Dickstein Shapiro Obtains Favorable Insurance Coverage Ruling in Environmental Liability Matter
(Washington , DC ) – On January 6, 2006 , Dickstein Shapiro Morin & Oshinsky LLP obtained a favorable ruling for insurance policyholders from the highest court in Maryland in Clendenin Brothers, Inc. v. United States Fire Insurance Co. The Maryland Court of Appeals ruled that a total pollution exclusion in U.S. Fire Insurance Company’s commercial general liability policy does not relieve the insurance company of its duties to defend and insure Clendenin Brothers, Inc. against welding liability claims. Dickstein Shapiro served as counsel for both the Gases and Welding Distributors Association (GAWDA), the umbrella membership association for welding rod distributors and manufacturers, and Clendenin Brothers, Inc., a GAWDA member.
“The economic impact of this decision on the welding industry cannot be overstated,” said Rick Doyle, Executive Director of GAWDA. “Many of our members are mired in disputes with insurers over coverage for welding claims. The Maryland court recognized that insurance companies have an obligation to pay the costs to defend and resolve these claims.”
The court limited the scope of the pollution exclusion to traditional environmental pollution, which does not encompass welding rod liability. Based on the historical development of pollution exclusions in insurance policies, the court recognized that “the insurance industry intended the pollution exclusion to apply only to environmental pollution” and that the terms in the exclusion – such as dispersal, release, contaminant, and pollutant – “are terms of art in environmental law.” The court’s ruling reaches beyond the insurer’s obligation to defend its policyholder to encompass its obligation to indemnify Clendenin Brothers.
“This case is critical to any company facing insurer arguments that pollution exclusions in commercial general liability insurance policies preclude insurance coverage for non-traditional environmental liability,” said Katherine J. Henry of Dickstein Shapiro. “The broad and definitive ruling rejects insurers’ unwarranted claims that pollution exclusions should be read broadly to eviscerate insurance coverage for normal industry activity.”

Nicholas G. de la Torre focuses on all aspects of trademark and copyright litigation, prosecution and transactional work. He has experience with trademark, trade dress, copyright, unfair competition and false advertising litigation, experience representing clients in proceedings before the Trademark Trial and Appeal Board and experience in all aspects of U.S. and International trademark prosecution. He received his B.A. in Sociology from The Pennsylvania State University in 1996 and his J.D. from Boston University School of Law in 1999. Mr. de la Torre was a Summer Associate in 1998 and then joined Brinks in 1999, after finishing law school.
Margaret A. Dobrowitsky focuses her practice on drafting and negotiating domestic and international technology transfer agreements, joint venture agreements, asset purchase and supply agreements, engineering and software development agreements, information technology and telecommunications agreements, software license agreements, patent and know-how licenses, performing patent prosecution in the electrical and mechanical arts before the U.S. Patent and Trademark Office. She is experienced in both the automotive and medical device industries. Sanders N. Hillis focuses his practice in the preparation and prosecution of patent and trademark matters in such technologically-diverse areas as computer software, wireless and wireline telephony, wireless communication technologies, business methods, speech coding, semiconductor operation and manufacture, power system monitoring and management, digital communication technologies, automotive systems, radio frequency applications and audio amplifiers. Mr. Hillis has considerable experience with the Patent Cooperation Treaty, foreign country prosecution of patent applications and appeals to the U.S. Board of Patent Appeals. He received his B.S. in Electrical Engineering, cum laude, from Ohio University in 1987 and his J.D., magna cum laude, from Indiana University School of Law in 1999. Charles M. McMahon counsels clients and litigates on their behalf in the areas of patent, trademark, copyright and unfair competition law. He has represented domestic and international clients in federal courts and before the U.S. Patent and Trademark Office, the International Trade Commission, and the United States Court of Appeals for the Federal Circuit. Mr. McMahon’s work has involved a variety of technical areas, including truck transmission systems, wireless communications, solid-state electronics, encryption systems, digital imaging systems, electronic measurement devices, software applications and online business-to-business exchange systems. He received his B.S. in Electrical Engineering from the University of Notre Dame in 1996 and his J.D. from The George Washington University Law School in 1999. Amir N. Scott J. Slavick focuses his practice on trademark prosecution and litigation and Internet, trade secret, copyright and trade dress law. He maintains large corporate clients’ trademark portfolios and his experience includes drafting trademark licensing agreements, office action responses, trademark applications, trademark opinion letters, briefs, motions, settlement agreements, consent agreements, copyright applications, confidentiality agreements and restrictive covenants. He received his B.A., in History from Northwestern University in 1995 and his J.D. from Georgetown University Law Center in 1998. Mr. Slavick joined Brinks as an associate in 1998.

