Former U.S. Army Attorney Joins Preston Gates
Recent addition to further strengthen Government Contracts Practice



WASHINGTON, D.C. — Preston Gates Ellis & Rouvelas Meeds LLP announced today that Greg Vogel has joined the firm as an associate. Mr. Vogel has spent the last five years as an attorney in the Judge Advocate General’s Corp for the U.S. Army. He is joining the Government Contracts and Procurement Policy Group at the firm.

Prior to joining Preston Gates, Mr. Vogel served as a Captain in the U.S. Army Judge Advocate General’s Corps and as an attorney in the Bid Protest Litigation Division of U.S. Army Materiel Command (AMC), where he defended the AMC on over twenty Government Accountability Office (GAO) bid protests and drafted agency-level decisions for the AMC Protest Decision Authority. While stationed at Fort Belvoir, he also assisted in an investigation of international intelligence activities.

"Having successfully defended the Army in bid protests, Greg’s experience in contract law issues will be particularly useful to firm clients," said Preston Gates partner Bill Shook, the government contracts practice group leader. "His background will add to our already extensive experience in government contracts issues."

Prior to being stationed at Fort Belvoir, Mr. Vogel was the administrative law attorney for U.S. Army South at Fort Sam Houston, Texas. He assisted in an Office of Special Counsel inquiry into civilian personnel reimbursement discrepancies and advised the Commanding General, Principal Assistant Responsible for Contracting, and resource managers on contract and fiscal law issues. Beginning in September of 2003, Mr. Vogel served as Command Judge Advocate for the Joint Task Force Bravo at Soto Cano Air Base in the Republic of Honduras. Greg served as the sole attorney for the U.S. military in a joint unit responsible for activities in Central America. His duties included advising the commander on all aspects of law, including contract, fiscal, military, ethical and international law.

Mr. Vogel began his service in the Army in 2002 at Fort Buchanan in Puerto Rico. While there, and later Fort Sam Houston in Texas, he served as the International and Operational Law Attorney. He helped to negotiate military-to-military Memoranda of Understandings for operations in Central and South America and lectured on topics including Law of War, the Geneva Convention, Code of Conduct and the Rome Treaty.

During his career in the U.S. Army, Mr. Vogel received the Joint Service Commendation Medal, Army Commendation Medal with one oak leaf cluster, Army Achievement Medal and the Global War on Terrorism Service Medal. He earned his J.D from the University of Virginia and his B.A. from the University of Richmond.

Nelson Mullins Increases Salaries for Starting Attorneys
COLUMBIA, S.C. (Jan. 20) — On Jan. 19, Nelson Mullins announced it would raise salaries paid to all associates of the Firm. Nelson Mullins is among the leading firms in the Southeast and provides salaries and benefits that match the top tier of firms in the region.

Effective as of the pay period beginning Jan. 1, 2006, starting salaries for Nelson Mullins’ associate attorneys in Georgia and North Carolina will increase to $115,000, while the new rate for associates in South Carolina will increase to $95,000. The Firm previously raised starting salaries for associates in Nelson Mullins’ Washington, D.C., office; and, those raises went into effect on Jan. 1, as well.

Miller Canfield Attorneys Discuss Critical Issues for Tax-Exempt Organizations in Michigan

Local Attorney Promoted to Major
Organizes Local Foundation During Deployment To Benefit Iraqi Children and Poor


Madison, WI (January 20, 2006) – Michael Best & Friedrich LLP is proud to announce that our partner, Matthew Storms who is currently serving overseas in Iraq, has recently been promoted to Major in the Wisconsin Army National Guard. When he is not deployed, Mr. Storms practices business and corporate law in Madison and he is a founding member of the firm’s Venture BestSM group.

Major Storms is the commander of HHC, 2nd Battalion, 127th Infantry out of Appleton, Wisconsin. His unit was mobilized on June 6, 2005 and left soon after for mobilization training at Camp Shelby, Mississippi. His unit subsequently deployed to the Middle East on August 20.

Since Major Storms arrived in Iraq, he established a non-profit entity, The Badger OIF Foundation, to benefit Iraqi children and poor in the area in which his unit is located. Jordan Hemaidan, also a partner at Michael Best and board member of Badger OIF Foundation, said that “this is a great way to demonstrate the goodwill that the average American has for the average Iraqi, and to contribute to the building of a peaceful and stable Iraq for the future.”

Loeb & Loeb Obtains Dismissal of Securities Arbitration Action Before Hearing; Arbitrators Award Attorneys Fees and Sanctions Against Claimant for Failure to Comply With NASD Dispute Resolution Rules
Loeb & Loeb LLP announced that an NASD Dispute Resolution arbitration panel has entered an Award dismissing all claims "with prejudice" that were brought against the firm's securities brokerage client. The Panel ordered the Claimant to pay $5,000 in attorneys fees and $2,000 in sanctions based on the Claimant's "willful and material failure to comply with Orders of the Arbitrators." The Arbitrators also found that "Claimant failed repeatedly to comply with the NASD Code of Arbitration, specifically as regards to discovery issues."

Loeb partner Michael A. Thurman and associate Christina Z. Foster handled the matter on behalf of the firm. The Award was entered following a pre-hearing conference on Loeb's motion to compel the Claimant to respond to discovery requests made nearly two years earlier.

The Panel found that the Claimant's failure to respond to the requests and to two previous Orders directing the Claimant to respond supported the dismissal of the action prior to a hearing on the merits of the case. The Arbitrators noted in the Award that the only documents produced by the Claimant during the discovery process were copies of documents that had previously been produced by the brokerage firm. The Panel also cited Claimant's failure to comply with the NASD's rules requiring parties to exchange exhibits and witness information prior to the hearing.

The underlying claim sought damages of $365,000 and alleged negligence, failure to supervise, breach of fiduciary duty, misrepresentation, non-disclosures, unauthorized trading, omission of facts, unsuitability, violation of California securities laws, fraud, negligent misrepresentation and conversion.

"We were pleased that the Arbitrators required the Claimant to comply with the NASD rules," Thurman said. "We felt that we had strong defenses if the case went to hearing, but it would have been unfair to require our client to spend the time and money to defend an action when the Claimant had essentially failed to participate."

KV Pharmaceutical Company Wins Summary Judgment of Invalidity and Unenforceability in Patent Litigation by AstraZeneca over Toprol-XL
Kenyon & Kenyon LLP client KV Pharmaceutical Company has announced that the United States District Court for the Eastern District of Missouri has granted its motions for summary judgment in a patent infringement case filed against it by AstraZeneca. The case arose from KV’s submission of ANDAs seeking approval to market generic formulations of AstraZeneca’s beta-blocker Toprol-XL (metoprolol succinate extended-release tablets) The case is In re Metoprolol Succinate Patent Litigation, MDL-1620-RWS.

The Court granted the motions filed by KV Pharmaceutical Company and its co-defendants Andrx Corporation and Eon Labs for summary judgment of invalidity and unenforceability of both patents that were asserted by AstraZeneca (U.S. Patents 5,001,161 and 5,081,154). Both patents were held invalid, as well as being held unenforceable for inequitable conduct committed by AstraZeneca during prosecution of the patents before the U.S. Patent and Trademark Office.

According to a statement issued by AstraZeneca, sales for Toprol-XL in the U.S. in 2005 were $1.291 billion. KV reported in its press release that it believes it has the first-filed ANDA pending at the FDA for the 100mg and 200mg dosages, and that sales of the 100mg and 200mg strengths represent nearly half of the total volume.
