Commercial Real Estate Attorney Joins Nelson Mullins in Atlanta
Michèle L. Battle has joined Nelson Mullins Riley & Scarborough as a partner in the Real Property and Finance Group in Atlanta. Her practice includes zoning and land use, representing developers and small businesses in the acquisition and sale of real property, and representing institutional lenders in commercial loan transactions.

Ms. Battle is the founder of the Real Estate Development Institute Inc., a nonprofit organization that provides educational opportunities for minorities interested in commercial real estate development. She was awarded the 2000-2001 Networking Deal of the Year Award by the Commercial Real Estate Women of Atlanta.

In 2001 Ms. Battle was recognized nationally by the CREW Network with the Career Development Award and was named one of the 40 Rising Young Stars in Georgia under 40. A member of the State Bar of Georgia, Ms. Battle is also a member of the DeKalb County Habitat for Humanity Advisory Group.

"Michele contributes to the strength of our real estate development and finance practice, while adding a whole new dimension with her proven zoning and land use skills, and her community involvement," said Practice Leader Richard Herzog.

Ms. Battle earned a Juris Doctor from Harvard Law School in 1989. In 1986 she earned a Bachelor of Arts from The Ohio State University.

Robinson & Cole Attorney Participates in Panel at 2007 ABA Annual Meeting
Thomas J. Donlon, Counsel in Robinson & Cole’s Trial and Appellate Group, participated as a member of the panel for the program “Winning Management of Legal Issues Through Trial and Appeal” presented at the recent ABA Annual Meeting in San Francisco. The panel addressed the value of involvement of appellate attorneys during the pre-trial and trial stages of significant litigation from the viewpoints of the appellate court, the corporate client and the practitioner. Mr. Donlon serves as the chair of the programming sub-committee of the ABA Appellate Practice Committee.

IP Law 360 Quotes Partner Bill Golden in Winning Dismissal of Claim Against Bacardi
Partner William Golden is quoted in IP Law 360 regarding his successful representation of Bacardi. An article titled, "Judge Cuts Pernod's 'Havana Club' Claims in Half," reports that U.S. District Judge Sue L. Robinson dismissed one of two claims Pernod Ricard USA LLC has asserted against Bacardi USA LLC. Mr. Golden prevailed in the defendant's motion to dismiss the false advertising claim with respect to the "Havana Club" trademark. He stated that he is confident that the Delaware court will also rule in favor of Bacardi with respect to the origin of its Havana Club rum.

FDA’s Chief Counsel Sheldon Bradshaw to Join Hunton & Williams
Hunton & Williams LLP announced today that Sheldon Bradshaw, Chief Counsel of the United States Food & Drug Administration, will join the firm as a partner and co-chair of the firm’s Food and Drug Practice. Bradshaw publicly announced his resignation from his current position with the FDA today and will join Hunton & Williams’ Washington office in October.

“We have been looking to expand our Food and Drug Practice and Sheldon is an exceptional addition to our existing team,” said Wally Martinez, managing partner of Hunton & Williams. “He brings a wealth of experience from both the FDA and the Department of Justice which will be invaluable to our clients not only served by the Food and Drug Practice, but many of our other practices, as well.”

Bradshaw served as Chief Counsel of the FDA since 2005, where he was responsible for providing legal advice to senior leadership at the FDA and the Department of Health and Human Services; and for managing the work of more than 100 lawyers and staff. During his tenure, he oversaw controversial regulatory issues dealing with drugs, biologics, medical devices, food, and other products. He also reviewed and approved every regulation, guidance and warning letter issued by FDA; oversaw all FDA-related litigation; and negotiated and drafted landmark.

“Sheldon’s experience as Chief Counsel at FDA and his understanding of how the agency makes decisions will bring immediate benefits to the firm’s existing clients,” said Gary Messplay, who is chair of Hunton & Williams’ Food and Drug Practice and will co-chair the practice group with Bradshaw upon his arrival.legislation expected to be enacted this year.

