UNITED STATES SUPREME COURT AGREES TO HEAR APPEAL BY KLEIN & CO. FUTURES, INC.
On May 21, 2007, the United States Supreme Court agreed to review a decision by the United States Court of Appeals for the Second Circuit that Klein & Co. Futures, Inc., a futures commission merchant, lacked standing under the private remedy provisions of the Commodity Exchange Act to bring a suit for damages against a board of trade and its subsidiaries for failure to enforce rules to prevent a manipulation scheme that led to Klein & Co.’s collapse (Klein & Co. Futures Inc. v. Board of Trade of City of New York, U.S., No. 06- 1265, 5/21/07). The Supreme Court will hear the case in the fall.

Day Pitney LLP and Morrison & Foerster LLP served as co-counsel on Klein & Co.’s petition for a writ of certiorari to the Supreme Court. Day Pitney LLP attorneys Jeffrey Plotkin and Lorraine Bellard represented Klein & Co. in this effort. The Futures Industry Association filed an amicus brief in support of Klein & Co.’s petition for certiorari to the Supreme Court.

Orrick Boosts Asian Litigation and Arbitration Practice
Orrick, Herrington & Sutcliffe LLP announced today that Andrew Dale will join Orrick as of counsel, resident in the firm's Hong Kong office. Dale, who joins from Paul Hastings, is part of the four person litigation team to join Orrick with Hong Kong's newest partner Robert Pé.

"We are strategically building our pan-Asian litigation practice to advance our capability to serve our global clients," said Christopher Stephens, Managing Partner of Orrick's Asian offices. "The recent increase in investment and transactions in China and throughout the region has increased the demand for sophisticated litigation expertise, and the addition of Andrew will enhance our litigation capability in Hong Kong. We are particularly pleased to bring across an entire team who have worked together with great success over several years."

Dale concentrates his practice on complex contentious matters including commercial litigation, international arbitration, intellectual property and product liability. His recent engagements include advising a major Hong Kong technology conglomerate in a high-stakes fraud claim, advising a Taiwanese client to challenge jurisdiction of the Hong Kong court and representing the vendor of a major cosmetics business in Mainland China in a multi-million US dollar ICC arbitration.

"It is an incredible opportunity to continue working with Robert and join a growing global firm like Orrick," said Dale. "I look forward to contributing to Orrick's significant litigation practice in Asia, and contribute to the thriving litigation practice throughout the world."

Dale received an LL.B degree from the University of Leicester in 1996 and an L.P.C. from the College of Law in York in 1997.

Orrick Adds Leading Capital Markets Real Estate Lawyer in New York
Orrick, Herrington & Sutcliffe LLP announced today that Alan J. Pomerantz has joined the firm as a partner and head of its real estate practice in New York. A former partner and head of the real estate practice at Weil, Gotshal & Manges, Pomerantz joins Orrick from private equity real estate investment company ERE Advisors LLC, where he was Co-CEO and President and a member of the company’s Investment Committee.

“Alan Pomerantz is a big-impact player,” said Peter Bicks, the Partner-in-Charge of Orrick’s New York office. “He brings decades of experience as a deal lawyer, which, combined with his recent experience as a senior business executive, will enable Orrick to keep pace with clients’ growing needs for capital markets and real estate-related services in New York and around the world.”

A leading real estate lawyer in the New York community, Pomerantz was the chair of Weil Gotshal’s global property and finance practice group for 11 years as well as a member of its firmwide global management committee and its New York pro bono committee. He has represented many of the preeminent global private equity investors, investment banks, financial institutions and real estate developers in large and complex real estate transactions, including equity joint ventures, project developments, acquisitions, public and private financings, and restructurings. Among his many community activities, Pomerantz is a member of the Executive Committee and Advisory Board of the Real Estate Institute of New York University and has cochaired its annual Capital Markets and Pension Fund Investment Conference for more than ten years. He is a board member of the Furman Center, a joint research center of the New York University Law School and the NYU. Robert F. Wagner Graduate School of Public Service, which addresses issues of low-income and affordable housing.

“Alan will take a lead role in building a high-value capital markets-oriented New York real estate practice to complement our strong real estate practices in Europe, Asia and the West Coast,” said William Murray, Jr., a San Francisco partner who leads the firm’s global real estate practice. “His arrival sets the tone for the future growth of our New York real estate practice and other real estate-related practice areas.”

Other real estate-related practice areas include securitized financing; portfolio acquisitions and dispositions; real estate M&A activities; leasing and development; restructuring and creditors’ rights regarding asset-level debt and equity real estate investments; REITs; CMBS; CDOs; and syndicated loans.

