Womble Carlyle has been honored for its efforts to help preserve North Carolina’s legal history through its support of the Supreme Court Historical Society.

The firm received membership in the Thomas Ruffin Society, given by the Supreme Court Historical Society for support of its historical preservation efforts. The membership was presented by Chief Justice Sarah Parker in a May 11th ceremony attended by the North Carolina Supreme Court. The Supreme Court Historical Society works to collect and preserve the history of the state’s courts. For example, a recent exhibit chronicles the history of women who have served as judges. The exhibits are open to the public and are on display in the Supreme Court building in Raleigh, which recently underwent a $9.5 million renovation.

WilmerHale Victorious in $103 Million False Claims Act Verdict
In a rare and complex False Claims Act trial, WilmerHale, working with a trial team from the Department of Justice, won a jury verdict in favor of the US government and client Richard Miller against all defendants with a damages award of just over $103 million. This is the fourth largest US jury verdict in 2007. Following a week’s deliberation, the jury found the defendants liable under the False Claims Act for conspiring to rig bids for US government-funded construction projects in the Middle East.

The construction projects were born from the 1978 Camp David Peace Accords and were paid for by the US Agency for International Development. The verdict, over ten years in the making, follows a criminal trial in which one of the defendants was convicted and several others pled guilty to charges of rigging their bids for US AID-funded projects in violation of US antitrust laws. WilmerHale client Mr. Miller is a former executive of one of the construction companies who, after becoming aware of the companies’ conspiracy, alerted the government.

This case drew on WilmerHale’s strengths in the areas of both antitrust and False Claims Act litigation, in which we regularly defend companies suspected of violations, as well as those who are victims of unlawful conduct.

Members of WilmerHale’s Litigation Department and Antitrust and Competition Department who worked on this case include Robert Bell, Jonathan Cedarbaum, Robert Cultice, Jennifer O’Connor, Colin Rushing, Matthew Baumgartner, Ashley Baynham, Monya Bunch, Michael Gottlieb, Kevin Heffel, Allison Murphy, Gregory Reece and Stephen Smith.

White & Case in London ECM Treble
White & Case has closed three London equity capital markets deals in the space of two days, including the move by one company from AIM to the London Stock Exchange's Main Market.

"At present, the equity capital markets are in a period of sustained growth, driven in particular by the continuing strengthening of economic fundamentals in the emerging markets. The trend of companies based in or focussed on emerging markets listing in London is well established, and it is something that we will continue to see more of," commented Allan Taylor, a principal partner in White & Case's Equity Capital Markets practice.

White & Case's equity capital markets treble involved the following transactions:

* Advising Merrill Lynch International and Hoare Govett Limited as joint sponsors on the move by Imperial Energy Corporation plc., a Russian oil and gas business, from AIM to the Main Market. The White & Case team advising on the deal was co-led by partners Philip Broke and Allan Taylor, working closely with associate David Dobbie;
* Advising Tau Capital plc., an Isle of Man investment company focussed on Kazakhstan, on its $250 million AIM IPO. Allan Taylor also led this deal, working alongside associates Deborah Grim, Victoria Henrion and Josephine Last; and
* Advising BMO Nesbitt Burns as placing agent in Titanium Resources Group Limited's $35.2 million secondary placement of shares on AIM. This deal was also led by Allan Taylor, who was assisted by associate Elizabeth Palmer.

Taylor added: "AIM has been a huge success story in recent years and a significant driver of growth in the London market. As it has matured, AIM has attracted larger and more international-based companies, and we are expecting to see more companies at the top end move up to the Main Market. AIM has lots of advantages for many companies, but the Main Market offers exposure to larger amounts of capital and has even more liquidity, which is clearly desirable for larger businesses."

The White & Case London-based ECM practice has had a formidable start to the year and recently recruited partners Andrew Croxford and Andrew Caunt to help meet growing client demand and a rapidly increasing pipeline of work.
