Firm Supports Diversity Initiative
This summer Goldberg Katzman again will participate in the Capital Area Managing Partners' (CAMP) Diversity Initiative. This year marks the second year for the CAMP Program. Attorney Royce Morris coordinates the program at Goldberg Katzman. Through this program, minority first-year law students are provided the opportunity to engage in "substantive legal work" alongside a mentoring attorney. Interns experience day-to-day life at the firm as well as attend client meetings, depositions, mediations and other hearings. Interns also are given research and drafting assignments.

Morris Wins Advocacy Award
Royce Morris will be awarded the Alan Jay Josel Advocacy Award at the annual meeting of the Pennsylvania Association of Criminal Defense Lawyers to be held on April 20. This award is presented to one member in recognition of extraordinary advocacy in one or more cases, causes, or issues during the previous year. Also, Attorney Morris who is currently the Vice President of the Association will become President-Elect at the same meeting.

EuroMoney Institutional Investor PLC-Legal Media Group has published its Guide to the World's Leading Product Liability Lawyers, the International legal market's leading guide to the top practitioners advising on product liability law. The list was compiled based on an international survey of 4,000 in-house counsel and senior practitioners involved in over 60 jurisdictions around the world.

Three members of Fasken Martineau's Product Liability Practice Group are listed in this prestigious directory: John Morin, Avon Mersey and Peter J. Pliszka.

Gide Loyrette Nouel advised Cleaveland on the acquisition of the "Mosaïque 3" portfolio
Cleaveland Asset Management, a real estate asset management firm, assisted a private investment fund in its purchase of a portfolio of 16 office buildings representing a total of 30,000 m² of office space for let, sold by 3 SCPI managed by UFG REM.

After the "Archipel" and "Cyclades" portfolios, this was the third invitation to tender for the acquisition of SCPI assets carried off successfully by Cleaveland.

For this transaction, Cleaveland was advised by Gide Loyrette Nouel (partner Frédéric Nouel and Hugues Moreau) and Maître Thessieux, notary.

The finance was provided by EuroHypo Bank Paris.

Court Approves Hercules Settlement
Judge Fullam approved the class action settlement at the hearing on May 7, 2007. For a copy of his Order, click here. He also approved the petition for counsel fees, cost reimbursements, and incentive payments. For a copy of that Order, click here.

The timetable for receipt of the settlement proceeds is:

(1) IF YOU HAVE ALREADY RETIRED AND HAVE RECEIVED A LUMP SUM PAYMENT

• If there is no appeal, the settlement will become final on June 7, 2007.

• Assuming there is no appeal, Hercules will send you an Election Form by September 4, 2007. That form will ask you how you want the settlement payment made to you: as a cash payment (from which the Hercules Pension Plan is required to withhold taxes), or as a direct tax-free rollover into your IRA or retirement plan with another employer. • You will have 30 days to complete and return this Election Form to Hercules.

• The Pension Plan will make the payment, in the manner you have directed, within 45 days after Hercules receives your Election Form.

• We cannot estimate what your settlement amount will be. For one plaintiff, the amount was 13% of his lump sum, and for the other plaintiff, it was 7.2% of his lump sum. The percentage you receive could be higher or lower because it is based on interest rates that were in effect during the calendar quarter you elected the lump sum.

• You will have automatically deducted from your payment 6.82% as your share of counsel fees, litigation costs, and incentive payments. For example, if your settlement amount is $5,000, then $341 will be deducted as your share of class counsel fees, costs, and incentive payments.

• Your settlement amount will also include interest at 3% on the settlement payment, compounded annually, from the date you retired until the date the settlement payment is issued.

(2) IF YOU ARE ENTITLED TO ELECT A LUMP SUM BUT HAVE NOT YET RECEIVED A LUMP SUM PAYMENT

• If you have not started your pension and therefore have not received any lump sum payment under the Pension Plan, your settlement payment will be included as part of the lump sum payment when you retire (assuming you elect to receive a lump sum).

• At that time, Hercules will provide you with a statement showing: your base lump sum; the additional settlement amount; the applicable interest rates; and your 6.82% contribution to class counsel fees, litigation costs, and incentive payments from the additional settlement amount.

Telcordia Wins $6.5 Jury Verdict
A jury has ordered Cisco Systems Inc. to pay $6.5 million to Finnegan Henderson client Telcordia Technologies Inc., the former research division of the Bell telephone companies, for infringing two of its technology patents. Although Telcordia originally sought $74.5 million in the case, Donald Dunner of Finnegan Henderson said he was pleased with the outcome. “We would have liked the damages to be a little higher,” Dunner said. “But the rest of the verdict was a complete victory for Telcordia.

Kenneth A. Tinkler Elected to the Executive Council of the City, County, and Local Government Law Section of The Florida Bar
Carlton Fields attorney Kenneth A. Tinkler was recently elected to a three-year term on the Executive Council of the City, County, and Local Government Law Section of The Florida Bar. Mr. Tinkler will serve in the District 2 seat, representing the territory encompassed by the 2nd District Court of Appeals appellate district, covering all of West-Central Florida. Organized in 1973, the City, County, and Local Government Law Section serves as an organization within The Florida Bar for lawyers, both private and public, practicing in the area of local government law.

Kenneth Tinkler is a member of the Firm’s Government Law and Consulting, Real Estate and Finance, and Energy Practice Groups. Mr. Tinkler is Board Certified in City, County and Local Government Law by The Florida Bar. His experience includes representation of government agencies and officials, including county government and constitutional officers. He is knowledgeable in Public Records & Sunshine Law, Parliamentary Procedure, Florida county home-rule charters, and Election Law, including Voting Rights Act issues. His practice focuses on a variety of state and local government law issues including land use law, election law, and environmental permitting.

Prior to joining Carlton Fields, Mr. Tinker was Senior Assistant County Attorney in the Office of the Hillsborough County Attorney. Tinker received his J.D. from the University of Florida College of Law in 1997, and B.A., cum laude, in Political Science, from Boston University in 1994.
