Greg Hall and Chris Miner join DLA Piper’s Corporate Group in Phoenix
DLA Piper US LLP today announced that Greg Hall and Chris Miner, leading corporate attorneys, will be joining the firm’s Corporate and Securities practice group as partners in the Phoenix office. The announcement comes shortly after the addition of Steven Pidgeon and David Lewis to the Phoenix office’s Corporate and Securities practice group.

Greg Hall and Chris Miner come to DLA Piper from Squire, Sanders & Dempsey, L.L.P., where Hall served as managing partner of that firm’s Phoenix office. They represent a number of major companies, including Mesa Air Group, Inc., Meadow Valley Corporation, Barrett-Jackson Auction Company, Ready Mix, Inc. and SuperShuttle International, Inc. In addition, Hall spent time in the London office of his former firm and Miner previously practiced in Frankfurt and New York, working on cross-border acquisitions and offerings.

Steven Pidgeon and David Lewis recently joined DLA Piper from Snell & Wilmer L.L.P, where Pidgeon was co-head of, and Lewis a partner in, the Business & Finance group. Pidgeon joins Mark Nadeau as co-managing partner of DLA Piper’s Phoenix office. Together, Pidgeon and Lewis have represented a wide variety of private and public companies, investment banks, private equity firms and other businesses, including ON Semiconductor Corporation, Meritage Homes Corporation, Roth Capital Partners and Jobing.com.

Corporate, Securities and M&A expert, Jeff Greene, joins DLA Piper Shanghai
DLA Piper announced today that partner Jeff Greene, a leading international corporate and securities lawyer, has joined the firm's Shanghai office. Greene's assignment to Shanghai from DLA Piper's Seattle office is in response to growing client demand for mergers and acquisitions (M&A) expertise in China. As an expert in cross-border M&A's , particularly in advising high technology and emerging growth companies, Greene will help drive DLA Piper's thriving China practice.

"Jeff's experience leading M&A transactions around the world will add significant value for clients in China and companies from abroad which are entering the market," said Roy Chan, Managing Partner of DLA Piper's Shanghai office. "With China fast emerging as a significant global force in the high technology arena this assignment is a strategic step to cement our position in China and meet the increased demand by emerging growth companies for seamless legal services, insights and solutions."

Greene has led cross-border M&A transactions in Australia, China, Germany, India, South Korea, the UK and elsewhere. His practice has also included public and private debt and equity offerings, private equity and venture capital. With substantial experience representing public companies accessing capital markets in a variety of transaction types, including shelf registrations and private investments in public equity (PIPEs), Greene will help DLA Piper deliver full-service legal and business counsel to clients operating in China.

Recently, Greene has advised numerous start-up technology companies in formation, capitalisation, stock options and represented venture capital firms in seed and later round financing transactions. He also represented purchasing and selling companies in numerous M&A's and divestures, and lenders and creditors in secured financing transactions.

"The ongoing investment in Chinese operations by multinationals, along with the surge in Chinese companies investing abroad, calls for an increased focus on cross-border transactions," said Nick Seddon, Asia Managing Director of DLA Piper. "Jeff's experience advising a wide range of international companies on complex transactions will enhance DLA Piper's ability to meet the changing needs of companies in China."

Greene will be working with DLA Piper China's award-winning venture capital and private equity team. It is the winner of Zero2IP'’s "2006 Venture Capital Lead Legal Advisor Award" and Top Capital magazine's "Counselor of the Year Award."

Named a "rising star" by Washington Law and Politics magazine, Greene frequently lectures on corporate governance and M&A related topics and is the co-managing editor of "The Mergers and Acquisitions Handbook – A Practical guide to Negotiated Transactions," a joint publication by DLA Piper and Bowne & Co., Inc. A member of the State Bar of Washington and a board member of the Diversity Trust of the Future of the Law Institute, Greene earned his JD from Golden Gate University with honours, and his BA from the University of Nevada at Reno.

James J. Brosnahan to Receive the American Inns of Court 2007 Lewis F. Powell, Jr. Award
James J. Brosnahan, senior partner at Morrison & Foerster LLP, will receive the American Inns of Court 2007 Lewis F. Powell, Jr . Award for Professionalism and Ethics. The award is presented annually at the United States Supreme Court “to recognize a lifetime devoted to the highest standards of ethical practice, competence, and professionalism.”

Attorneys, judges, government officials, journalists, philanthropists, and other community leaders are nominated each year for the award. A national committee of the American Inns of Court then selects the honoree. Mr. Brosnahan is the second recipient in the award’s 17-year history who has not been a judge.

“Jim Brosnahan is a role model for us at Morrison & Foerster and in the profession more broadly,” said Keith C. Wetmore, Chair of Morrison & Foerster. “He is utterly fearless in the defense of the rule of law, and his professional accomplishments are legendary. We congratulate him on this well-deserved honor.”

