Bryan Elwood, Counsel in the Washington, D.C. Office, has been named U.S. Chair of the Foreign Investment Committee of the U.S.-Mexico Bar Association (USMBA).
The USMBA is a unique, bi-national Bar Association made up of attorneys from both Mexico and the United States. The USMBA’s goals are to promote an understanding of the cultural and legal differences between both nations and to foster international cooperation through the effective practice of law and the development of the legal profession.
The USMBA serves the international law practitioner by providing current legal news and information, CLE programs and a place to meet and exchange views and writings with other members of the profession that work with both the United States and Mexico. The Association is divided into Committees that provide forums for discussion of important cross-border legal topics such as commerce, investment and immigration.
As U.S. Chair of the Foreign Investment Committee of the USMBA, Bryan Elwood, together with his Mexican counterpart, will be active in developing the Committee’s sources of information on matters affecting cross-border investments, as well as organizing seminars and overseeing working groups that address pertinent issues such as the investor-state dispute processes; BIT and FTA regulation; responsibility of transnational corporations; discrimination against investors; minimum treatment, international competitiveness and other interesting topics affecting investors, their investments and the legal practices that relate to them.

Butzel Long attorneys elected shareholders DETROIT, Mich. – The law firm of Butzel Long has elected the following attorneys as shareholders: William J. Clemens, Kevin M. DiDio, Cynthia J. Haffey, Carol A. Romej, Christopher M. Taylor and Maureen T. Taylor.
Previously, Mr. Clemens and Ms. Romej were senior attorneys. Mr. DiDio, Ms. Haffey, Mr. Taylor and Ms. Taylor were associate attorneys.
William J. Clemens practices in the firm’s Bloomfield Hills office. He has practiced intellectual property law for more than 30 years. He has extensive experience in U.S. and foreign patent, trademark and copyright matters; intellectual property licensing; contracts for developing, purchasing and licensing computer hardware and software; and electronic data interchange.
Mr. Clemens is a member of the Intellectual Property Law Section of the State Bar of Michigan and the Toledo Bar Association, and is past President of the Toledo Patent Law Association (1980-81). He is a graduate of the University of Toledo with a B.S. in Electrical Engineering in 1965, an M.S. in Industrial Engineering in 1969 and a J.D. in 1973. He is a resident of Commerce Township.
Kevin M. DiDio practices in Butzel Long’s Detroit office. He is a member of the firm’s Transaction, Finance and Taxation Practice Group. His primary areas of practice include: corporations, limited partnerships, and limited liability companies (LLC’s); mergers, acquisitions, joint ventures, and re-organizational transactions; corporate finance; international licensing and product distribution transactions; and tax and succession planning issues for closely held businesses. Mr. DiDio is a member of the Business Law Sections of the American Bar Association (ABA) and the State Bar of Michigan. He is a member of the ABA’s Committee on Partnerships and Unincorporated Business Organizations. He currently serves as Chairman of the Detroit Metropolitan Bar Association’s Corporate Counsel Section.
Mr. DiDio is a graduate of The University of Michigan (B.A., Economics, 1993) and Michigan State University – Detroit College of Law (J.D., Tax Concentration Program, 1997). Mr. DiDio was awarded the Jurisprudence Achievement Award for Business, Securities and Tax Planning while in law school. He is a resident of Grosse Pointe Park.
Cynthia J. Haffey practices in Butzel Long’s Detroit office. Her primary areas of practice are commercial and employment litigation. She has experience in numerous commercial matters, including disputes concerning the sale of a business, shareholder, partner and owner disputes, sales commission disputes, fraud, tortious interference and other business torts, and automotive (Tier 1 and Tier 2) contractual disputes. In addition, Ms. Haffey has significant experience defending corporate employers against age, sex, racial discrimination claims and other wrongful discharge claims.
