John Soshnik Named "Up & Coming Attorney" For 2007
The global law firm of Dorsey & Whitney LLP today announced that John Soshnik has been named an “Up & Coming Attorney” for 2007 by Minnesota Lawyer.

Each year Minnesota Lawyer reviews nominations and selects 20 early-career lawyers for the honor. "All the nominees, as well as the attorneys selected, are exemplary lawyers who do the profession proud," said Mark Cohen, editor-in-chief of Minnesota Lawyer.

An associate attorney in the Dorsey Health practice, Soshnik assists health care providers, health care benefit companies and managed care organizations with transactions, regulatory issues, health benefits and finance. As a former associate general counsel for UnitedHealth Group, Soshnik appreciates health law from the client’s perspective and has insight into the challenges and opportunities that health care companies face.

"John is a talented lawyer who has earned the trust of clients and colleagues alike,” said Neal Peterson, chair of the Dorsey Health practice. “He is a recognized leader, and his positive attitude and outgoing nature make it a pleasure to practice law with John."

Soshnik joined Dorsey in 2000. He earned his law degree from the William Mitchell College of Law in 2000, and also holds a B.S. degree in Urban Studies from the University of Minnesota.

Covington Shortlisted as Best Recruiter and Best Trainer by LawCareers.Net
The London office of Covington & Burling LLP has been shortlisted in two categories of LawCareers.Net Training & Recruitment Awards 2007:

- Best Recruiter, US Firm in the City, and
- Best Trainer, US Firm in the City

Pittsburgh Immigration Attorney Ellen Freeman to Serve on Two Committees for the American Immigration Lawyers Association
Buchanan Ingersoll & Rooney PC immigration attorney Ellen Freeman has been invited to serve on the Health Care Professionals Committee and the Ethics and Practice Management Committee of the American Immigration Lawyers Association (AILA), a national association of more than 10,000 attorneys and law professors who practice and teach immigration law. Her one-year terms will begin at the AILA's annual conference, which opens on June 13, 2007. As a member of these committees, Freeman will be responsible for accomplishing the goals set out by the committees while coordinating with the executive committee and staff contacts.

Founded in 1946, AILA is a nonpartisan, not-for-profit organization that provides its members with continuing legal education, information, professional services and expertise through its 35 chapters throughout the nation. AILA is an affiliated organization of the American Bar Association and is represented in the ABA House of Delegates.

Ellen Freeman focuses her practice on employment-based immigration such as temporary work visas and permanent residence, including PERM/labor certification applications, preference petitions and consular processing/adjustment of status. She received her law degree from the University of Pittsburgh School of Law, where she was appointed to the Order of the Coif. She received a master of international affairs degree with a concentration in international corporate environments from the University of Pittsburgh Graduate School of Public and International Affairs. Buchanan Ingersoll & Rooney Adds Real Estate Duo in Pittsburgh: Knox and Kochenbach Return to the Firm after 10 Years
Buchanan Ingersoll & Rooney PC is pleased to announce the addition of two real estate shareholders in Pittsburgh. Charles G. Knox and Carrie Kochenbach have joined Buchanan from Marcus & Shapira. Both previously had been real estate attorneys with Buchanan, Knox for 23 years and Kochenbach for six years. They joined Marcus in 1997.

"We're thrilled to have Carrie and Charley back," said Tom VanKirk, Buchanan's CEO. "We expect that they will play a significant role in the continuing growth of our real estate practice, both in Pennsylvania and throughout all of our offices. Charley in particular will spend a great deal of time in San Diego to help us develop our Las Vegas and West Coast real estate practice."

Knox and Kochenbach primarily represent institutional lenders in unsecured financings and construction loans to major real estate developers. Knox also assists real estate developers with acquisition, finance and leasing transactions. Kochenbach focuses her practice on commercial real estate lending and refinancing, with an emphasis on construction and mortgage lending.

Knox and Kochenbach were drawn back to Buchanan for the business opportunities the national firm presented.

"I was also very interested in the opportunity to help Buchanan grow its presence in Southern California and Nevada through the major real estate clients we serve," Knox said.

