Seven Rider Bennett Attorneys Join Briggs and Morgan
Four shareholders and three associates formerly with the Minneapolis-based Rider Bennett firm, which closes its doors May 31, have joined Briggs and Morgan, Professional Association. Shareholders Eric J. Magnuson and Diane B. Bratvold join the business litigation section, bringing a full range of appellate consulting services; Shareholder David B. Dean, who has been practicing law for more than 30 years on behalf of domestic and international clientele, joins the business law section; and associates Anna M. Burgett and Michael J. Stepan join the financial institutions and real estate section (shareholder Joseph D. Roach and associate Joseph L. Currier were announced in a previous news release).

Eric Magnuson, shareholder, has spent the last two and half decades practicing almost exclusively in appellate law, including consultation at both the trial and appellate levels. In his more than 30 years of experience, he has provided a full range of appellate consulting services, handling hundreds of appeals in a wide range of areas, including constitutional issues, employment law, trust and probate matters, trade secrets, business contracts, insurance law, land use, governmental law, and professional liability. He will be listed in the 2007 Annual Guide to Appellate Law in America.

Magnuson is the founding president of the 8th Circuit Bar Association. He has served as chair of the Commission on Judicial Selection since 2003, when Governor Tim Pawlenty first made the appointment.

Among his other contributions, he is: fellow and past president of the American Academy of Appellate Lawyers; a board member of the Minnesota chapter of the Federal Bar Association; co-reporter to the Minnesota Supreme Court Appellate Rules Committee; and past co-chair of both the American Bar Association’s Appellate Practice Committee of the Section on Litigation and Appellate Advocacy Committee of the Tort Trial and Insurance Practice Section. Magnuson received his B.A. from the University of Minnesota and J.D. cum laude from William Mitchell College of Law.

Diane Bratvold, shareholder, has spent more than 18 years handling civil appeals in Minnesota state and federal appellate courts and U.S. Courts of Appeals for the 7th, 8th and 9th Circuits. She has also frequently consulted or been admitted pro hac vice for appellate matters in North Dakota, Wisconsin and Iowa. Bratvold’s representation has involved many issues, including constitutional law, employment law, trust and probate matters, trade secrets, business contracts, insurance law, complex civil procedure, product liability and tort liability.

Bratvold is a fellow of the American Academy of Appellate Lawyers and currently holds several leadership positions in the field as chair of the Minnesota State Bar Association’s Appellate Section, Minnesota director of the Eighth Circuit Bar Association and chair of the program committee of the Defense Research Institute’s Appellate Advocacy Committee. She received her B.A. summa cum laude from Macalaster College and obtained her J.D. cum laude from the University of Minnesota Law School.

David Dean, shareholder, has been practicing law for more than 30 years with focus on domestic and international business legal matters. He has assisted clients in a wide variety of industries (such as waste management, high-tech, alternative energy, medical products, health care and Internet real esate) with strategic transactions across the globe. Dean’s experience includes advising boards of directors and executive management on matters relating to fiduciary duty, shareholder value, corporate governance and Sarbanes-Oxley, shareholder relations, corporate finance, mergers and acquisitions, and executive
compensation.

Dean currently sits on the executive council of the Minnesota State Bar Association Business Law Section. He received his B.A. cum laude from Holy Cross College and J.D. from Marquette University Law School, where he was editor-in-chief of its law review. Prior to joining private practice in 1990, Dean served as in-house counsel to a major high-tech firm and its data storage division, handling negotiations for strategic transactions, critical technology licensing, government relations, and mergers and acquisitions, among other responsibilities.

Anna Burgett, associate, practices principally in the areas of real estate, banking and finance, assisting clients with a broad range of transactional and litigation matters. In her real estate practice, she has experience preparing and negotiating negotiating purchase, sale and lease agreements, and loan documentation. She has also represented clients in litigation regarding judicial foreclosure actions, mortgage priority disputes, boundary line and easement disputes, residential real estate matters, mechanic’s liens, and quiet title actions. Burgett received her B.A. from the College of Saint Benedict and J.D. from the University of Minnesota Law School. Prior to joining private law practice, she clerked for the Honorable Edward Toussaint Jr.

Michael Stepan, associate, practices principally in the areas of creditors’ remedies, bankruptcy, and real estate and banking litigation. He has represented a number of lenders, mortgagees, lessors, trade creditors, vendors and individuals in bankruptcy proceedings and related proceedings, as well as general creditors’ rights litigation. Prior to joining private law practice, Stepan was a judicial law clerk to Judge Gregory F. Kishel for the U.S. Bankruptcy Court, and also previously served as a courtroom deputy clerk to Judge Nancy C. Dreher. He is a member of the Minnesota State Bar Association and its Bankruptcy Section, and was a member of faculty for the 2005 MSBA Bankruptcy Institute. Stepan earned a B.A. from St. Mary’s University of Minnesota and J.D. from William Mitchell College of Law, where he received the CALI Award in bankruptcy and served on the editorial board of the William Mitchell Law Review.