Prior to practicing law, Ms. Haffey’s career was concentrated in the retail industry both in management and human resources. She is a member of the Federal Bar Association, Eastern District of Michigan, American Bar Association, the State Bar of Michigan and the Oakland County Bar Association.
Ms. Haffey is a graduate of Western Michigan University (B.S., magna cum laude, 1980) and Wayne Statue University Law School (J.D., cum laude, 1997). She is a resident of Novi.
Carol A. Romej is a shareholder based in Butzel Long’s Bloomfield Hills office. She is Chair of the firm’s E-Discovery Practice and co-chair of Butzel Long’s Technology and E-Commerce Practice Group.
Ms. Romej has extensive experience in preparing technology licensing agreements, outsourcing agreements, and web and online agreements and policies; developing and implementing strategies for electronic and forensic discovery for internal corporate audits, investigations, and litigation; managing and selecting tools and vendors for electronic data acquisition; counseling and litigation on protecting Intellectual Property and Internet security issues; electronic record retention and litigation suspension procedures; and other issues regarding doing global business on the Internet.
Ms. Romej is on the adjunct faculty for the Walsh College Information Assurance Center. Walsh College is designated as a Center of Academic Excellence in Information Assurance Education by the National Security Agency. She also is on the adjunct faculty of Washtenaw Community College, Center for Information Assurance and Systems Security, 2006. Her professional memberships include the State Bar of Michigan, the American Bar Association, the Ann Arbor IT Zone, Automation Alley, and the New Enterprise Forum.
Ms. Romej is a graduate of the University of Michigan (B.A., Economics, 1982), Eastern Michigan University (B.B.A., Accounting, 1988), the Detroit College of Law (J.D., 1993) and Wayne State University Law School (LL.M., Corporate and Finance Law, 2001). She is a resident of Ann Arbor.
Christopher M. Taylor is based in Butzel Long's Ann Arbor office. He practices in the areas of media law, intellectual property, technology and e-commerce. He is a member of Butzel Long’s Higher Education Law Practice.
His experience includes drafting and negotiating license and service agreements, software/intellectual property transfer agreements, and merger and stock purchase agreements for business and public clients; developing information technology and intellectual property management and compliance policies for university clients; and prosecution of trademark registration applications and management of trademark portfolios.
Mr. Taylor is a graduate of the University of Michigan with a B.A. in English with high distinction, 1990; a B.M.A. in Vocal Performance with honors, 1990; an M.A. in American History, 1994; and the University of Michigan School of Law (J.D., cum laude, 1997) where he was Editor-in-Chief of the Michigan Law Review, and received the Scholarly Writing Award in May 1997 and the Abram W. Sempliner Memorial Award in 1996. He served as a judicial clerk for Judge Bruce M. Selya on the United States Court of Appeals for the First Circuit. He is a resident of Ann Arbor.
Maureen T. Taylor practices in Butzel Long's Detroit office. Her primary areas of practice are business litigation and product liability defense. She has experience in defending catastrophic product liability and tort litigation involving a wide array of automotive component parts, power tools and pharmaceuticals.
Before joining Butzel Long, Ms. Taylor was an associate at Jones, Day, Reavis & Pogue’s Pittsburgh office, where her practice had a national scope focusing on defending product manufacturers in complex mass tort litigation and defending corporate employers against age, sex, and racial discrimination claims as well as claims of wrongful discharge and defamation.
Ms. Taylor is a member of the Defense Research Institute (DRI), the Michigan Defense Trial Counsel (MDTC), the American Bar Association and the State Bar of Michigan.
She is a graduate of the University of Michigan (B.A., 1992) and the University of Pittsburgh School of Law (J.D., magna cum laude, Order of the Coif, 1997) where she was managing editor of the University of Pittsburgh Law Review and a legal writing teaching assistant. She is a resident of Northville.

