Dennis Greenstein Quoted in Habitat
The September 2007 issue of Habitat Magazine asked leading NYC-based real estate attorneys: "What is the most effective enforcement of a house rule or building policy that you have seen among the boards you counsel?" Dennis wrote: "The first step to enforce house rules and policies is to be certain that they are clear, reasonable, and practical. The second and equally important step is to interact with the residents in a manner that is fair, uniform, and responsive. " In noting through an example of a neighbor breaching the rules on a communal rooftop deck by hosting noisy parties and playing loud music, a resident meeting was held in the space to discuss overall complaints and many felt it was the first time issues could be aired and discussed from which suggestions were made and enforcement protocols put in place. Dennis noted, "A sense of respect and confidence that breaches would be dealt with was created. It helped to promote an environment that balances the need to enforce rules and policies with the concerns and rights of its residents."

New Real Estate partner takes the reigns in Birmingham
DLA Piper UK LLP is delighted to announce that Martin Hallam has agreed to become location head for the real estate team in Birmingham. Martin is currently the firm's National Head of Regeneration and a senior real estate partner in the Manchester office.

Martin has been with the firm for 17 years, originally joining what was then Dibb Lupton Broomhead in Manchester to set up a greenfield real estate practice. Martin has a wealth of real estate expertise, particularly on the development, regeneration and investment side. He is very client focused and is relishing the opportunity to help to further develop the Birmingham real estate practice.

Chris Rawstron, the office managing partner for Birmingham commented: "Martin has the support of the Birmingham real estate partners and the broader Real Estate Group who are committed to making the team pre-eminent in the region."

Martin Hallam commented: "This is a great opportunity. We have the basis for a great team in Birmingham and I look forward to building the team into the pre-eminent practice that the office can provide. I have a number of clients in the Midlands and this will bring me closer to them and give me the opportunity of getting to know the Midlands market."

DLA Piper Receives Law Firm Partner of the Year Award from Marovitz Lend-A-Hand Program
DLA Piper announced today that the firm has received the Law Firm Partner of the Year Award from the Chicago Bar Association’s (CBA) Abraham Lincoln Marovitz Lend-a-Hand Program. The firm was honored for its multi-faceted contributions in the area of tutoring and mentoring, exemplified by the work of Portia Owen Morrision, Senior Counsel in the firm’s Real Estate practice, and Ken Schmetterer, a partner in the firm’s Litigation practice.

The CBA cited Morrison for her profound commitment to the Girl Scouts of Chicago and Schmetterer for his pro bono service to the UMOJA Student Development Corporation.

Morrison has served Girl Scouts of Chicago in many capacities, including serving on its board for 12 years, four of them as its president. She now serves on the council realignment committee that is working for the merger of seven Girl Scout Councils in northern Illinois and Indiana. For three years, she served as board event chair for Girl Scouts of Chicago’s major fundraiser – the annual Tribute to Achievement Dinner. In 2006, Morrison received the Girl Scouts’ Own Award, recognizing extraordinary service to Girl Scouts of Chicago. She is also the recipient of the Thanks Badge I and Thanks Badge II, the highest awards for adult volunteers in Girl Scouting.

UMOJA is a nonprofit corporation based in Chicago’s Manley Career Academy High School that links the educational efforts of three Chicago schools with the broader community and serves as an advocate for young people. It now provides educational, professional, social, and life skills to about 3,000 students a year. As pro bono general counsel and member of its board of directors, Schmetterer assisted UMOJA with a wide variety of legal matters and non-legal volunteer efforts.

“We are grateful that the Chicago Bar Association has acknowledged the firm for supporting Portia and Ken in their selfless pro bono endeavors on behalf of children in Chicago,” said Anne Geraghty, pro bono manager for DLA Piper’s Chicago office. ”Portia and Ken are both extremely committed to organizations that mentor and tutor young people, helping them succeed in school and reach their full potential.”

The Abraham Marovitz Lend-A-Hand Program was created by the Chicago Bar Foundation (CBF) and CBA in memory of the judge who was one of the most recognized and well-loved public figures in Illinois. The program strives to help young people from underprivileged Chicago communities succeed in school by providing grants, attorney mentors/volunteers, and other resources to outstanding tutor/mentor agencies who provide one-on-one mentoring opportunities to young people.

“DLA Piper’s culture and policies encourage pro bono service, volunteerism and charitable giving,” said Lou Cohen, managing partner of DLA Piper’s Chicago office. “We are pleased to be recognized for our commitment to pro bono and we look forward to the continued growth and commitment of our pro bono platform here in Chicago.”

DLA Piper attorney Sonya Naar, a partner in the Chicago office, received the Making-A-Difference Award from the Lend-A-Hand Program in 2005 for creating and leading a program that partnered DLA Piper with Barry Elementary School. Justice Seymour Simon won the Judge Marovitz Mentoring Award last year for his lifelong commitment to mentoring, community service and the pursuit of justice.

Morrison & Foerster Earns 100-Percent Score on Human Rights Campaign’s Corporate Equality Index
Demonstrating that it continues to be an enlightened work environment for the gay, lesbian, bisexual, and transgender community, law firm Morrison & Foerster LLP has again achieved a perfect 100-percent score on the Human Rights Campaign’s Corporate Equality Index for 2007, earning the distinction of being one of the “Best Places to Work for GLBT Equality.”

Since 2003 the firm has received a perfect score every year, one of the few law firms to do so. This year 29 other law firms were rated at 100 percent (the trend is sharply upward – last year there were just 12). The average score among law firms surveyed was 88. With the realization that one of the best ways to attract high-quality employees is to offer a diverse and inclusive workplace, Morrison & Foerster is proud to set such a consistent example of equality and integrity in our industry.

The Human Rights Campaign (HRC) created its Corporate Equality Index to measure how completely company policies, including benefits, are made and applied without regard to the sexual preference, orientation, or expression of employees or customers. This year the HRC surveyed a total of 519 businesses in 29 industry sectors; law firms were drawn from the AmLaw 200. A total of 195 companies achieved perfect scores of 100, the HRC reports, up nearly 15-fold in the last five years.

Manatt's Lisa Specht Appointed To Board Of Music Center
Manatt, Phelps & Phillips, LLP, the national law and consulting firm, announced today that Lisa Specht was appointed to the Board of Directors of the Music Center. Ms. Specht, a partner in the firm's Government & Public Policy Division, will be cochairing the Operations Committee and will serve on the Music Center Executive Committee.

No legal privilege for in-house lawyers
According to the Frankfurt Allgemeine, the European Court of First Instance’s decisions in Akzo v European Commission confirmed the existing jurisdiction that the so called legal privilege only applies to correspondence between company and external lawyers but it cannot be claimed by in-house counsel.

Howrey partner Martina Maier (BR) was quoted in the article as saying: “Companies have to think carefully about how to allocate tasks between internal legal departments and external legal advice in the future. Especially US companies will have severe problems with this situation as they are used to the fact that the correspondence with internal counsel is confidential.”

Ms. Maier thinks that the Luxembourg decision does not make sense as company lawyers cannot express their concerns about a business practice that interferes with antitrust laws without having to fear that they deliver usable evidence to the investigating authorities. Without a risk this can only happen if one refers to protected correspondence with external counsel.