Glen P. Belvis focuses his practice on all facets of intellectual property law, including patents, trademarks, copyrights, trade secrets and related antitrust matters. He has substantial patent litigation experience, including bench and jury trials, appeals before the Federal Circuit, and alternate dispute resolutions, and has participated in several multinational litigations involving related patent lawsuits in the U.K., Europe, Asia, Canada and the United States. He has testified as an expert witness on patent and trade secret matters and lectured on patent and antitrust matters at Oxford University and has experience in patent prosecution, interferences, and proceedings before the PTO board of appeals. Mr. Belvis' experience encompasses a wide range of technologies including medical devices, bio-tech, software, Internet, lasers, paper, polymers, heavy equipment and pharmaceuticals. He received his B.S. in Chemistry from University of Notre Dame and his J.D. from DePaul University College of Law.
Jeffery M. Duncan focuses his practice on counseling and preparing opinions in patent, trade secret and licensing matters; evaluating, negotiating and drafting technology transfer and joint venture agreements; performing intellectual property evaluations, audits and due diligence reviews; litigating patent and trade secrets cases; and preparing and prosecuting patent applications in the U.S. and abroad. His practice is concentrated on the following technologies: pharmaceuticals, biotechnology, diagnostics and chemistry. Ralph J. Gabric focuses his practice in patent, trade secrets, copyright, trademark and unfair competition litigation, counseling and prosecution. Gary M. Ropski has practiced intellectual property law exclusively since joining Brinks Hofer in 1976. His practice now focuses on litigation, but has included patent prosecution and litigation, trademark prosecution, including oppositions, and litigation, trade dress litigation, copyright registration and litigation, trade secret litigation, right of publicity counseling and litigation and related unfair competition and antitrust matters in federal and state courts. He has extensive experience in presenting and rebutting damage claims in intellectual property litigation. MS Young Lawyers Recognized for Pro Bono Service
Jackson, MS - Bradley Arant Rose & White LLP attorney Amanda K. Jones is serving as President of the Mississippi Bar Young Lawyers Division during 2005 – perhaps its busiest year ever, thanks to Hurricane Katrina. In recognition of the amazing disaster response effort by lawyers young and old from across the state that she personally helped coordinate, the Mississippi Center for Justice recently recognized Jones for her exemplary Pro Bono Service in the wake of Hurricane Katrina. This award follows one given to Jones by the American Bar Association’s Young Lawyers Division in October. ABA YLD Chair, Christina Plum, presented Jones with a national “Star of the Quarter” in recognition of her pro bono service in the weeks following the hurricane.

