OMM Attorneys Publish on "Permanent Injunctions in Patent Cases Following eBay"
O'Melveny-Newport Beach partner John Kappos and associates Darin Glasser and Michael Myers recently authored the article "Permanent Injunctions in Patent Cases Following eBay," published in the Spring 2007 edition of the Federal Bar Association, Orange County Chapter newsletter.

The article examines the impact of the U.S. Supreme Court's ruling in eBay v MercExchange, in which the Court reversed the Federal Circuit's general rule that district courts should issue permanent injunctions in patent cases as a matter of course absent exceptional circumstances.

The article also explores several questions to face district courts in years to come, including:

* How to handle the situation where a patentee is not currently practicing the patent, but intends to begin manufacturing in the future?
* Should the issuance of a permanent injunction be disturbed if the patentee ceases practicing the patent down the road?
* Where permanent injunctions are not issued, and the defendant is permitted to continue infringing, is any subsequent infringement necessarily willful?
* Should a permanent injunction issue where the patentee is practicing the patent, but not in sufficient quantity to satisfy an important market demand?

Baker & McKenzie Advised on Sale of Strong Ukrainian Premium Brand Name
Baker & McKenzie announced today that it recently acted as the legal advisor to Horizon Capital, fund manager of Emerging Europe Growth Fund, LP, a mid-cap private equity fund investing in Ukraine and Moldova, with respect to sale of its shares in the open joint stock company “Shostka City Milk Factory” (Shostka), one of the Ukraine’s cheese sector market leaders, to French Fromageries Bel (Bel Group).

The Kyiv office Corporate/Mergers & Acquisitions team was led by Mykola Stetsenko, associate, under general supervision of James Hitch, Managing Partner.

Shostka is a top five Ukrainian manufacturer of hard cheeses in terms of market share and owes its leading position and investment attractiveness to Horizon Capital, a private equity fund manager, which purchased the milk plant in 2005.

Commenting on this transaction, Oksana Strashna, Vice President of Horizon Capital, said: “When our company made a decision to exit its investment from Shostka, we could count on the law firm that knew this market and over years demonstrated its constancy and consistency. We were pleased to meet the majority of the same team whom we jointly worked with on Shostka acquisition in 2005 and entrusted legal advisory work on Shostka shares sale to them.”

EFAW SWORN IN AS FEDERAL JUDGE OF U.S. MILITARY COURTS
The trial law firm of Wheeler Trigg Kennedy LLP is proud to announce that partner Andrew Efaw has been sworn in as a Federal Judge for the U.S. Military Courts. The U.S. Military Courts hear criminal cases for all of the Armed Services. A graduate of the United States Military Academy at West Point and of the University of Pennsylvania Law School, Army Lt. Col. Efaw served as an active duty Army Judge Advocate General attorney, and in 2004 was sent to Iraq for a one-year deployment as a reservist. He is one of only two members of the reserves in his class who completed the required judicial training at the University of Virginia Law School. At Wheeler Trigg Kennedy, Mr. Efaw focuses his practice on defending complex commercial, product liability, and franchise cases in federal and state courts.

Sonnenschein Expands Real Estate Group With Addition Of Tax Credit Attorney
Sonnenschein Nath & Rosenthal LLP announced today the addition of Mark Leitson as of counsel in its national Real Estate Group. Leitson will reside in the law firm’s Chicago office.

Leitson has a 20-year legal career covering multi-family and commercial real estate and corporate transactions. Most recently, he was vice president and deputy general counsel at National Equity Fund, Inc., one of the nation’s leading tax credit syndicators. In that position, Leitson oversaw all corporate and securities law matters, and he closed more than 40 low-income housing project investments on behalf of NEF equity funds.

“Mark will be specializing in the area of new market tax credits - a burgeoning business that has seen unprecedented growth,” said Jana Cohen Barbe (formerly Jana Cohen Blackman), chair of Sonnenschein’s Real Estate Group. “With a focus on that particular niche, Mark will be an asset to our already preeminent tax credit practice.”

Leitson received a J.D. degree from the University of Chicago and a Masters of Architecture from the University of Illinois at Chicago. He earned a B.A. degree from the University of Michigan.

“Sonnenschein’s Real Estate Group has already achieved prominence in the areas of new market and low income housing tax credits,” noted Leitson. “I look forward to contributing to the growth of the firm’s tax credit team.

Theodore C. Taub Receives Ralph A. Marsicano Award
Congratulations to Ted Taub, Partner in the Tampa office of Shumaker, Loop & Kendrick, LLP, on being awarded the Ralph A. Marsicano Award on Friday, May 11, 2007, at the Florida Bar’s City, County and Local Government Law Section’s 30th Annual Local Government Law Seminar at the Hyatt Regency Coconut Point, Bonita Springs. The award is the oldest and most prestigious given out by the Section. Mr. Taub was honored for his outstanding contributions to the practice of local government law over an extended period of time. Mr. Taub was nominated by Congresswoman Kathy Castor for the award.

Marsicano, the award’s namesake, was Tampa City Attorney for 28 years, general counsel for the Florida League of Cities for 30 years, and one of the principal authors of the local government provisions of the Florida Constitution.

The City, County and Local Government Law Section of the Florida Bar serves as an organization and resource for lawyers who represent local government interests or practice in this field on behalf of private interests.

Attorney Chip Rice, with the law firm of Lewis, Longman and Walker, P.A., who presented Taub with the award, said “Ted has been long overdue in receiving this award, he is much more than qualified.”

“I am very honored to receive this award. I knew Ralph Marsicano. To receive this award in his name is the highlight of my public career,” said Taub.

This program will provide a brief overview of bankruptcy law relating to real estate once the debtor files a petition, as well as a summary of condominium law.

Included topics: the Automatic Stay, preferences, when a Homestead is effective and to what extent, malpractice concerns, how the Trustee functions, what to look for in a Stipulation Agreement, Trustee’s Deeds, cautions on searching for Bankruptcy in the chain of title and to what extent searching PACER is required under current real estate practice.

INTRODUCTION TO CONDOMINIUM LAW

This portion of the program will provide the new attorney or paralegal with an overview of the elements in a master deed and declaration of trust, items to review in a unit deed and special considerations in the sale of a unit. The presentation will address the different types of residential condominiums. The seminar materials include checklists that will assist attorneys who conduct condominium closings.