CRAVATH REPRESENTS PERRY CAPITAL, MARATHON ASSET MANAGEMENT, D.E. SHAW GROUP AND TENNENBAUM CAPITAL PARTNERS IN DORAL FINANCIAL CORPORATION RECAPITALIZATION
Cravath represented Perry Capital, Marathon Asset Management, D.E. Shaw Group and Tennenbaum Capital Partners in connection with their formation, together with Bear Stearns Merchant Banking, of Doral Holdings, L.P., which in turn entered into a definitive stock purchase agreement with Doral Financial Corporation to acquire from it $610 million of Doral common stock. The lawyers involved in this matter are partners B. Robbins Kiessling, Thomas E. Dunn, and associates Tatiana Lupushchik, Mansur M. Nuruddin and Venkatesh Vijayaraghavan on corporate matters; partner Andrew W. Needham and associate Darren G. Heil on tax matters; and partner Eric W. Hilfers and associate Kerry Ann Fitzgerald on employee benefits matters.

Brian Burke, Jane Dall Receive Leadership in Law Awards
Brian K. Burke and Jane A. Dall, both of Baker & Daniels LLP, received 2007 Leadership in Law Awards from Indiana Lawyer. The publication recognized outstanding attorneys from around the state in its May 2 issue.

Burke, chair and CEO of Baker & Daniels, was one of 15 lawyers receiving the Distinguished Barrister Award honoring individuals whose leadership – both in the legal profession and community services – has been exemplary and had significant impact during their careers.

Burke, a member of the Indiana bar for almost 29 years, was elected to Baker & Daniels' management committee in 1990 and appointed managing partner in 1993. He is responsible for providing effective, efficient service to clients through eight offices in Indiana, Washington, D.C. and China. In the community, Burke is president of the Indianapolis City Market Corporation's board of directors, serves on U.S. Sen. Evan Bayh's service academy selection committee and is immediate past president of the Boy Scouts of America's Crossroads of America Council.

Dall, an associate in business litigation at Baker & Daniels, was one of 15 individuals receiving the Up and Coming Award for lawyers who are early in their legal careers but have already demonstrated a knack for leadership and making an impact, as well as having the makings of becoming a distinguished barrister in the future.

Dall joined Baker & Daniels in 2004 after graduating from the University of Notre Dame Law School and clerking for the Honorable Kenneth F. Ripple in the U.S. Court of Appeals for the Seventh Circuit. Besides representing clients at trial and appellate levels in commercial and employment litigation matters, she is actively involved in the firm's Seventh Circuit pro bono initiative. Dall coordinates Baker & Daniels' volunteer tutoring program at Indianapolis Public School 39 and serves on the Southeast Neighborhood Development's board of directors.

William A. Krais wins $587,000 in Medical Malpractice Suit - Maliavsky v. Caponetti
William A. Krais, a principal with Porzio, Bromberg & Newman, P.C., settled a case on behalf of Geraldine Maliavsky against Dr. Richard Caponetti in a medical malpractice case. A Middlesex County jury returned a verdict in favor of Mrs. Maliavsky, who is now 57-years-old, $725,000 for her past and future pain and suffering. The Court will add to the verdict the stipulated medical bills and lost income, in the amount of $113,632, for a total gross verdict of $838,632. However, the Court will reduce the verdict by 30% under Scafidi to account for that portion of Mrs. Maliavsky's current condition that the jury found to be caused by her pre-existing medical condition.

In May 2000, Mrs. Maliavsky fell at work, suffering a fracture-dislocation of her right (non-dominant) shoulder. She came under the care of Dr. Caponetti, an orthopedic surgeon. Dr. Caponetti reduced the dislocated shoulder. In June 2000, he operated on Mrs. Maliavsky to repair a fracture of the greater tuberosity, a bony area of the shoulder.

Mrs. Maliavsky claimed that Dr. Caponetti did not repair the fracture properly, that he failed to place and fix the bone fragment in an anatomic position. As a result, Mrs. Maliavsky claimed that the bony fragment healed in a non-anatomic position and that she required multiple surgeries to regain any significant function of her right shoulder. Dr. Caponetti disagreed. He asserted that he properly repaired the fracture and that Mrs. Maliavsky's limitations throughout her rehabilitation and today were caused by the severe initial injury combined with the outcome of Mrs. Maliavsky's subsequent treatment.

Edward Craig, M.D., an orthopedic surgeon from the Hospital of Special Sugery in New York, and Edward Self, M.D., an orthopedic surgeon from Ridgewood, New Jersey, testified as experts on behalf of the plaintiff.

Mr. Krais, Principal, primarily represents plaintiffs in m edical malpractice and serious personal injury cases in New Jersey and New York state and federal courts. He chairs the firm's Personal and Fiduciary Services Practice Group.
