Porzio Pharmaceutical Marketing and Sales Compliance & Litigation Attorneys Presented at Pharma Industry Conferences
Linda Pissott Reig, Principal and Scott Liebman, Associate of Porzio, Bromberg & Newman, spoke at the RAPS Advertising, Promotion and Labeling Conference on May 11, 2007 in Minneapolis, Minnesota.

Over 100 people attended their presentation, entitled "Off-Label Communications: CME Activities & Clinical Trial Registries." They discussed how pharmaceutical companies must strike a delicate balance when revealing information about marketed drugs: too much information could result in accusations of off-label promotion and too little information may cause a zealous state attorney general to prosecute for "hiding" information.

Scott Liebman and Sarina Rivera, Associates, spoke at the 2nd Annual Prescription Data Restriction Summit on April 27, 2007 in Philadelphia, Pennsylvania.

Their presentation, entitled "Prohibitions Against 'Data Mining' and Your Business," gave an overview and update of states with pending legislation regarding prescription data restrictions, including New Hampshire, Missouri and Hawaii. They also discussed the effects of the American Medical Association's Prescription Data Restriction Program on the pharmaceutical industry, the implications of the Health Insurance Portability and Accountability Act (HIPPA), and gave practical solutions to monitoring various "Data Mining" legislation.

Fourteen Porzio Attorneys Honored as "Super Lawyers" by New Jersey Monthly Magazine
New Jersey Monthly Magazine has named fourteen Porzio, Bromberg & Newman attorneys as New Jersey’s 2007 “Super Lawyers.” The list includes Steven P. Benenson, Lisa M. Bromberg, Myron J. Bromberg, D. Jeffrey Campbell, Thomas R. Chesson, Roy Alan Cohen, Vito A. Gagliardi, Jr., Lauren E. Handler, Douglas R. Henshaw, Anita Hotchkiss, Kenneth R. Meyer, John M. Newman, Michael L. Rich, and Peter J. Wolfson.

New Jersey Super Lawyers selected Lauren E. Handler of Livingston and Anita Hotchkiss of Morristown, both principals of Porzio, in their list of New Jersey’s Top 50 Women Lawyers. The list is comprised of the women lawyers who received the highest point totals in the 2007 balloting, research and blue ribbon review process. Ms. Handler is also included in Super Lawyers’ list of Top 100 Lawyers in New Jersey.

Horton invents new method of delivering emergency glucagon dose
Pennington partner, Wiley Horton, placed First in the national Invent Now Challenge sponsored by The History Channel. Mr. Horton is a co-inventor, with Brian Boothe of Raleigh, North Carolina and Kim Bertron of Tallahassee, Florida, of the invention called, The SimpleShot, a new method of delivering emergency glucagon during a diabetic episode. The three co-inventors were recently profiled on the TV program, Modern Marvels: It Came from Outer Space.

Heller Ehrman Win in Patent Case Named one of the Top 10 IP Verdicts of 2006
A New Jersey jury awarded Texas Instruments, Inc. and Stanford University a $112 million verdict in a patent dispute with Globespan Virata, Inc. In early 2007, IP Law & Business named the case, Globespan Virata, Inc. v. Texas Instruments, Inc., et al., among the Top 10 IP verdicts from 2006, citing research by VerdictSearch. The dispute also landed among the Top 100 Verdicts in The National Law Journal, a sibling publication of IP Law & Business.

In 1998, Globespan and Texas Instruments (TI) entered into licensing negotiations with TI and Stanford about their patents for high-speed DSL modem technology. After refusing to take a license for 5 years, Globespan sued TI and Stanford in 2003, alleging TI's licensing offers violated antitrust laws and asserting TI and Stanford's DSL patents were invalid and, therefore, not infringed. TI countersued, claiming Globespan infringed 3 key DSL patents. Court granted a motion to bifurcate the case. Eventually, the patent claims went to trial in Jan. 2006. After more than 3 weeks of trial, the jury found that Globespan willfully infringed all 3 patents and awarded $112 million in damages. The “willful” finding opened the door to the possibility of enhanced damages.

