Dr. Gloria Norberg Joins Winstead as a Patent Agent
Austin (Jan 17, 2006) — Gloria L. Norberg, Ph.D., has joined Winstead Sechrest & Minick P.C. as a patent agent in the Austin Office. She will be a member of the Biotechnology and Nanotechnology Practice Groups. A dedicated scientist and highly-skilled patent agent, Dr. Norberg has over 30 years experience working in biotechnology, pharmaceuticals, chemical arts, and medical arts. Since 1991, she has worked as a patent agent in the Austin legal community, providing patent portfolio management and analysis for clients in bioscience, medical technology, and intellectual property industries. Prior to her legal career, she spent 20 years conducting research in various scientific disciplines including biochemistry, genetics, and microbiology.
"Dr. Norberg is a reputable patent agent who also happens to have an extensive and impressive biotechnology background. Dr. Norberg represents clients in a wide variety of domestic and international patent applications including compositions for treatment of diseases such as cancer, HIV, and cardiovascular conditions. She provides portfolio analysis support for attorney due diligence, opinion, and litigation work and she represents clients in biotechnology, pharmaceutical formulations, diagnostics, small molecule therapeutics, and medical imaging methods as well as polymer chemistry and biodegradable polymers.

She has several published publications covering her research in medical technology and bioscience including a recent paper on inventorship in bioscience. She received her Ph.D. in biochemistry from the University of Texas, her M.S. in microbiology from the University of Illinois, and her B.S. in chemistry from the University of North Dakota.

How Safe Are Hotel Card Keys?



Frequent travelers can rest easy. Computerworld has shown that concerns that electronic hotel room keys include sensitive personal information are unfounded. The hotel industry has frequently said there is no basis for the claims, but the concerns still remain among some travelers. To determine whether there is any basis for concern, Computerworld tested 100 hotel card keys from hotels and resorts ranging from Motel 6 to Hyatt Regency and Disney World. Neither Computerworld nor the expert it engaged to do additional testing of the cards could find any personally identifiable information on any of the cards. Domestic Surveillance Issue Remains Front and Center



The debate over the authority of the President to order the interception of telephone and e-mail messages between persons in the United States and persons overseas will be at the forefront of Congress’s agenda as it returns to Washington. Speaking Sunday on ABC’s “This Week,” Senator Arlen Specter, chair of the Senate Judiciary Committee, which will hold hearings on domestic surveillance, reiterated his belief that the President did not have the authority to order the surveillance. "I started off by saying that he didn't have the authority under the resolution authorizing the use of force,” he said. “The president has to follow the Constitution." When asked what remedy would exist if the President is found to have acted without authority, Specter replied that the remedy could be a variety things including impeachment. Specter added that “I don't see any talk about impeachment here. . . Former Vice President Al Gore was not so charitable. He used Martin Luther King Day to speak out against the domestic eavesdropping authorized by President George Bush after the 9-11 attacks on the World Trade Center and the Pentagon. In his speech, Gore accused the President of “breaking the law repeatedly and persistently.” Gore recalled how during the last several years of his life, Dr. King was illegally wiretapped on a regular basis by the FBI. Said Gore:



The FBI privately called King the “most dangerous and effective negro leader in the country” and vowed to “take him off his pedestal.” They government even attempted to destroy his marriage and blackmail him into committing suicide.



This campaign continued until Dr. King’s murder. The discovery that the FBI conducted a long-running and extensive campaign of secret electronic surveillance designed to infiltrate the inner workings of the Southern Christian Leadership Conference, and to learn the most intimate details of Dr. King’s life, helped to convince Congress to enact restrictions on wiretapping.



The result was the Foreign Intelligence Surveillance Act (FISA), which was enacted expressly to ensure that foreign intelligence would be presented to an impartial judge to verify that there is a sufficient cause for the surveillance.

The New York Times reports today that then FBI head Robert S. Mueller III, expressed his concern that about whether the eavesdropping was legal, as his agency worked to investigate thousands of leads provided to it from the National Security Agency. Survey Identifies Consumers’ Concerns with Loyalty Programs



David T.S. Fraser at the Canadian Privacy Law Blog pointed us to an article about a soon-to-be-released survey of consumers regarding privacy and loyalty programs. According to the study, “Retail Demand Insights 2006: What Drives Consumers?,” retailers are going to have to take care to address consumers’ privacy concerns in developing their loyalty programs. The survey found that consumers draw a clear line between what is and is not acceptable information to be provided in a loyalty program. The study found that “the most acceptable information shoppers were willing to give retailers include their name (89.8%), e-mail address (78.1%), street address (60.7%), and past transactions (46.8%). Consumers were least likely to allow retailers to track weight (14.4%), income (12.5%), job title (12.1%), employer (10.9%) and net worth (8.2%).” “Shoppers Want Loyalty Programs, but Not at the Cost of Privacy,” http://www.crm2day.com/news/crm/117019.php

