Condon McGlothlen Quoted in Chicago Daily Law Bulletin “Companies are Testing a New Kind of ‘Health Law'”
Condon McGlothlen was quoted in the article, “Companies are Testing a New Kind of ‘Health Law,” published in the September 14, 2007 issue of Chicago Daily Law Bulletin. The article examines employers’ emphasis on wellness programs, with a special focus on mandatory wellness programs for employees.

Condon notes that, “We've always told people voluntary wellness programs are fine. But companies are now wanting to go beyond that, and insurers are encouraging companies to go beyond that to reduce employee and retiree health care costs.”

Condon remarks that "employers can certainly encourage employee wellness" and offer medical exams and other company initiatives, but it is doubtful in most industries that it would be legal to require employees to undergo medical tests, including blood tests, "as a condition of employment."

Regarding smokers, he notes the law in Illinois and in many other states permits employers "to charge smokers higher insurance premiums or to provide different levels of health insurance benefits for smokers." Condon points out, however, that In Illinois banning nicotine from employees' lives as a condition of employment is illegal. He notes that, "Many states have laws like this, not all." Even so, employers in some states have begun to require that employees not smoke, including outside of work. Condon observes that there may be more such ideas on the horizon, including some concerning alcohol consumption: "I've had it asked would it be legal" to require employees to completely abstain from alcohol.

DLA Piper helps to buck the credit crunch trend for VTB Bank Europe plc
DLA Piper has finalised a commercial lease for VTB Bank Europe plc (VTB) who have agreed to take headquarters space at 14 Cornhill, EC3. VTB are taking a 20 year lease of the top five floors of the building, which is due to be finished at the end of the year. The initial rent is in excess of £3.5m per year.

Real estate partner, Paul Jayson, led the UK/Russian team from DLA Piper and commented: "It's clearly an uncertain time for both the real estate and banking sectors in London, however through this deal and others, we are seeing clients who wish to take advantage of the shortage of the best quality space in the heart of Europe's premier financial district."

The developer is for this project is IVG Asticus Real Estate Limited who were represented by James Miller from Cameron McKenna.

DLA Piper's team also included Emma Joyce and Corinne McCarthy from the engineering and construction team and Delphine Nougrayede and Ksenia Borisenko from the Moscow office.

Seventy-Two Miller Canfield Lawyers Named Super Lawyers
Miller Canfield announced today that 72 of its lawyers have been named in the second edition of Michigan Super Lawyers. The firm has more lawyers named than any other firm in Michigan.

Super Lawyers are the top 5 percent of attorneys in the state as chosen by their peers and through the independent research of Law & Politics. Michigan Super Lawyers 2007 is based on the survey of more than 30,000 attorneys across the state who have been in practice for five years or more.

McDermott Earned 100 Percent Rating for Second Year in Row on HRC's Corporate Equality Index
The Human Rights Campaign (HRC) released its annual Corporate Equality Index, naming McDermott Will & Emery as one of the U.S. companies earning the top rating of 100 percent. This is the second year McDermott has received this perfect score. The results of the survey illustrate a 41 percent increase in the number of companies expanding benefits and protections for their gay, lesbian, bisexual and transgender employees.

"McDermott is committed to attracting and retaining exceptional talent to our global practice. With this commitment in mind, McDermott has prioritized the development of strong diversity programs and practices, and the Firm has achieved great momentum in recent years," commented Harvey Freishtat, Chairman of McDermott Will & Emery.

During the past few years, McDermott has formalized its diversity program by implementing and establishing three different diversity committees including: the Racial & Ethnic Diversity Committee, the Gender Diversity Committee and the LGBT Diversity Committee. While the programs have varying initiatives and programs, they each have the same goal—to create and sustain an inclusive work environment where diversity of thought and expression from every employee is valued.

