Edward Cheng speaks during ABA’s National Legal Malpractice Conference
Edward Cheng, partner in the firm’s Litigation Department and co-chair of the Professional Liability practice, was invited to speak during the American Bar Association’s Fall 2007 National Legal Malpractice Conference, Focus on Critical Comunications, in Scottsdale, Arizona, on September 19-21.

Ed is scheduled to participate as a panelist during “Biting the Hand that Sues You: Anti-SLAPP Statutes and Malicious Prosecution Cases.” The session will focus on Anti-SLAPP (Strategic Lawsuits Against Public Participation) statutes, malicious prosecution and abuse of process causes of action.

Employment Law Group presents The Dos and Don’ts of Handling Employee Performance Problems and Terminating Employees
The firm held the fourth and final seminar in a series on Best Employment Practices for Employers: The Dos and Don’ts of Handling Employee Performance Problems and Terminating Employees.

Human resources personnel, in-house counsel and business managers/executives participated in a breakfast seminar and webinar. Jane Barry, Vice President of Human Resources for the Boston Children’s Museum offered her perspective as a guest speaker for this event.

Attorney Alan Rutkin Launches Insurance Coverage Law Blog
Alan Rutkin, of Great Neck, a partner in Rivkin Radler's Insurance & Coverage Litigation Practice Group has officially launched a weblog focusing on cutting edge insurance issues from current events in the law. The "blog," www.insurancecoveragelawyerblog.com, offers Rutkin's insights on the issues, cases, and trends the insurance coverage industry grapples with daily.

As an experienced coverage lawyer, Alan Rutkin has authored a column for Best's Review for more than a decade before deciding that the topics addressed in his column could be discussed on a more frequent, timely, and interactive basis through the web. The result is a forum where those who serve this complex industry can learn as well as share their own thoughts. Topically, Rutkin covers a lot of territory, including: absolute pollution exclusions, catastrophes, intentional acts, known loss, late notice, litigation, number of occurrences, occurrence, and tripartite relationships. The site is an excellent resource for those seeking knowledgeable insights about this complex area of law.

Alan Rutkin represents domestic and foreign insurers in the analysis, negotiation, and litigation of complex claims. Many of the claims involve delayed manifestation ("long tail") injuries such as polluted properties, toxic torts, and asbestos. He has counseled insurers on new and unique issues for more than twenty years, and has special expertise in insurance coverage disputes involving environmental matters and other complex claims. A frequent speaker on litigation and insurance topics, he has also written extensively on insurance coverage litigation. Rutkin's defense litigation column for Best's Review has received the Editorial Excellence Award from the American Society of Business Press Editors.

Alan Rutkin serves on Rivkin Radler's Executive Committee, the firm's governing body. He currently heads the firm's pro bono program, which assists the indigent in coordination with Nassau/Suffolk Law Services. He is part of the leadership of the American Bar Association's Tort, Trial & Insurance Practice section, and the New York State Bar Association.

Rivkin Radler's David A. Manko and David S. Wilck Recipients of FREE's Humanitarian of the Year Award
David A. Manko, of Commack and David S. Wilck, of Dix Hills, Partners at Rivkin Radler will receive the Humanitarian of the Year Award from Family Residences and Essential Enterprises, Inc. (FREE) on October 19, at the Crest Hollow Country Club.

David Manko is a member of the Firm's Health Services and Corporate & Commercial Practice Groups. He represents healthcare providers in connection with their business, regulatory and managed care matters. Mr. Manko regularly volunteers his time and uses his expertise in the healthcare industry to assist non-for-profit healthcare providers and their patients with a variety of private and public healthcare-related issues. His community and philanthropic activities are well recognized as he has assumed leadership roles in a variety of fund-raising activities supporting causes ranging from children's health issues to mental health issues affecting the homeless.

David Wilck is a member of the Firm's Professional Liability and Insurance & Coverage Litigation Practice Groups. He represents lawyers, accountants, insurance agents and other professionals in malpractice claims. In addition, he represents numerous insurance companies in coverage-related matters, including professional liability and employment practices liability. He has helped raise thousands of dollars to assist Long Island area adults with disabilities as a member of FREE's Sports and Entertainment Committee.

Matheson Ormsby Prentice advises Arnotts on EUR65 million investment by Brunner Limited
Matheson Ormsby Prentice has advised Arnotts on a €65 million investment by Brunner Limited in Art Holdings Limited, the new holding company for the Arnotts group. Corporate Finance partner Robert Heron advised Arnotts and its Chairman, Richard Nesbitt. Anglo Irish Bank Private Equity, which is a co-investor with Boundary in Brunner, was advised by corporate partner Liam Flynn of Matheson Ormsby Prentice.

Matheson Ormsby Prentice, which has advised Arnotts since the Nesbitt-led take private in 2003, is also advising the company on its flagship Northern Quarter development in Dublin, and has recently advised on the buyout of the O'Connor family minority interest. Arnotts operates the largest department store on the island of Ireland.

Fortune 500 General Counsel Joins Jackson Lewis LLP
Jackson Lewis LLP, one of the country's leading workplace law firms, announced today that Mark Askanas has joined the firm's San Francisco office as partner.

Mr. Askanas served since January 2001 as General Counsel for Ross Stores, Inc., a Fortune 500 company with 30,000 associates in 25 states. He was Ross Stores' first General Counsel, responsible for Sarbanes- Oxley compliance, corporate governance, securities filings, transactional matters, and preventive nationwide litigation and class action avoidance strategies. From 2001 through 2005, Mr. Askanas was also Ross' Senior Vice President of Human Resources where he was responsible for executive compensation, benefits, turnover and retention issues, recruiting, organizational development and training.

"Mark's experience as the General Counsel of a Fortune 500 company is an invaluable asset," says Rob Pattison, managing partner of Jackson Lewis's San Francisco office. "In addition to his litigation experience, Mark brings to our clients a deep understanding of the financial impact of complex labor and employment issues, allowing for the most creative and practical approaches to them."

The announcement represents a coming home of sorts for Mr. Askanas, for prior to joining Ross Stores, he was a successful employment litigation partner with Jackson Lewis, having served as lead counsel for cases in state and federal courts throughout the western United States. He was at Jackson Lewis from 1988 to the end of 2000 in the Firm's San Francisco office. He first became a Partner in 1993.

"Working on the corporate side has given me a familiarity with issues I wouldn't have come across as an outside counsel," says Mr. Askanas. "As General Counsel, I gained extensive, first-hand experience in litigation avoidance and preventive solutions. I've also worked closely with our Boards of Directors, Audit Committee and Finance Department managing risk and advising on legal developments and issues. My first and greatest passion has always been employment law; as such, I am thrilled to be back with Jackson Lewis, and working with the Firm's many diverse clients."

Mr. Askanas received his juris doctorate from the University of California, Davis School of Law (1985) where he was Senior Research Editor of the U.C. Davis Law Review. He received his B.A. degree from the University of California, Berkeley (1982).
