WCM Wins Summary Judgment in Kings County Construction Accident Lawsuit
Associate Jamila Smith-Cha-Jua was awarded summary judgment in a Kings County, NY construction accident lawsuit. In the case of Godfrey v. TDO Holding Corp., the plaintiff, a construction worker, suffered an on-the-job injury. He alleged that our client, a subcontractor, had created a dangerous condition that led to his accident.

As discovery progressed, plaintiff continuously failed to provide any discovery responses. We therefore moved to dismiss plaintiff’s claim for failure to comply with the court ordered discovery schedule.

The trial court granted our motion and dismissed the plaintiff’s case with prejudice.

WCM Wins Summary Judgment in New York County Personal Injury Lawsuit
Associate Tamara Mosby won summary judgment in a New York County trip and fall case. In the case of Suero v. City of New York, et al, the plaintiff caught his right foot in a sidewalk crack located near a curb cut. His resulting fall resulted in alleged injuries of bulging discs, torn ligaments in his right knee and a fractured right knee. Our client, a construction company, had a standing contract with the City of New York to install curb cuts on an as-needed basis. At the time of the alleged accident, we had received a permit to perform work at the location of the plaintiff’s accident.

At the close of discovery, we moved for summary judgment. We argued that we never worked at the site of the plaintiff’s accident. In support of our argument, we produced documentary and testimonial evidence that indicated that the type of material used at the site of the plaintiff’s accident differed in quality and substance from the type of materials and equipment used by our client. In opposition, the plaintiff argued that because the City of New York said a contractor had worked at this site, and since we were the only contractor hired by the City to do work at the site where the plaintiff fell, a question of fact existed as to whether or not we were the cause of the defective sidewalk condition.

The trial court disagreed with the plaintiff’s opposition. It held that the plaintiff failed to prove that a question of fact existed so as to warrant the denial of summary judgment. The case against our client was dismissed.