About Knox

Charles Knox focuses his practice on real estate law with particular emphasis in the area of commercial real estate finance. He has represented institutional lenders and commercial real estate developers with respect to acquisition, finance and leasing transactions.

On behalf of his clients, Knox has:

* Documented and closed a number of unsecured loans from institutional lenders to publicly traded real estate investment trusts and other large commercial developers, including several unsecured lines of credit involving between $100 million and $300 million.

She has participated in various aspects of commercial real estate lending and refinancing, including a concentration in construction and mortgage lending. She also has experience in sales of commercial property, asset purchases and general real property law.

On behalf of her real estate clients, Kochenbach has documented, negotiated and closed a variety of commercial loans from institutional lenders to both large and small commercial developers, including many syndicated construction and renovation loans for hotels, shopping malls, residential apartment projects and condominiums, lifestyle centers and office buildings throughout the United States.

Kochenbach earned a J.D. from the University of Pittsburgh School of Law. She also holds a bachelor of arts degree in history from Kenyon College.

Robins v. PACCAR Victory
Lionel A. Hawse, Will H. Fulton and Lee A. Rosenthal of Woodward, Hobson & Fulton, in Lexington and Louisville, Kentucky, successfully defended PACCAR Inc in a wrongful death action brought by the parents of an eleven year old boy. The product liability action asserted that the visibility of the Peterbilt cab chassis was inadequate causing the driver of the garbage truck to overlook the child. The jury unanimously found that the product was not defective. The trial occurred in Fayette Circuit Court in Lexington, Kentucky.

In July 2001 the driver of a right-hand steer automated garbage truck ran over an eleven year old as the driver negotiated a left turn into an intersecting street. The child was riding a “razor” scooter near the left curb. They collided in the mouth of the intersecting street. Due to the “out tracking” characteristic of straight trucks, the left rear tandems rolled over the child’s head and chest crushing him to death.

The product at issue was a 1993 PACCAR right hand drive cab & chassis equipped with an automated side loader body manufactured by Wayne Engineering. In addition to claims of inadequate off-side and rear visibility, plaintiff’s claimed that right-hand drive vehicles were unreasonably dangerous per se, that they were too large for operation in residential neighborhoods, and that there were inadequate warnings regarding the out-tracking characteristics of straight trucks.

The incident created much publicity in Lexington including a comprehensive review of whether the government of the Lexington metropolitan area should abandon the automated side loaders which are proven safer and more efficient than the 3 man rear loaders.

Plaintiff’s asserted that in addition to the four mirrors on the left side which came from Peterbilt as original equipment, the manufacturer should have included an aspherical mirror and a left hand video camera as well. Wayne had added a rear video camera at the time the garbage body was installed. Peterbilt established that aspherical mirrors have been criticized in such an application. The jury unanimously rejected the need for an alternative design finding that there was no defect.

Richard H. C. Clay Named as a Fellow to the International Society of Barristers
Woodward, Hobson & Fulton, L.L.P. announced this week that Richard H.C. Clay, a partner in the Louisville office, has been named a Fellow in the International Society of Barristers. The International Society of Barristers is an honor society of outstanding trial lawyers chosen by their peers on the basis of excellence and integrity in advocacy. It seeks to preserve trial by jury, the adversary system, and independence of the judiciary. Created in 1965, the Society has a limited membership with Fellows from every state, the District of Columbia, Puerto Rico, and the Virgin Islands, from Australia, Canada, England, Scotland, and Mexico, with the great majority from the United States. Fellows are elected by the Society’s Board of Governors on nomination by a Fellow after inquiry directed to other Barristers in the nominee’s region and to judges before whom the nominee has tried cases.

Mr. Clay practices in the areas of complex litigation, pharmaceutical and medical device litigation, appellate practice and administrative law. He has tried over 75 jury trials in state and federal court. He serves as Kentucky counsel for several major pharmaceutical companies confronting nation-wide claims. He is included in the Best Lawyers in America in “Commercial Litigation” and “Personal Injury and Civil Litigation,” and is a member of the firm’s management committee.