Noted Business And Securities Lawyer Theodore Guth Moves To Manatt
Manatt, Phelps & Phillips, LLP, the national law and consulting firm, announced today that Theodore E. Guth has joined the firm as a partner in the Business, Finance & Tax Division. Mr. Guth, a founder of the corporate, securities and business law boutique of Christopher | Guth LLP, will move that firm's practice to Manatt.

Mr. Guth will continue to focus his practice on business, corporate, and securities matters. Manatt Partner Senator Martha Escutia (Ret.) Appointed To Commission For Impartial Courts
Manatt, Phelps & Phillips, LLP, the national law and consulting firm, announced today that former State Senator Martha Escutia has been appointed to serve on the Commission for Impartial Courts Task Force on Public Information and Education. Sen. Escutia, a member of Manatt's Government & Regulatory Policy Division, was appointed to the Commission by the Honorable Ronald M. George, Chief Justice of the California Supreme Court and Chair of the Judicial Council.

As a member of the Commission, Sen. Escutia will work with other former Senators, highly regarded judges, court administrators and attorneys to ensure that the public in California has access to an impartial judicial system that is fair and accountable. Earlier this year, Sen. Escutia was honored by the Judicial Council of California for her role in bringing landmark reforms to the state's judicial system.

“I am thankful for Martha's willingness to continue her enormous contributions to the administration of justice in our state,” said Chief Justice George. “Her commitment, knowledge and understanding of the state's judicial system will be an asset to the Commission.”

The Commission was formed in August 2007, to focus on the manner in which judges are selected, retained, and removed from office, which can have a major impact on the independence of the judiciary. As a member of the Task Force on Public Information and Education, Sen. Escutia will evaluate and make periodic reports and final recommendations regarding proposals to improve public information and education concerning the judiciary.

“Martha is a perfect choice to join this important Commission,” said George Kieffer, Chair of Manatt's Government & Regulatory Policy Division. “She has a deep commitment to the judicial process and to the State of California, and I know that she will bring a wealth of vision and expertise to her new role.”

During her tenure in the Legislature, Sen. Escutia held key leadership positions, including the first Latina Chair of the Senate Judiciary Committee, the first woman Chair of the Assembly Judiciary Committee, and Chair of the California Legislative Women's Caucus. As a freshman legislator, Sen. Escutia was Chair of the Senate Health Committee, and was also ranking Democrat on the Assembly Health Committee. She served as Chair of the Senate Committee on Energy, Utilities and Communications and was the first woman Chair of the 27-member-strong California Latino Legislative Caucus. Sen. Escutia also successfully led the effort to bring full employment status to trial court interpreters. She is author of the Court Facilities and Construction Act, and the Family Law In Pro Per Information System.

Kramer Levin Receives Perfect Score From Human Rights Campaign in List of Best Companies for GLBT Equality; One of Only Four New York City Based Law Firms
Demonstrating the firm’s continuing commitment to diversity, Kramer Levin Naftalis & Frankel LLP earned a perfect score in the Human Rights Campaign’s (HRC) sixth annual “Corporate Equality Index.” The HRC, which is the nation’s largest gay, lesbian, bisexual and transgender (GLBT) rights organization, uses the Corporate Equality Index as a tool to rate American businesses on how they treat GLBT employees, consumers and investors. Kramer Levin is one of only four New York City law firms and one of 27 law firms nationwide to receive the HRC’s 100 percent perfect rating.

“We take great pride in this top score,” said Paul Pearlman, Kramer Levin’s managing partner. “Kramer Levin has always believed in the value of diversity in the workplace and that discrimination of any kind, including on the basis of sexual orientation and gender identity, has no place in our firm.”

In addition to providing generous benefits to its employees without regard to sexual orientation or gender identity, Kramer Levin has played a leading role in pro bono GLBT rights litigation for over a decade. The firm served as co-counsel with Lambda Legal in Hernandez v. Robles, which sought equal marriage rights for same-sex couples under New York law, and is currently litigating several cases involving respect in New York for marriages of same-sex couples entered into in other jurisdictions. Kramer Levin also submitted amicus briefs in Boy Scouts v. Dale and Lawrence v.