Hunton & Williams’ Food and Drug Practice, based in Washington, provides legal and regulatory assistance to both emerging companies and large multinational corporations. It is a full-service food and drug practice covering all product categories, and involves regulatory and compliance counseling, government relations issues, transactions, and litigation and enforcement. The group assists clients in obtaining FDA approval of new products and developing regulatory approval strategies, clinical trial development and design, product labeling, and manufacturing issues.

“Hunton & Williams’ Food and Drug Practice is extremely well-respected in the biologics, pharma and related industry circles in the United States and internationally,” said Bradshaw. “This isa vibrant, stand-out practice in a very specialized area of law that presented a natural fit for my experience and future professional growth. Bradshaw began his legal career as a law clerk for Chief Judge Karen J. Williams of the United States Court of Appeals for the Fourth Circuit, and he worked as an associate with Howrey Simon Arnold & White, LLP from 1999- 2001.

He left private practice in 2001 when he was appointed Deputy AssistantAttorney General for the Office of Legal Counsel at the U.S. Department of Justice. There he provided legal advice to the White House, the Attorney General, and federal agencies on a variety of constitutional, statutory, and regulatory matters. In addition, prior to joining the FDA in 2005, Bradshaw served as the Principal Deputy Assistant Attorney General for the Civil Rights Division at the Department of Justice.

Bradshaw received his law degree with honors from The George Washington University School of Law in 1996, and his bachelor’s degree from Brigham Young University in 1991.

Fenwick & West's Silicon Valley Venture Capital Survey Reveals 74% Increase in Valuations in the 2nd Quarter of 2007
Fenwick & West LLP, one of the nation's premier law firms providing comprehensive legal services to technology and life science clients, today announced results of its Second Quarter 2007 San Francisco Bay Area Venture Capital Survey.

The survey analyzed the valuations and terms of venture financings for 126 technology and life science companies headquartered in the Silicon Valley/San Francisco Bay Area that reported raising capital during the second quarter of 2007.

"Our findings show a continuation of the strong positive trend in Bay Area venture valuations," said Barry Kramer, partner in the firm and co-author of the survey.

The Fenwick & West Venture Capital Barometer™ – which measures the change in share price of Bay Area companies funded during the quarter compared with the share price of their previous financing round – showed a 74% average price increase during the quarter.

"This was the second largest increase since the survey began," said Kramer, "exceeded only by a 75% increase in the first quarter of this year."

"The increase," he said, "was driven in part by 12 financings in which the purchase price of the stock sold in the financing was at least three times higher than the prior round. Of these financings, seven were in Web 2.0 and related fields."

The quarterly survey also disclosed that up rounds exceeded down rounds for the 14th consecutive quarter. "Up rounds exceeded down rounds 81% to 11%, with 8% flat," said Kramer. "The ratio of up rounds to down rounds was tied with the first quarter of 2007 for the highest ratio since we began the survey."

An up round is one in which the price per share at which a company sells its stock has increased since its prior financing round. Conversely, a down round is one in which the price per share has declined since a company's prior financing round.

Michael Patrick, also a partner in the firm and survey co-author, said, "As reported by Dow Jones VentureSource, aggregate venture investment in the U.S. during the quarter was $7.4 billion in 717 transactions, compared to $7 billion in 584 transactions in the first quarter of 2007. This was the highest amount of venture investment since the fourth quarter of 2001."

Further citing VentureSource, Patrick added, "Venture investment in health care continued to be especially strong. There was $2.4 billion in total health care investment, of which $1 billion went to medical device companies, the highest total on record for that segment of the health care industry."

Dickstein Shapiro LLP today announced its Congressional & Corporate Investigations Practice, led by partner Mark Paoletta, has formed a strategic alliance with Michael F. Barrett. For 10 years, Mr. Barrett was staff director and chief counsel of the House Energy and Commerce Committee’s Oversight and Investigations Subcommittee, one of the premier investigative committees in Congress.
