Rutan Obtains Dismissal of Defamation Action
Rutan aids in successfully obtaining dismissal of defamation and related claims made against the author by the subject of their scholarly/scientific article Who Abused Jane Doe, The Hazards of the Single Case History (http://www.csicop.org/si/2002-05/jane-doe.html) , in California Supreme Court case Taus v. Loftus, 40 Cal. 4th 683; 151 P.3d 1185; 54 Cal. Rptr. 3d 775; 2007 Cal. LEXIS 1896. The Court dismissed the claims on the grounds that the defendants' activities were protected by freedom of speech. The client was represented by Rutan & Tucker attorney Duke Wahlquist.

PHILLIPS LYTLE LLP PARTNER-IN-CHARGE RICHARD M. BEERS, JR. PRESENTS TO COUNTY OFFICIALS AT ANNUAL COUNTY FINANCE SCHOOL
Richard M. Beers, Jr., Partner-In-Charge with Phillips Lytle LLP, a full service law firm with statewide coverage, recently made a presentation on real property tax enforcement at the 41st Annual County Finance School in Syracuse. The three-day school attended by more than 250 county officials from across New York State was co-sponsored by the New York State Association of Counties, in conjunction with the Office of the State Comptroller and the New York State County Treasurers and Finance Officers Association.

At Phillips Lytle, Mr. Beers focuses his practice in the areas of real estate transactions and financing, secured lending, distressed loan resolutions and real estate tax matters. Apr-07 member of the American, New York State and Monroe County Bar Associations, he received his J.D. from Syracuse University College of Law and his B.S. from Bates College. Listed in The Best Lawyers in America®, Mr. Beers also serves on the board of directors of the Rochester Downtown Development Corporation.

Keller and Heckman LLP Partner, David G. Sarvadi, Joins Panel to Discuss Workplace Issues on NPR's Kojo Nnamdi Show
David Sarvadi, a partner in Keller and Heckman's OSHA and Employment practice, will participate on a panel of experts to discuss the role of The Occupational Safety and Health Administration (OSHA) and the impact the agency has had over the last 30 years. Workplace deaths and injuries have been on the decline since OSHA was created in 1971, but is the administration doing enough to protect today's workers? Mr. Sarvadi will represent the employer's view and will discuss the current state of OSHA enforcement, its successes and failures, and the prospects for OSHA Reform.

The panel will include participants from Keller and Heckman LLP, The George Washington University School of Public Health and Health Services, the U.S. Chamber of Commerce, and The Center for Public Integrity.

David Sarvadi advises clients in the areas of occupational health and safety, toxic substance management, pesticide regulation, employment law, and product safety. He works with clients in developing, reviewing, and auditing compliance programs in all of these areas, in obtaining agency rulings on proposed or novel activities and questions, and in seeking interpretations of regulations as they apply to specific sets of facts. He has been counsel to the National Coalition on Ergonomics from its inception in 1994. He has a background in occupational safety and health, having worked as an industrial hygienist for more than 15 years and became a Certified Industrial Hygienist in 1978.

Hearn client victorious as Indiana Court of Appeals holds excess insurer may not sue insured's attorneys for legal malpractice
Attorney Edward W. Hearn was victorious in a recent case involving a legal malpractice claim filed by an excess insurer against defense lawyers retained to defend its insureds in an underlying product liability suit in Indiana. The underlying case was settled for $6.3 million. The primary liability insurer paid just under $3 million towards the settlement. The excess insurer contributed $3.74 million to it. They then sued the defense lawyers, claiming that their alleged failure to assert a non-party defense in the underlying case resulted in a settlement that would otherwise have been much smaller. The insurance carrier further argued that it would not have had to pay anything under the excess coverage had the lawyers raised that affirmative defense.

The Indiana Court of Appeals held that an excess carrier could not bring a legal malpractice action against counsel for the insured and the primary carrier under an equitable subrogation theory as such a theory would be contrary to the Indiana rule of non-assignability of legal malpractice claims. The court also held that on the facts as adduced, the excess carrier could not assert that it had an express or implied attorney-client relationship with counsel for the insured and the primary carrier.

H&S Supports Lawyers Collaboration for Diversity Programs
Halloran & Sage attorneys recently participated in a wide of range of diversity programs in conjunction with the Lawyers Collaborative For Diversity, Inc (“LCD”).

The Lawyers Collaborative for Diversity was formed by concerned lawyers to answer the call for diversity. Their current challenge is to increase the recruitment, retention and promotion or lawyers of color. Their mission is to unite the resources, energy and commitment of the State’s leading law firms, corporations, public sector entities, law schools and state bar associations in the joint mission of making Connecticut a more attractive place for attorneys of color and women to practice law and find satisfying professional opportunities.

Recently, at the LCD annual meeting, Attorneys, Carl Ficks, Katie Bordeau, Brian Rich, Bill Wilson, Al DiVincentis and Mark Altermatt participated in an open forum facilitating the advancement of the diversity dialogue. The discussion focused on the importance of mentoring during law school so that law students of color have every opportunity to succeed academically and develop strong networking skills to help them become successful members of the bar.

Attorney June Sullivan contributed to an LCD open panel discussion in February entitled “Charting Your Legal Future”. A variety of topics were covered, including job searching, life as lawyers and public sector opportunities for law students of color.

Attorneys Regen O’Malley and Alexei Plocharzyk attended the Mentor Program Kick-Off Dinner where law students of color met their LCD mentors and participated in team building activities.

Recently, Attorneys Alfred DiVincentis, June Sullivan, Jeffrey Gostyla and Human Resources Manager Laurie Phillips participated in a discussion entitled “Creating Best Practices for Evaluations of Associates of Color.

Attorney Kathleen St. Onge will participate in a resume review and mock interview program for law students of color that will offer interviewing tips and guidelines and prepare students for the rigors of interview season.

In addition, Halloran & Sage is proud to sponsor the LCD Edwin Archer Randolph Diversity Award Celebration. This award ceremony honors and celebrates significant contributions and accomplishments in the advancement of attorneys of color within the legal community.