Following the trial, Globespan argued that its antitrust claims in the same case, which were scheduled for trial in Oct. 2006, would nullify the patent damages verdict and require TI and Stanford to pay substantial antitrust damages to Globespan. However, in March 2006, the judge dismissed several of Globespan's antitrust claims. Shortly thereafter, Globespan approached TI to initiate settlement discussions. In May 2006, Conexant Systems, Inc., on behalf of its subsidiary, Globespan, agreed to pay $70 million to TI and Stanford University to settle the patent infringement dispute and related antitrust litigation.

The lead attorneys from Heller Ehrman representing Texas Instruments were Alexander L. Brainerd, a shareholder in the firm’s San Francisco office, and Robert T. Haslam, a shareholder in the firm’s Silicon Valley office in Menlo Park, Calif. Several other lawyers from Heller Ehrman were involved in representing TI, including Silicon Valley's Amy Van Zant, Aaron Jacobs, Peter Gratzinger, Jaideep Venkatesan, Kyle Robertson, and Dario Scimeca; San Francisco's Rob Fram and Keith Weed; and Washington, D.C.'s Johnny Kumar and Jay Jurata.

Heller Ehrman Named a "Bet-the-Company" Law Firm in BTI Report
Heller Ehrman has been named as a premier “Bet-the-Company” law firm by BTI Consulting Group in BTI’s 2007 report, BTI Power Rankings: The BTI Client Relationship Scorecard for Law Firms. According to BTI, Heller Ehrman’s position was based on earning clients’ votes of confidence for critical matters or crisis situations and the firm’s ability to handle high-priority, high-value matters.

The report was generated through interviews conducted by BTI with 427 corporate counsel at large and Fortune 1000 companies. Through the survey, BTI’s objective was to test the underlying strength of law firm relationships and gauge which law firms are best positioned to lead the market. Clients evaluated more than 350 law firms.

According to BTI, the only way to be named on the exclusive list of “go-to” law firms is to be identified, unprompted, by clients in BTI’s independent, objective research.

Heller Ehrman Named a "Go-To Law Firm" for Financial Service Companies
Heller Ehrman has been named a “Go-To Law Firm” for Financial Services Companies by American Lawyer Media (ALM), based on a recent survey.

ALM asked general counsel at the leading financial services companies which outside law firms they turn to for assistance. ALM’s research department also investigated and gathered data on financial services company’s Go-To Law Firms from various sources, such as public records, including court dockets and securities filings, and legal and business publications, including The American Lawyer and The Wall Street Journal among others.

According to ALM, the surveys and research focused on several areas of legal services, including litigation, corporate transactions/mergers & acquisitions, regulatory affairs/compliance, securities, banking/finance, labor/employment and intellectual property. Law firms cannot pay to be on the list.

Greenberg Traurig Facilitates $176M Construction Loan for High-Rise Condo Hotel
Joel K. Goldman, a shareholder in the Miami office of Greenberg Traurig, LLP and a member of the firm’s national Real Estate team, announced today the closing of a $176.5 million construction loan by LaSalle Bank National Association for TRG - Brickell Point West, Ltd., an affiliate of The Related Group, to finance the Viceroy Resort and Residences at the Icon Brickell Condominium complex.

Located within the third and final Icon tower, Viceroy at Icon Brickell will command a dozen of the building’s 50 stories. As the first condo hotel of its kind in the downtown Miami and Brickell Avenue area, it will offer a sky-high rooftop pool bar, destination restaurant and other hotel amenities for Viceroy guests and Icon residents. The Viceroy is a joint venture between Kor Hotel Group and The Related Group.

“We are very proud that we have structured a deal that meets our client’s financial needs throughout the life of this project,” said Goldman, who represented TRG with assistance from Greenberg Traurig Associate Kimberly S. LeCompte.