Scott R. Carvo Joins Warner Norcross
January 17, 2006) – Warner Norcross & Judd LLP today announced that Scott R. Carvo has joined its Grand Rapids office as an associate.
Carvo earned a bachelor of arts degree in history from the University of Michigan in Flint and his doctor of jurisprudence degree cum laude from Wayne State University Law School in Detroit, where he was Order of the Coif. He was also a member of the Moot Court National Team and received top honors for his participation in various competitions. He also pursued Arabic studies at the University of Damascus in Syria during his undergraduate studies.

Prior to joining Warner Norcross, Carvo served as a law clerk with a Detroit firm where he worked on health care and medical malpractice issues.

A native of Flint, he now resides in Wyoming with his wife, Amina, and their son, Noor.

Joseph M. Infante Joins Warner Norcross
January 17, 2006) – Warner Norcross & Judd LLP today announced that Joseph M. Infante has joined its Grand Rapids office as an associate.
Infante earned a bachelor of science degree in environmental geosciences from Michigan State University in East Lansing. He received his doctor of jurisprudence degree from The Ohio State University Moritz College of Law in Columbus, where he competed as a member of the National Moot Court team, was president of the Environmental Law Association and treasurer of the Sports and Entertainment Law Association.

Prior to joining Warner Norcross, Infante was a summer clerk with a law firm in Muskegon. He also worked as a phlebotomist at Mercy General Health Partners in Muskegon.

A native of Muskegon, he now resides in Grand Rapids.

Firm Grows Trade Practice
David M. Schwartz has joined the Washington office. Schwartz, 43, is of counsel in the firm's International Trade & Customs practice group. He focuses his practice on import and export compliance, trade remedy litigation and trade policy. Schwartz most recently practiced as of counsel with the Washington office of Blank Rome LLP.

When asked why he joined the firm, Schwartz said, "Thompson Hine offers not only a strong international trade practice but also a commitment to client service. I look forward to the continued development of my practice as part of the firm's larger growth plans."

Schwartz has over ten years of experience practicing international trade law. He counsels clients on international trade issues arising under U.S., NAFTA and WTO laws and regulations. He represents clients in administrative litigation proceedings before the U.S. International Trade Commission, the U.S. Department of Commerce, U.S. Customs and Border Protection and the U.S. Department of State. He also represents them in legislative matters before the U.S. Congress. Prior to private practice, Schwartz served as a judicial clerk to the Honorable A. Joe Fish, U.S. District Court for the Northern District of Texas.

T&K Advises Largest Brazilian Corporation, Petrobras, On Purchase of Shell Oil Assets
Rio de Janeiro, Brazil - On December 22, 2005, in a customary show of inter-office cooperation, attorneys from Thompson & Knight's Rio de Janeiro and Dallas offices assisted with the close of the US$140 million purchase of Shell assets in Latin America on behalf of the Firm's client Petrobras. The acquisition agreement consisted of the fuel businesses (retail and commercial market) in Colombia and all Shell's operations and assets in Paraguay and Uruguay, amounting approximately to US$140 million. The total value of the transaction will be determined in the final transfer of assets to Petrobras during 2006.

The acquisition details are as follows:
- Colombia - control of 38 services stations in Bogotá; distribution base in Puente Aranda; lubricant blending plant and a terminal of basic products in Santa Marta.
- Paraguay - 134 service stations with 52 convenience stores, in all of Paraguay; assets in Liquid Petroleum Gas (LPG) commercialization; installations for the sale of aviation products in the airports of Assunção and Cidade del Este.
- Uruguay - 89 services stations in all of Uruguay; installations for the sale of aviation products in the International Airport of Carrasco; commercialization of asphalt and participation in the regional market of maritime products

The conclusion of this operation is in line with the objectives established in the strategic planning by Petrobras wishing to solidify its position as an integrated energy company, with strong international presence and as a leader in Latin America. Such markets offer an excellent potential of growth and possibility of synergy with the current assets of Petrobras in the continent.

Marcelo Mello, Ivan Tauil, Bruno Gonçalves, Andre Berzins (Rio de Janeiro) and John Rain, J. Holt Foster III and David Harris (Dallas) were primarily responsible for carrying out due diligence, contract negotiation, and structuring.
