Gabriel Joins Dykema’s Intellectual Property Litigation Group In Los Angeles
Dykema today announced the addition of Allan Gabriel to its Intellectual Property Litigation practice group. Gabriel, joining the firm from Thelen Reid Brown Raysman & Steiner LLP, will be a member in the firm’s Los Angeles office.

Gabriel focuses his practice on intellectual property litigation involving patent, trademark and copyright infringement, trade secrets, false advertising and right of publicity claims on trial court and appellate levels. He also has substantial experience in handling antitrust, unfair competition, Internet related and general business litigation matters.

"Allan’s broad IP litigation experience will add substantial depth to our already nationally-renowned Intellectual Property Litigation team," said Rex Schlaybaugh, Dykema’s Chairman and Chief Executive Officer. In his new role at Dykema, Gabriel will continue to represent a number of clients in a variety of industries including software development, high tech components manufacturing, consumer food products, newspaper publication, as well as investors and entrepreneurs.

A frequent writer, Gabriel is co-author of "Trademarks," chapter six, Attorney’s Guide to the Law of Competitive Business Practices, California Continuing Education of the Bar, 1991 (second edition), and "Product Counterfeiting-Protection Under the Lanham Act Section 43(a)," Product Counterfeiting Remedies, Practicing Law Institute (1984).

He received a J.D. from Rutgers University School of Law and a B.A. from Queens College of the City University of New York.

Dykema Attorney Elected To Sustainable Business Forum Board
Mark Lenz, a member of the firm’s Real Estate Practice Group, has been elected to the Board of Directors for the West Michigan Sustainable Business Forum ("Forum"). The Forum was founded in 1994 under the auspices of the West Michigan Environmental Action Council (WMEAC), and while based in Grand Rapids, it is a regional partner of the Michigan Sustainable Business Forum. The mission of the Forum is to promote business practices that demonstrate environmental stewardship, economic vitality and social responsibility. The Forum provides information and resources to West Michigan businesses and local units of government, encouraging the adoption and implementation of sustainable development business practices aimed at improving corporate profitability while simultaneously enhancing the long-term health of the environment.

Mr. Lenz’ principal areas of practice include real estate, municipal and municipal finance law. Before joining Dykema, Mr. Lenz was an Assistant Corporation Counsel with the City of Chicago Department of Law for nearly 20 years. Throughout his career with the City of Chicago, he played a key role in some of the City’s most notable real estate developments. He represented the City’s Department of Housing in the creation and implementation of the New Homes for Chicago Program, the first government sponsored initiative in the United States involving municipal funding and provision of other incentives for the development, construction and sale of detached single family housing to low and moderate income households. He also advised the City’s Department of Planning and Development regarding several high profile real estate development projects that were financed in part utilizing tax increment financing.

Mr. Lenz received his B.A. from the University of Michigan, magna cum laude, and his J.D. from the University of Texas School of Law. He is an active member of the Chicago and West Michigan chapters of the United States Green Building Council.

Robinson & Cole Environmental Partner Discusses Environmental Insurance at the BBA
Robinson & Cole Environmental partner Christopher Foster made a presentation on April 24, 2007 to the Boston Bar Association on key legal and practical issues associated with applying for and securing environmental insurance policies.

Mr. Foster copresented with insurance broker Michael Long of William Gallagher Associates and Thomas Barry, Senior Vice President of the Massachusetts Business Development Corporation, who administers the Massachusetts Brownfields Redevelopment Access to Capital Program which provides environmental insurance subsidies for eligible properties.

Fannie Mae Closes Bond Credit Enhancement Deal for Hollywood & Vine Project
O'Melveny partner Masood Sohaili and associate Lauren Spiegel represented Fannie Mae in a bond credit enhancement deal for the Hollywood & Vine Project, a mixed-use development at the intersection of Hollywood and Vine that will include a retail portion, multifamily rental units (including affordable housing), and a W Hotel.

The project is being financed by an issuance of $180 million in tax-exempt private activity housing bonds by the Community Redevelopment Agency of the City of Los Angeles. Fannie Mae is credit enhancing principal and interest payments on the bonds and providing liquidity support to the bondholders.

The development will be a mixed-income project with 20 percent of the units restricted to people whose incomes are 50 percent or less of the area median income.

Former Wisconsin Public Service Commissioner Robert Garvin Joins Foley’s Energy Regulation Practice
Foley & Lardner LLP announced today that former Wisconsin Public Service Commissioner and Iraq War veteran Robert “Bert” Garvin joined the firm as of counsel in the Litigation Department and Energy Regulation Practice.

“We are delighted to have Bert join us. His demonstrated leadership and extensive knowledge of national and regional energy policy issues, such as regional electric markets and global climate change, will have significant impact on our Midwest and national clients,” said Ralf Boer, the firm's chairman and CEO. “Bert is a talented lawyer who brings to our practice and our clients valuable experience in regulatory, legislative and policy matters in these critical areas.”

Garvin previously served as a member of the three-person Public Service Commission of Wisconsin from March 2001 to February 2007. The Commission is the agency that regulates the state's energy, telecommunications and water utilities.

At Foley, Garvin will counsel clients throughout the country on issues related to electric transmission policy, regional electric generation and capacity markets, energy efficiency, renewable energy and the energy industry's response to global climate change.

Garvin was the primary author for many of the Commission's major orders and regulatory decisions that have resulted in the construction of over $4 billion of needed new transmission and generation facilities in Wisconsin. He was elected to serve as lead representative by state regulators from 14 states and one Canadian province to represent them in matters before the Midwest System Operator, Inc. (MISO) and the Federal Energy Regulatory Commission (FERC). He also directed advocacy efforts on behalf of regulators and companies serving customers in the Upper Midwest before FERC and MISO during the critical months leading up to the start of a regional day-ahead energy market.

He has testified numerous times before Congress, FERC, the Nuclear Regulatory Commission and state legislatures on energy and telecommunications policy matters. He has served on the board of directors of the National Association of State Regulatory Commissioners (NARUC) and as chairperson of its Nuclear Waste Subcommittee. As a result of his extensive public affairs and public speaking experience, Garvin is a nationally recognized expert and commentator.

Garvin also served in Operation Iraqi Freedom as a staff judge advocate with the U.S. Army, 3rd Corps Support Command, 40th Corps Support Group, at Logistics Supply Area Anaconda in north-central Iraq from September 2005 to September 2006. In that capacity, Garvin served as senior prosecutor advising commanders on a wide variety of military justice matters across the Iraq theatre of operations.
