Real Estate partner Vincent Monte-Sano’s work on behalf of Trinity Real Estate was noted in the January 11, 2006 “Real Estate Update” section of the New York Law Journal. Mr. Monte-Sano represented Trinity in a lease of premises at 225 Varick Street to the Legal Action Center’s New York City headquarters. The lease has a term of ten years, and renovations are scheduled to be completed next month.

Cleveland, OH - The law firm of Buckingham, Doolittle & Burroughs, LLP, is pleased to announce that Sara N. Stenger has joined the law firm’s Real Estate & Construction practice group as an Associate resident in the Cleveland office.
Prior to joining the law firm, Ms. Stenger served as a judicial intern for Judge Linda Tucci Teodosio at the Summit County Juvenile Court. She reviewed and answered objections to Magistrate’s Decisions, researched topics such as legal emancipation and birth certificate name changes, observed trials, and aided judicial attorneys in rewriting juvenile local rules. She also was a law clerk/legal secretary at Charles J. Palmeri Co., L.P.A. She assisted in the preparation of motions for summary judgment and default judgment, researched bankruptcy and foreclosure cases, and bid at Sheriffs’ sales in Summit and Cuyahoga County for National City Bank.
Ms. Stenger earned her J.D., cum laude, The University of Akron School of Law in 2005. She was an Articles Editor for the Akron Law Review. Ms. Stenger was also a member of Phi Alpha Delta, the Student Bar Association, and a McDowell Scholar. In addition, she received her B.S., cum laude, from John Carroll University. She is a volunteer for the American Cancer Society, Young Professionals.
Ms. Stenger resides in Cleveland, Ohio.

Bryan Cave Attorneys Offer Strategic Advice for Voluntary Cleanups In Wake of Supreme Court Ruling
In December of 2004, the U.S. Supreme Court issued an opinion that restricts the right of companies that voluntarily clean up polluted sites to get former owners of those sites to share the cost. For the January issue of Environmental Law in New York, New York Partner Philip Karmel and Associate Laurence Horvath authored an article about how the ruling in Cooper Industries, Inc. v. Aviall Services, Inc. and its progeny in the lower courts affect those who seek to develop contaminated properties.
“It seems likely that the U.S. Supreme Court will revisit the availability of contribution suits under the Superfund law in the near future to resolve the conflicts that have arisen among the lower courts,” they wrote. The article provides strategic advice for those brownfield developers and other clients who seek to purchase or voluntarily cleanup a contaminated site but cannot place their business affairs on hold while the courts sort out the questions left unanswered by the Supreme Court decision.

Brown Rudnick will present a community-wide conversation with South African
Constitutional Court Justice Albie Sachs, the human rights activist world-recognized for
his role in creating South Africa’s new constitution. Justice Sachs and his life partner, Vanessa
September, will discuss South Africa’s emerging democracy following the fall of apartheid and
will share their personal stories on the transformation of that region. The event will take place
from 7:30 – 9:00 a.m. at the offices of Brown Rudnick Berlack Israels LLP, One Financial
Center, Boston, MA 02111. The event is free and open to the public, but seating is limited.

Appointed by President Nelson Mandela in 1994, Justice Sachs is a member of the South
African Constitutional Court. His life partner, Vanessa September, is an architect working on
urban rebuilding. Justice Sachs has played an active role in the creation of South Africa’s
new constitution, and is the author of several books on human rights including The Soft
Vengeance of a Freedom Fighter. In his most recent book, The Free Diary of Albie Sachs,
Justice Sachs and Ms. September describe how South Africa is being healed and rebuilt.

Peter Kirsanow to Testify in Samuel Alito Supreme Court Hearing
CLEVELAND, OHIO - January 11, 2006 – Benesch, Friedlander, Coplan & Aronoff LLP attorney Peter N. Kirsanow will be testifying in Supreme Court nominee Samuel Alito's hearing in Washington D.C. later this week. President Bush nominated Alito to the position of Associate Justice, to replace retiring Justice Sandra Day O'Connor. The focus of Mr. Kirsanow's testimony will be Samuel Alito's record on issues related to civil rights.
Mr. Kirsanow was recently appointed by President Bush to the National Labor Relations Board. He is a partner with Benesch's Labor and Employment Practice Group.

B&W Wins Summary Judgment of Patent Infringement
Chicago, IL -- Banner & Witcoff is pleased to announce that it prevailed today on a motion for summary judgment of patent infringement in SunTiger, Inc. v. Sunglass Products of California d/b/a Zoom Eyeworks, Inc and Fisherman Eyewear.
Sunglass Products sells sunglasses under the name "Fisherman Eyewear." See http://www.fishermaneyewear.com. One of the lenses in the Fisherman Eyewear line of sunglasses is a type of lens that Sunglass Products calls "Low Light Amber." Sunglass Products markets this Low Light Amber lens to fisherman and states that the lens is "excellent for low light conditions such as first and last light or heavily overcast days."
SunTiger has multiple patents, including U.S. Pat. Nos. 5,177,509 and 5,400,175, that cover the technology used in Sunglass Product's Low Light Amber lenses. This technology originated from the Jet Propulsion Laboratory (“JPL”), which is managed for the National Aeronautics and Space Administration (“NASA”) by the California Institute of Technology. JPL is the lead U.S. center for robotic exploration of the solar system. The patented technology protects human eyesight by blocking dangerous blue, violet, and ultraviolet light and allowing substantial transmission of wavelengths of light that are useful for visual acuity.
On January 11, 2006, the Court, a federal court in Los Angeles, granted summary judgment of infringement and held that the Fisherman Eyewear "Low Light Amber" lenses literally infringed SunTiger's '509 and '175 Patents. A jury trial is scheduled for June 2006 in order to determine the extent of SunTiger's damages and to establish whether Sunglass Products' infringement was willful.
In view of the fact that Sunglass Products made an unusual move of waiving traditional defenses of invalidity and unenforceability, this ruling by the Court establishes Sunglass Products' liability. Consequently, SunTiger expects that a permanent injunction will issue shortly.

Banner & Witcoff's representation of SunTiger in enforcement of these patents dates to 1997, when Banner & Witcoff lawyers obtained a multimillion dollar jury verdict and finding of willfulness that was affirmed by the U.S. Court of Appeals for the Federal Circuit.
