Moore Addresses ABA Conference
Denver partner Steven W. Moore was a speaker at the 2007 Annual Meeting of the American Bar Association (ABA). The presentation was entitled “Ex Parte Communications in Employment Class Actions” (co-authored with Cleveland partner Gregory V. Mersol).

Employment class litigation has been one of the hottest areas of employment law, and Mr. Moore discussed one of the most contentious areas of this type of litigation – communications that defense counsel may have with putative class members in an effort to develop the evidence needed to defeat class certification.

Speaking to a national audience of attorneys, Mr. Moore discussed the important interests that employers' attorneys have in communicating with putative class members before a class is certified and the manner in which such communications can be conducted without running afoul of any of the ABA Model Rules of Professional Conduct.

Mr. Moore also discussed application of the ethics rules in various different contexts, including traditional class actions under Fed. R. Civ. P. 23, collective action or opt-in cases under the Fair Labor Standards Act, and enforcement actions filed by the Equal Employment Opportunity Commission or the Department of Justice.

The ABA's Annual Meeting was held August 10-12, 2007 in San Francisco, California and is one of the largest continuing legal education conferences in the nation.

Mayer Brown Attorney Marcia Madsen Named Top Lawyer
Mayer Brown partner Marcia Madsen has been named the Top Government Contracts Lawyer for 2007 by the Washington Business Journal. The distinguished award, which was presented at a reception in Washington, D.C. on Tuesday September 11, 2007, is bestowed annually to the lawyer(s) exemplifying the very highest standards of professionalism, ability and expertise.

Ms. Madsen was thrilled to receive the honor. "I am truly flattered and pleased to be recognized with this prominent award. Thanks must go out to my colleagues at Mayer Brown as well as those who dedicated themselves to the Acquisition Advisory Panel," Madsen said. "This is truly and honor that I will not forget."

Ms. Madsen has been a partner at Mayer Brown since 2001 and serves as chair of both the Government Contracts and Homeland Security Practice Groups. Over the last year she has scored a number of significant victories for her clients, including a high profile case for Lockheed Martin in which she successfully protested the Air Force's noncompetitive award of its $15 billion CSAR helicopter program. Additionally, Ms. Madsen was selected to chair the Acquisition Advisory Panel. This 13 member panel, created by Congress and appointed by the White House, was charged with recommending improvements to acquisition laws and policies. The Panel's work has been the subject of considerable attention, including testimony by Ms. Madsen before Congress regarding the Panel's recommendations. Many of the panel's recommendations are now making their way into legislation and regulations.

"We're extremely proud of Marcia and the work she has done for our clients and for the country as the Chair of the recent federal panel on government acquisitions," said Peter Scher, Partner-in-Charge of Mayer Brown's Washington, D.C. office. "She has been a wonderful asset to our firm and our clients, and I'm delighted that she received this much deserved recognition for all her efforts."

Mayer Brown has a broad based government contracts practice that involves regulatory issues and litigation. The firm advises companies with government business regarding cost and pricing issues, audits and investigations, and the special rules applicable to intellectual property in government agreements. Litigation of contract disputes, prime/sub disputes, and bid protests comprise a substantial portion of the practice.
