Firm Wins "Landmark" Land Use Case
Magavern Magavern Grimm served as special counsel to the Village of Lancaster in a lawsuit by a church hoping to relocate within the Lancaster Industrial Park, which was not zoned for use by a church. After the Village Board denied the church's application for a special use permit, the church sued.

In what has been described as a "landmark decision," Erie County Supreme Court Justice Joseph Makowski agreed with Jim Magavern that the Village's "legitimate interest" in reserving land in the industrial park for industrial use outweighed the church's right to relocate within the industrial park.

Paul Seltman to Speak on Employer-Mandated Universal Health Care
Paul Seltman, counsel in the Washington office, will participate in a live webcast debate on national health care reform at 10-11:30 a.m. EDT on Oct. 3 at the Woodrow Wilson International Center for Scholars in the Ronald Reagan Building in Washington, D.C.

Moderated by bestselling author and physician Robin Cook, the other speakers include James Marone of Brown University and Michael Cannon from the Cato Institute. Paul will be speaking on an employer-mandated approach to universal heath care that he outlined in an article that appeared in Covering America: Real Remedies for the Uninsured, Volume III. The debate is being co-sponsored by the Wilson Center and the Global Health Initiative. The event is open to the public in addition to being webcast.

48 GARDERE ATTORNEYS NAMED TO SUPER LAWYERS LIST
A total of 48 partners from the Dallas, Houston and Austin offices of Gardere Wynne Sewell LLP have earned selection to the 2007 Texas Super Lawyers list.

Gardere has placed more than 45 attorneys on the list in each of the five years the list has been compiled by the publishers of Texas Monthly and Law & Politics Media Inc. With their selection to the 2007 list, 30 of the firm’s attorneys are now five-time honorees. Additionally, four attorneys are first-time selections.

“To have such a high percentage of our partners not only to be selected for this honor, but also to have been named to every edition is indicative of the type of attorney that we have at Gardere,” says Stephen D. Good, Gardere Managing Partner. “As with everyone who made the list, they are leaders in their fields and in our firm.”

Texas Super Lawyer selections are based on peer nominations made by more than 70,000 attorneys from across the state, with the final selections made by a panel of lawyers chosen by the Texas Super Lawyers editors. Fewer than 5 percent of the attorneys nominated were chosen for this honor. The list appears in the October 2007 issue of Texas Monthly and Texas Super Lawyers, a publication co-produced by the publishers of Texas Monthly and Law & Politics Media, Inc.

Earlier this year, 12 Gardere attorneys were chosen to appear on the Texas Rising Star list, a companion to the Super Lawyers list. Rising Stars selections are based on nominations by members of the Texas Super Lawyers list. Rising Stars are the top upand-coming Texas attorneys who are 40 or younger or have been in practice for fewer than 10 years.

Paul Hastings Represents Private Escapes in its Definitive Merger with Ultimate Resort
Paul, Hastings, Janofsky & Walker LLP, a leading international law firm, announced today that the firm represented Private Escapes Destination Clubs, the industries third largest destination travel club, in its definitive agreement to merge with the industries second largest destination club, Ultimate Resort, LLC. The transaction, which is expected to close in November 2007, will result in a combined real estate portfolio with a fair market value of $200 million.

Chicago partner Rick Chesley led the Paul Hastings team, which included partner Greg Spitzer and of Counsel Stacey Kern.

The combined company will be the fastest growing and top destination club by number of locations, with 1,200 combined members accessing 140 properties located in the United States, Mexico, the Caribbean and Europe. The combined company’s corporate and operational offices will be located in Orlando, Florida; Fort Collins, Colorado; and Kansas City, Missouri.

Gallo Named Recipient of First Annual Jeffrey F. Liss Award
DLA Piper announced today that partner Greg Gallo has been named the recipient of the first annual Jeffrey F. Liss Award. Established in memory of Jeffrey Liss, U.S. Co-Managing Partner, the award recognizes a U.S. partner who has significantly contributed to both the firm and legal profession, as well as having demonstrated a unique and meaningful concern for the public good.

“Jeff Liss was an exceptional lawyer who made countless and profound contributions to the firm, the legal profession and society,” said Francis B. Burch, Jr., Joint Chief Executive Officer of DLA Piper. “Greg embodies the kindness, graciousness and humility for which Jeff was known, and that this award was created to recognize. He is a great lawyer. His strong and longstanding commitment to the welfare of our communities and to pro bono, his commitment to the welfare of the firm and his empathy and humility are what set him apart.”

Respected and recognized for decades as one of best lawyers in Silicon Valley, Gallo has long contributed meaningfully to his community, his firm and to the profession without regard to recognition and publicity. Among other things, he served on the board of directors of Family & Children Services from 1995-2001 and on the board of the Entrepreneurs Foundation from 2002 until very recently, and he has served on the board of the Silicon Valley Community Foundation since 2006.

The Jeffrey F. Liss Award
Jeffrey F. In addition to serving on the firm’s global board and its U.S. executive and policy committees, Liss was active in many professional and civic organizations.

In establishing the Jeffrey F. Liss Award, DLA Piper seeks to honor Jeff Liss’ accomplishments as a lawyer and his contributions to the firm, legal profession and greater community. The award will be presented on an annual basis to a DLA Piper partner who consistently acts as a steward for the firm, helping to set and execute policy and strategy, whose empathy and leadership make him an ambassador of the firm in the U.S. and around the world. Qualities associated with the award will include extraordinary legal abilities, a passion for the work, a strong commitment to pro bono, diversity and mentorship and a balance in life and temperament.

As was the case this inaugural year, award recipients will be announced at the annual U.S. Partners Conference in September.