Mr. Brosnahan is a senior trial lawyer who has been recognized extensively throughout his career for his expertise in both civil and criminal trial work. He holds a place in The State Bar of California’s “Trial Lawyers Hall of Fame,” was recognized in The National Law Journal’s2006 “Top 100 Most Influential Lawyers in America” list, and was named “Trial Lawyer of the Year” by the American Board of Trial Advocates in 2001. Mr. Brosnahan also served as an assistant U.S. attorney from 1961 to 1966 and as president of the Bar Association of San Francisco. He has tried more than 150 cases in his career and has represented clients in a number of high-profile matters.

“Having a trial lawyer like Jim Brosnahan as a longtime leader in our firm sets a tremendous example. The experience of working with Jim forever shapes young lawyers, training them in the art of advocacy and a commitment to their clients and the bar,” said Steven M. Kaufmann, Chair of Morrison & Foerster’s Litigation Department.

The American Inns of Court is a mentoring organization of over 20,000 state, federal, and administrative law judges, attorneys, legal scholars, and law students. Members aim to raise standards of excellence, levels of professionalism, and awareness of ethics in the legal industry through programs and discussions on the matters at monthly meetings.

The American Inns of Court will honor Mr. Brosnahan at the United States Supreme Court during their Celebration of Excellence event, hosted by Justice Samuel A. Alito, Jr., on October 20, 2007.

Laurie Chess and Tracy Kern Help AutoZone Drive Away With Another Trial Victory
The plaintiff, a 10-year employee, was fired for having taken spark plugs out of the store without first having the customer pay for the plugs, and for receiving a $20 tip for doing so. This conduct violated the company's written policies prohibiting employees from accepting tips and from removing merchandise from the property without first being paid for. The employee claimed the company's reasons for his termination were not true, and that he was fired due to his age and in retaliation for having taken workers’ compensation leave. During this jury trial, the plaintiff testified that the money he took was not a "tip," but rather "compensation" for work he performed for the customer while he was off the clock. The plaintiff called the customer to testify that his vehicle had broken down in Jasper, Indiana, on New Year’s Eve, and that he would have been stranded but for the plaintiff’s help. The customer also testified that he was happy to provide the plaintiff with remuneration for his hard work. Plaintiff also called five former employees, including a manager, who testified they had removed parts from the store without them having been paid for, and had not been fired for this. Under cross-examination, however, all admitted that they never took money for doing so. In all, the plaintiff and his case were sympathetic, but rigorous preparation and cross examination allowed Chess and Kern to rest without putting a single witness on the stand. After deliberating for less than two hours, the jury returned a verdict in AutoZone's favor on both of the plaintiff's claims.

Pellicano Judge Denies Requests
According to the Daily Journal, U.S. District Judge Dale S. Fischer declined to dismiss the false statement charge against former Los Angeles police officer Mark Arneson, a codefendant of indicted Hollywood private eye Anthony Pellicano, on Monday. Arneson allegedly lied when he met with prosecutors in a 2003 proffer session to explore the possibility of cooperating with the government.

“Fischer then invited Christensen’s lawyer, Terree Bowers (LA), to show that record-keeping, even if it’s not a crime itself, can be done for criminal purposes if it’s part of a racketeering enterprise. Based on this legal evaluation, due by Sept. 28, Fischer said she might reconsider Christensen’s discovery request.”


“In addition to the further filings discussed in Monday’s hearing, Bowers, Artan and Arneson’s attorney, Chad S. Hummel, said they plan to file a total of 10 additional motions before the Oct. 22 deadline. Some of the motions will seek additional discovery from the government, and others attack its case, including one that Bowers described as ‘an omnibus misconduct motion.

Trial Win for Edwards Angell Palmer & Dodge Client
After 13 days of trial before the Chief Judge of the U.S. District Court in New Jersey (Hon. Garrett E. Brown), Alan Spiro (Boston) obtained a $3,350,691 judgment in favor of his client, Thompson Design Group. Thompson Design Group v. 1101-1125 Hudson Street LLC et al.. TDG is an internationally renowned urban planning firm whose principals have designed such vibrant historic waterfront redevelopments as Boston’s Faneuil Hall Marketplace, Baltimore’s Harborplace and New York’s South Street Seaport. In December 1999, TDG entered a contract with a developer to plan the redevelopment of 14 acres on the Hudson River in Hoboken, New Jersey, the site of the former Maxwell House Coffee plant, with a panoramic view of the Manhattan skyline. TDG agreed to a reduced fee for its services in exchange for a percentage of the profits from the project, because TDG was confident that its design concepts would add substantial value.

Though the developer, led by a hedge fund, acquired the site for $18,000,000, and sold its stake in two phases for an aggregate of $97,000,000, the developer claimed that TDG’s profit share under the complex profit sharing formula was $0. Ultimately, both TDG’s performance on the project and its positions on the contract issues were completely vindicated by the Court’s decision.