Leading International tax adviser joins Mayer, Brown, Rowe & Maw in Brussels
International law firm Mayer, Brown, Rowe & Maw LLP is pleased to announce that International and Benelux tax adviser Astrid Pieron has joined the firm. Astrid is based in the Brussels office.

Astrid provides advice, with a focus on international and Benelux tax issues, on tax transactions; financial structures and products and tax controversy. For tax transactions she has specific expertise on LBOs and funds structuring, and has experience acting for the acquiring funds, the target or the managers. For financial structures and products Astrid advises financial institutions and corporations. Her tax controversy advice includes transfer pricing, for example the increasing interest by non-EU countries, such as Russia, in the benefits of efficient transfer pricing structures.

Astrid has over 25 years of experience as a tax adviser. Previously she was a tax partner at Deloitte and before that a tax partner at Arthur Andersen. She teaches at the University of Brussels. She is a co-author of books on the accounting, legal and tax aspects of derivatives (CED. Samson 1994-1998) and the author of books on international tax matters (Kluwer 2002; Larcier 2005). She is a director of the board of Union Wallonne des Enterprises.

Astrid joins nearly 100 tax partners at Mayer, Brown, Rowe & Maw between its various offices. With Astrid's arrival Mayer, Brown, Rowe & Maw has created a Benelux tax centre in its Brussels office that will address most of the tax challenges enterprises face in the Benelux area.

Astrid Pieron commented: "I am delighted that my international and Benelux tax experience can be used for the benefit of Mayer, Brown, Rowe & Maw's clients. I am also excited to be working in a multidisciplinary environment given the importance of tax issues to many areas undertaken by the firm such as transactions; trade and transfer pricing; pensions; financial services; derivatives and real estate."

Attorney Jenifer A. Belt Appointed President of the Board of Governors of the UT College of Law Alumni Association
Shumaker, Loop & Kendrick attorney, JENIFER A. BELT, has been appointed President of the Board of Governors of the University of Toledo College of Law Alumni Association.

Ms. Belt is a partner in the health law practice group in the Toledo, Ohio office. Ms. Belt serves on the Boards of the St. Vincent Mercy Medical Center Foundation, Habitat for Humanity, the Toledo Firefighters Health Plan, and Citifest. She is the President of the Toledo Junior Bar Association and is Chair of the Health Law Committee of the Ohio State Bar Association.

Ms. Belt received her J.D., magna cum laude, from the University of Toledo College of Law and her B.A., cum laude, from Miami University.

Patton Boggs Lodie White Appointed to Board of Directors of the Foundation of the Energy Law Journal
Patton Boggs LLP congratulates associate Lodie White on her appointment to the Board of Directors of the Foundation of the Energy Law Journal. The Journal publishes legal, policy, and economic articles of lasting interest and with significant research value on subjects dealing with the energy industry. Ms. White will serve a three-year term on the Board, providing legal and regulatory guidance on a wide range of industry-related issues. Ms. White also served as Chair and Vice-Chair of the Young Lawyers Committee of the Energy Bar Association from 2004-2005 and 2003-2004, respectively.

The Energy Law Journal is beginning its twenty-sixth year of publication. Published semi-annually, it has nearly 2,600 subscribers in the United States and 15 other countries, including Canada, Brazil, Argentina, Germany, Austria, Japan, Australia, Taiwan, and Korea. The Journal has become a preeminent energy publication, providing thought-provoking and deeply researched articles by practitioners, internationally known academics, federal judges, high-ranking government officials, and members of FERC. The Journal is often cited by Federal Courts, law review articles, energy industry speakers, and FERC. Its Board of Directors consists of nineteen directors.

At Patton Boggs, Ms. White advises clients on complying with federal statutes and regulations governing the electricity industry. Specifically, she provides strategic advice to clients for complying with FERC regulations governing open access transmission, generator interconnection, and prohibitions on market manipulation and fraud. She also assists them with litigation matters before FERC.


Before joining the firm, she was a staff attorney at FERC in the Office of the General Counsel, Division of Energy Markets and Rates, and in the Office of Enforcement, Division of Market Oversight and Investigations. While in the Office of Enforcement, Ms. White investigated companies in the natural gas and electric industry for potential violations of Commission rules, orders, and regulations relating to energy market structures, activities, and participants. She also provided advice to the practictioners and the public alike via FERC’s Enforcement Hotline and handled a variety of transmission, market, and operational issues.

Ms. White earned her law degree at the American University Washington College of Law in 1999 and holds two degrees from Wayne State University, an M.B.A. (1995) and a B.A. (1992).