We mourn the loss of Attorney and Partner, Mark J. Levinson (1/11/06)
We deeply mourn the loss of our partner and friend Mark J. Levinson. He was a fine attorney, and most generous and kind friend, mentor, husband, father and grandfather.
Mark will be remembered with great fondness. We are all privileged to have known him.

Christopher M. Ernst Joins Buckingham, Doolittle & Burroughs, LLP
Cleveland, OH - Buckingham, Doolittle & Burroughs, LLP today announced the addition of Christopher M. Ernst as a Partner, resident in the Cleveland office. The addition of Mr. Ernst increases the Cleveland office to 30 attorneys, and strengthens its Litigation and Real Estate & Construction practice.
Prior to joining the law firm, Mr. Ernst was a Partner with Weston Hurd Fallon Paisley & Howley, LLP where he represented a variety of businesses in general commercial litigation, construction, e-commerce, contract, torts, employment and creditors’ rights matters. Mr. Ernst also served as a United States Litigation Manager for an international manufacturing company, overseeing and directing litigation across the country.

Brinks Hofer Gilson & Lione Wins Landmark Ruling for Respondents in ITC Section 337 Enforcement Proceeding
CHICAGO – Brinks Hofer Gilson & Lione, one of the largest intellectual property law firms in the United States, today announced a victory on behalf of its clients, ZF Friedrichshafen AG and ArvinMeritor, Inc., distributors of the FreedomLine™ heavy duty truck transmission systems. The companies were respondents in a Section 337 patent infringement matter before the International Trade Commission (ITC) in Washington, D.C. The complainant had sought penalties in excess of $40 million, all of which were denied.
“It appears that this is the first time in the 75-year history of the ITC’s Section 337 investigations that an Administrative Law Judge has ruled for a respondent in an enforcement proceeding,” said Gary M. Ropski, President of Brinks Hofer Gilson & Lione. “We are very pleased that Judge Paul Luckern has ruled in favor of our clients. His decision affirms our clients’ belief that their redesigned system does not infringe Eaton’s patents.”
In December 2003, the Eaton Corporation, a manufacturer of automotive and truck products, asserted that the FreedomLine transmission infringed six different Eaton patents. After a 10-day hearing in September 2004, Judge Luckern ruled in favor of ZF and ArvinMeritor on all but one of the 76 asserted claims. The ITC agreed. In response, ZF engineers redesigned the FreedomLine system in compliance with the ITC decision and ZF continued to import the redesigned transmissions.
The judge’s latest ruling holds that the redesigned FreedomLine system does not infringe the last of Eaton’s 76 patent claims, which means that Eaton has failed to stop the importation and sale of FreedomLine transmissions. The Brinks trial team included Gary Ropski, Laura Beth Miller, Thomas Filarski, Charles McMahon, Ray Ricordati and Timothy LeDuc with assistance from co-counsel, Lyle Vander Schaaf and Cory Norton of Bryan Cave LLP in Washington D.C.

San Antonio Business Leader, Former Councilman Honored with Library Dedication
SAN ANTONIO) Jan. 10, 2006— North East Independent School District (NEISD) Superintendent Dr. Richard Middleton announced that the public library located at Ronald Reagan High School will be named in honor of Tim Bannwolf, a partner at Bracewell & Giuliani LLP and former San Antonio District 9 City Councilman. The dedication ceremony for the Timothy Herman Bannwolf Library will take place on Sunday, Jan. 15, at 2 p.m. at Ronald Reagan High School, 19000 Ronald Reagan Drive.

Bannwolf, a longtime community and civic leader, served on city council from 1997 to 2001 and spearheaded the joint venture between the San Antonio Public Library and NEISD. A fiscal conservative, Bannwolf’s efforts in establishing the state’s first-ever joint library between a large metropolitan city and local school district saved taxpayers an estimated $3.5 million, the cost of building a separate stand-alone library. In addition, the city branch library, the first to be named after a San Antonio city councilmember, continues to save taxpayers significant money in annual operating costs.

Before serving on the city council, Bannwolf chaired the citizens’ committee that proposed the $147.4 million bond election in 1995 that provided construction funds for the new high school, as well as a number of other schools. Due to his continued efforts over the years to facilitate the improvement of NEISD and the public library system, the board of trustees unanimously voted to name the library in his honor.

“It is impossible to convey the depth to which Tim immersed himself in this endeavor to see it to fruition. He served on the task force that recommended the bond election, worked to get the bond election passed, and then to ensure those funds were put to the best possible use, he ran for city council to direct the spending,” said NEISD Superintendent Dr. Richard Middleton. “Tim conceived and then proposed the idea of the joint venture between the public library and school district. It is not an understatement to say that without Tim Bannwolf, this library would not be here to serve both the students of Reagan High School and the city of San Antonio as a whole. The program has been so successful, and such a model of efficiency, that plans are currently under way to replicate this joint venture model on other campuses within NEISD.”

The library opened in 1999 and served more than 40,000 patrons that year. As of 2005, annual public patron visits to the library have doubled, to more than 90,000. An additional 3,500 high school students are also served by the library each year.

Opened with 5,000 volumes, it has since grown in size to 30,000, and in the last three years Internet usage has doubled. Additionally, under Bannwolf’s leadership, $25 million of the 1995 bond package was specifically set aside for technical equipment and upgrades at various NEISD schools, allowing for the joint venture library to have a state of the art computer lab not available at other city branch libraries.

“The partnership at Reagan High School is an excellent example of what can be achieved when governmental entities collaborate. In a time of budget and program cuts, Tim Bannwolf proposed a solution that saved taxpayer dollars and made library services available to an area that had previously lacked these resources,” said Ramiro S. Salazar, San Antonio Public Library director. “This partnership serves as a model on how two government entities can work together to effect better service to the community.”

The joint venture process required approval from NEISD, the San Antonio City Council and the San Antonio Public Library.

“It is a tremendous honor to be recognized this way, and I am humbled by it,” said Bannwolf. “It is gratifying to me that so many people now have access to the premier educational resource that has resulted from this unique partnership.”

As a partner at Bracewell & Giuliani, Bannwolf’s practice focuses on the financial services industry, as well as various sports and entertainment law matters and labor and employment-related issues.

“As one of the most respected members of the San Antonio community, Tim has long been recognized for his business contributions,” said J. Tullos Wells, who is managing partner of the San Antonio office of Bracewell & Giuliani. “It is so appropriate that he now be honored for his true passions: education and literacy of the children of San Antonio. In the community, Bannwolf played a key role in launching the San Antonio Technology Accelerator Initiative (SATAI), which recently became part of the Governor’s Regional Technology Authority.
