SUPREME COURT RULES ON WAGE/REST PERIOD VIOLATION STATUTE
The California Supreme Court issued a decision in Murphy v. Kenneth Cole on April 16, 2007 finding that the remedy provided for in Labor Code Section 226.7 (which requires employers to pay employees an additional hour for meal and rest period violations) is a "wage" subject to a 3 year statute of limitations rather than a "penalty" subject to a 1 year statute of limitations.

Thompson Hine Grows Retail Real Estate Practice
Bruce Hopkins has joined the law firm of Thompson Hine LLP as a partner in its Real Estate practice in the Washington, D.C., office. Prior to joining Thompson Hine, he was with Griffin-Fletcher LLP.

Mr. Hopkins states that he joined the firm because “I was attracted to both Thompson Hine’s focus on client service and the strength of its national real estate practice. I look forward to growing my practice with the firm.”

Mr. Hopkins’ practice focuses on retail and mixed-use projects including development, leasing, purchases and sales, financing, due diligence, management and construction matters. Prior to entering private practice, he worked for almost a decade in the real estate industry doing commercial real estate appraisal work, commercial real estate lending and development for a major life insurance company and commercial real estate development and management for a private developer.

Mr. Hopkins has handled virtually every aspect of shopping center transactions including letter of intent negotiation; purchase contract negotiation; due diligence and purchase transaction closings; governmental development and financing agreements; REA documentation; renovations and expansions of existing properties; design and construction agreements; pad sales and leases to anchors and outparcel users; inline retail store leases; sale contract negotiation and transactions. His retail project experience includes mixed-use, regional shopping malls, lifestyle centers, streetscapes, conversions from single-tenant to multi-tenant use, power centers and grocery-anchored strip centers.

Mr. Hopkins earned his J.D., cum laude, from Salmon P. Chase College of Law. He received his B.A. in economics from Yale University. He is admitted to practice in the state of Ohio and the commonwealth of Kentucky.

Shipman & Goodwin Attorney Honored by Darien-Norwalk YWCA
Shipman & Goodwin attorney Phillip H. Bartels was recently honored by the Darien-Norwalk YWCA for his ongoing work with the women’s organization. Mr. Bartels incorporated the organization in 1975 and has served as its counsel on a pro bono basis ever since. Mr. Bartels was honored by the organization at the Darien 28th Annual Volunteer Recognition Day Luncheon which celebrated Darien volunteers and projects that have made a difference in the community.

The YWCA of Darien-Norwalk touches one out of every six households in the community. Through family programs, community service initiatives and social clubs, the YWCA has served women and families in the area for over 30 years.

Fetzer elected to ABOTA
Attorney Brian C. Fetzer was recently elected to the Illinois Chapter of the American Board of Trial Advocates (ABOTA) at their annual Law Day luncheon, Tuesday, May 1, at the Mid-Day Club in Chicago .

ABOTA was launched in 1958 with the goal of preserving the right to trial by jury as guaranteed by the Seventh Amendment to the United States Constitution. Membership in this organization is by invitation only to trial attorneys who have demonstrated excellent trial skills while maintaining the highest levels of professionalism, integrity, honor, and courtesy.

Mr. Fetzer has extensive civil trial experience, having tried jury cases to verdict in both state and federal court. He has frequently lectured on tort civil practice and trial strategy issues for the Chicago Bar Association, The Illinois Association of Defense Trial Counsel, The Illinois Institute of Continuing Legal Education, and the International Association of Defense Counsel. In 2003 his peers selected him as one of the Top 20 Defense Lawyers in Chicago .

He is joined by Johnson & Bell ABOTA members William V. Johnson, Margaret A. Unger and John W. Bell. Mr. Bell currently serves as ABOTA Illinois Chapter president.

Patrick Oxford Quoted in Houston Chronicle
Patrick Oxford, managing partner of Bracewell & Giuliani is interviewed by Houston Chronicle's Mary Flood for "Texas-based, globally oriented." Oxford said that globalization of the economy has had a huge effect on all major American law firms. "Corporate governance scandals and Sarbanes-Oxley have brought a very tight and complicated regulatory scheme to American capital markets, and as a result, many new companies outside the United States are choosing to seek funds in the London capital markets as opposed to New York. The energy markets are booming worldwide as well, said Oxford.

Laurence F. Sovik, Esq., to be Honored as 50-Year Member of the Onondaga County Bar Association
Laurence "Fritz" Sovik, Esq., will be honored as a 50-year member of the Onondaga County Bar Association at the annual 50-Year Luncheon. Fritz and 16 of his peers will be honored at the event.

Fritz celebrated his 50th year at Smith Sovik in October 2006.
