate in the firm’s Capital Markets Department, brought to bear the firm’s considerable expertise in mass tort bankruptcies to this case to formulate and implement a consensual plan of reorganization supported by all the creditor constituencies which resolves the products liability and general creditor claims within the plan structure. The N.V.E. global settlement and the confirmation of the N.V.E. plan could not have been achieved without the hard work of: (i) Michael V. Blumenthal and Gerard Catalanello of Thelen Reid, the Committee’s co-counsel and the Court-appointed Trade Creditor’s Liaison Counsel; (ii) N.V.E.’s general bankruptcy counsel, Daniel Stolz and Steve Jurista of Wasserman, Jurista & Stolz; (iii) Anne Andrews, Robert Roden, Ed Blizzard and Russ Briggs, plaintiffs’ counsel and members of the Court-appointed Plaintiffs’ Liaison Committee; and (iii) the Court-appointed Defendants’ Liaison Counsel, Rex Littrell of Ulmer & Berne LLP.

Brian T. James Appointed Vice Chair of Florida Bar Grievance Committee
Zuckerman Spaeder LLP associate Brian T. James was appointed vice chair of the Florida Bar’s Grievance Committee “K” in the 11th Judicial Circuit. As a leader on this committee, James will review and investigate allegations of professional misconduct against attorneys.

James represents individuals and corporations in a wide variety of white collar and complex civil matters, including fraud and RICO; asset forfeitures; false claims; as well as matters involving federal, state and local regulatory and law enforcement agencies such as the FDA, FTC and SEC. Since joining Zuckerman Spaeder's Miami office in 2004, James has expanded his practice to include the areas of health care, professional responsibility and administrative law.