From the time Hurricane Katrina hit Louisiana and Mississippi on August 29th, until late October, the Amite County native and University of Mississippi Law School graduate worked full time to coordinate the delivery of legal assistance to disaster victims through a toll-free hotline and at FEMA Disaster Recovery Centers throughout the state. Bradley Arant Rose & White LLP, the firm she joined in 2001 after practicing five years with another firm, gave Jones a fully paid leave of absence so she could devote all of her legal skills and leadership abilities to the disaster relief. “I think it’s amazing that my firm enabled me to do this by essentially donating me to this relief effort,” Jones said. “It is my firm that should be commended for allowing me the freedom to make this contribution to my fellow Mississippians.” Bradley Arant was also recognized by the Mississippi Center for Justice for generously donating its partner to coordinate the delivery of pro bono legal services to hurricane victims.
When she was installed as President of the Young Lawyers Division during the summer, she had set a goal of increasing the number of young lawyers providing pro bono legal service to low income people in Mississippi. She had even created a new Young Lawyers Pro Bono Committee, but had no idea that the hurricane would strike so soon and so hard, and that it would be the YLD’s Disaster Legal Assistance Committee through which hundreds of her fellow lawyers in many firms would respond so quickly and eagerly with free legal aid.
“We created a volunteer army of nearly 600 lawyers to provide legal counsel over the hotline and at disaster recovery centers throughout the state,” Jones explained. The hotline was up and running by September 2nd, manned initially by lawyers and now with the help of legal assistants who fill out individual intake forms that are then sent to volunteer lawyers who provide assistance over the phone. In Jackson, law students from Mississippi College of Law have come in to answer the phones during lunch.
When the first DRC opened, the Young Lawyers Division had lawyers on the ground. “A lawyer from Biloxi who lost his home during Katrina moved to his office, which had survived the hurricane, and operated out of it. He managed the first disaster recovery center in Mississippi located in Ocean Springs and housed four other lawyers later that week – each of whom enthusiastically provided free legal aid in Moss Point and Pascagoula,” Jones noted. “The stories that have come from this disaster response are truly inspiring. Another attorney on the Mississippi coast manned every disaster relief center in Jackson County, later inspiring and sending out other lawyers from her firm to help. A Jackson attorney volunteered at the Biloxi and Pass Christian DRCs for three days, came back, and immediately signed up to go back again. Virtually every lawyer with my own firm has volunteered at one of the DRCs statewide or provided legal assistance over the phone,” added Jones, who continues to provide free legal services at the DRCs, especially on weekends, even though she has returned to her practice at Bradley Arant.
“The Mississippi Bar’s Young Lawyers Division has a strong tradition of helping out during natural disasters,” Jones noted. “When Hurricane Camille hit in 1969, young lawyers traveled in RVs from across the state to assist – so the YLD has been responding to needs of fellow Mississippians arising out of a disaster for at least three decades. It was years later that the American Bar Association’s Young Lawyers Division and FEMA actually signed an agreement whereby each state’s YLD would coordinate with FEMA to provide free legal assistance to disaster survivors through a hotline and at FEMA DRCs.”
To accommodate the flood of offers of assistance from out-of-state attorneys, Jones and other members of the State Bar met with members of the Mississippi Supreme Court and the Mississippi Court of Appeals immediately after Katrina struck, to allow the special admission of these attorneys to provide pro bono legal aid through the Disaster Legal Assistance program. An order was issued two days later, with copies distributed statewide.
The Bar Association also sponsored five different training sessions on insurance, landlord-tenant, and foreclosure issues to better equip lawyers advising those hardest hit by the hurricane. Three training sessions were held at the bar center in Jackson, one at the University of Mississippi School of Law, and another at Mississippi College School of Law. The Young Lawyers Division, with the assistance of the University of Mississippi School of Law Civil Legal Clinic, also issued a revised and improved reference manual that can be downloaded from the Bar’s website for this, and future, disasters.
Jones, who normally focuses her legal skills on products liability and commercial litigation in state and federal courts, as well as white collar criminal defense cases, handled 65 to 70 disaster related calls each day for nearly two months and making trips to the coast to oversee the DRCs. In her role as the Bar’s primary disaster relief coordinator, she also found herself in front of television cameras and on the radio or with newspaper reporters on a fairly regular basis. “Whatever it’s taken to get the word out about our hotline – and about the legal assistance available at the DRCs, that’s what I’ve been willing to do,” Jones said. “It’s simply been an unforgettable experience for a young lawyer,” she added, noting that she, like most of her fellow attorneys, have already far exceeded the goal of increasing their pro bono work.
Amanda Jones is a partner in Bradley Arant’s Jackson office and a member of the Litigation and White Collar Criminal Defense Practice Groups. Her civil litigation practice focuses primarily on products liability defense and commercial litigation in both state and federal courts. She has represented clients in federal grand jury investigations and tried several criminal cases to jury verdict, in which she was successful in obtaining not guilty verdicts for her clients against charges of conspiracy, fraud and false statement, as well as embezzlement.

Trial Partner Becomes New Houston Bar Foundation Chair
HOUSTON – Tracie J. Renfroe, a trial partner at Bracewell & Giuliani LLP, is the new chair of the Houston Bar Foundation.

Renfroe has served on the Houston Bar Foundation board of directors since 2004. She has a commercial litigation practice with emphasis on environmental, toxic tort and product liability disputes. She chairs Bracewell & Giuliani’s environmental litigation team and has served on the firm's Management Committee. She has been a volunteer for Houston Volunteer Lawyers Program for 20 years.

Renfroe is a 1982 graduate of Baylor University and a 1985 graduate of Baylor University School of Law. She is a member of the Environmental Law Sections of the American Bar Association, the State Bar of Texas and the Houston Bar Association. She also is a member of the International Association of Defense Counsel. Renfroe serves on the board of directors of the Houston Food Bank and served as chair in 2004-2005.

Euromoney Adds Two Top Bracewell Partners to Its Elite Expert Guides
HOUSTON(Jan. 13, 2006) – Two partners at Bracewell & Giuliani LLP have recently been named in their practice to the prestigious Euromoney's Expert Guides series.

Partner Cliff Gunter, who heads Bracewell's Trial Section, was listed in the 2005 Guide to the Leading U.S. Litigation Lawyers, and partner Henry Kaim, who head the firm's Bankruptcy Section, was honored in the 2005 Guide to the World's Leading Insolvency and Restructuring Lawyers. Both attorneys practice in the firm's Houston office.
