The USPTO Issues Rule Changes
The United States Patent Office (“USPTO”) published the final version of the long-awaited rule changes. The changes to the rules affect continuation practice and claims practice, as well as impose new limitations on applications. The rules go into effect November 1, 2007, and are applicable to all new applications filed on or after the effective date. The rules also apply retroactively to all pending applications with a limited grandfather provision (i.e., one more continuing application without a petition or showing).

The Federal Circuit Announces a new Standard for Determining Willful Infringement, and Reviews Waiver of Privilege as it Relates to the use of Legal Opinions in Litigation
The Federal Circuit, sitting en banc, issued a unanimous decision establishing a new standard for determining willful infringement. In the same opinion, the court reviewed the waiver of attorney-client privilege as it relates to the use of opinions in defending infringement actions.

Six MG&C members chosen for 2008 edition of The Best Lawyers in America

Mr. Garrett graduated from Western Carolina University and is a cum laude graduate of the University of South Carolina School of Law. He concentrates his practice in the area of workers' compensation law.

Mr. Benjamin graduated from the University of South Carolina with a degree in political science, and received his Juris Doctor from the University of South Carolina School of Law. He practices in the areas of governmental relations law, business litigation, municipal finance, procurement, and administrative and regulatory law.

Mr. Morgan graduated from The Citadel, and he received his Juris Doctor from the University of South Carolina School of Law. He practices in the areas of insurance law, personal injury, arson and insurance fraud, bad faith, premises liability, products liability, and health care law.

Mr. Holmes graduated from the University of North Carolina at Chapel Hill with a degree in Business Administration, and he obtained his Juris Doctorate from the College of William and Mary. He concentrates his practice in the are of workers' compensation law.

Janet D. Callahan Presents to Association of Justices of the Supreme Court of the State of New York
Janet D. Callahan was selected by the Association of Justices of the Supreme Court of the State of New York to speak at their annual fall conference at the Gideon Putnam Hotel in Saratoga Springs.

Callahan’s topic at the conference, which was attended by 150 Supreme Court Justices and guests, was “Significant Court of Appeals Cases in 2007.” A partner at Hancock & Estabrook, LLP, Callahan chairs the Firm’s Litigation and Appellate Practice Groups and is a member of its Executive Committee.

GARDERE WELCOMES GERARD TO LITIGATION SECTION
Gardere Wynne Sewell LLP is pleased to announce the addition of Bretton C. Gerard as a partner in the firm’s litigation section.

Mr. Gerard’s practice is devoted to business litigation, with a specific focus on real estate, partnership and property disputes. He is also a trained mediator with extensive experience in resolving cases through mediation and arbitration.

Dorsey & Whitney Welcomes Evan Ng to the Firm's Palo Alto Office
The law firm of Dorsey & Whitney LLP is pleased to announce the addition of Evan Ng to its Palo Alto office. Mr. Ng joins the firm as Of Counsel and brings experience representing public and private life science and technology companies across a broad range of matters that include venture capital and private equity financings, initial public offerings, mergers and acquisitions and strategic technology transactions.

Mr. Ng maintains an active specialty practice focused on the life science industry and frequently advises underwriters on public offerings and private equity sponsors in the negotiation and execution of buyout transactions. In addition, he also advises U.S. companies and investors with respect to operations and investments in China, and is fluent in Cantonese and Mandarin.

The firm’s worldwide footprint and existing client base of premier life sciences clients are a perfect fit with the startup companies, venture capitalists and private equity firms with which I work," said Mr. Ng. Simpson Thacher Represents Blackstone in Investment in China National Bluestar (Group) Corporation – First Blackstone Investment in China
Simpson Thacher is representing The Blackstone Group with respect to its investment of up to $600 million to acquire 20% of the equity of China National Bluestar (Group) Corporation. China National Bluestar is a key subsidiary of the PRC state-owned enterprise China National Chemical Corporation and a leading manufacturer of new material and specialty chemical products. This transaction represents Blackstone’s first major investment in China.
