KILPATRICK STOCKTON RANKED AMONG TOP INTERNATIONAL FIRMS IN CHAMBERS GLOBAL GUIDE
ATLANTA (January 24) – Kilpatrick Stockton LLP announced today that the firm earned top recognition in the annual Chambers and Partners Global Guide.

Seven Lawyers from Keating Muething & Klekamp Named Leading Lawyer by Cincy Business Magazine
Seven lawyers from Keating Muething & Klekamp were named Leading Lawyer by Cincy Business magazine: Steven C. Coffaro (Business), Richard L. Creighton (Litigation), Pamela Morgan Hodge (Insurance), Mary Ellen Malas (Family/Domestic Relations), Timothy B. Matthews (Banking), Edward E. Steiner (Corporation/Partnership) and Joseph L. Trauth, Jr. (Real Estate).

According to Cincy Business magazine, hundreds of members of Greater Cincinnati’s legal community nominated colleagues for this honor, specifying a particular strength and area of practice for each nominated attorney, and a jury of peers made the final selections.

Mr. Coffaro focuses his practice on commercial litigation matters. He represents both public and private companies and individuals in a wide variety of business disputes. He has actively represented clients in litigation matters pending in state or federal courts in Ohio, Kentucky, Indiana, Illinois, Michigan, Nevada, New Hampshire, New York, Tennessee, Texas and Wyoming. In addition to his commercial litigation practice, Mr. Coffaro also devotes part of his practice to the representation of firm clients in the defense of personal injury matters.

Mr. Creighton’s practice is concentrated in general civil litigation, with particular emphasis on complex business, antitrust and tort litigation, including class actions. In recent years, he has served as lead class counsel in several class action cases, including antitrust price-fixing cases. In the business law arena, he has successfully defended clients in a variety of contract and/or fraud cases. Mr. Creighton is also recognized for his experience in counseling media clients on matters involving libel, invasion of privacy and other First Amendment issues. A licensed instrument rated private pilot, he has successfully represented numerous clients in aviation related matters, including aviation crash cases and administrative proceedings before the Federal Aviation Administration. He served as a law clerk to the Honorable John W. Peck, United States Court of Appeals for the Sixth Circuit.

Ms. Hodge represents companies in a variety of circumstances, including: insurance coverage litigation, bad faith litigation, managing insurance claims to obtain coverage without the necessity of filing suit, construction claims, tort claims, contract claims, and employment claims. She is an experienced litigator having tried, arbitrated and mediated many cases with extensive experience in insurance matters.

Ms. Malas is the leader of the Family Law section of the Private Client Services Group. Her practice is concentrated in all areas of domestic relations, including divorce, dissolution, premarital agreements, juvenile law, grandparent rights, and collaborative law. She is a frequent lecturer in the area of family law and is one of the founding members, and current Steering Committee member, of the Collaborative Family Lawyers of Cincinnati. Ms. Malas represents clients in Hamilton, Butler, Warren, and Clermont counties.

In practice since graduating from Harvard Law School in 1981, Mr. Timothy B. Matthews heads the Commercial Finance and Reorganization Practice Group at Keating Muething & Klekamp. He has dedicated much of his career to bank transactions, including mergers, acquisitions, divestitures, portfolio sales and financing transactions. Mr. Matthews also represents a variety of institutional and fund lenders and investors, as well as serving as corporate counsel to a number of companies.

Mr. Steiner is co-leader of the firm’s Business Representation and Transactions Group. The focus of his practice is corporate, securities and financing law, where he has extensive experience in mergers, acquisitions and divestitures representing both public and closely-held corporations and other entities. He is part of the team at Keating Muething & Klekamp that has overseen more than 300 acquisition and divestiture transactions in the past five years with an aggregate transaction value in the billions of dollars. He also regularly represents investment limited partnerships in venture capital and private equity investment transactions, as well as institutional investors in their acquisitions of interests in venture capital and private equity limited partnerships. He has significant experience in initial and follow-on public offerings of securities, and in representing issuers and investors in private placements of securities. He also regularly represents franchisors and franchisees.

Mr. Trauth's practice is concentrated in areas of civil litigation, zoning and planning law and real estate law. He has been extremely successful in obtaining real estate property tax reductions for major commercial properties in this region. He has represented numerous commercial property owners in obtaining substantial real estate tax reductions.

Quinn Quoted in Baton Rouge Advocate
Baton Rouge Real estate partner Louis Quinn was quoted in the January 21 editon of The Advocate in an article regarding the The Regent Apartments, a proposed 318-unit apartment complex at Interstate 12 and Millerville Road. Quinn and Baton Rouge managing partner and real estate attorney Charles Landry represent the Regent Apartments which was scheduled for a hearing before the the City-Parish Planning Commission on January 23 for a zoning change. The Hurricane Katrina-related population increase has caused demand for apartments to increase around Baton Rouge and some experts say the current vacancy rate is around 1 percent.

Jones Walker Welcomes 2006 Spring Clerks
Jones Walker welcomes two of its summer law associates back to the firm for spring clerkships. Carla Ashley and Chris Martin, both third year law students at Louisiana State University, resumed clerking at the firm in January. Ms. Ashley and Mr. Martin will join Jones Walker as associates in the Baton Rouge office in the fall of 2006. The firm anticipates hiring up to 28 summer associates in 2006 throughout its offices in LA, Texas, Florida, and Washington, D.C.

Settlement of RICO class action first in U.S. for damages to workers by alleged illegal immigrant hiring
U.S. Judge Fred Van Sickle (E. D. Wash.), preliminarily approved a settlement in Mendoza v. Zirkle a class action in which the defendants will pay $1.3 million for the benefit of the class, the legally authorized workers of the Zirkle Fruit Co., based in Selah, Washington.

This is the first case in U.S. history in which legal American workers have obtained damages from the wage depression caused by illegal immigration. The case was filed in 2000, initially dismissed, successfully appealed to the Ninth Circuit Court of Appeals, certified as a class action, and was set for trial on January 9, 2006.

If the Court grants final approval to the settlement, following a fairness hearing on May 11, 2006 , class members will receive back pay for each hour worked in the company’s warehouse and fruit orchards during the class period, 1999-2004.

The plaintiffs are represented by Howard Foster of Johnson & Bell, Ltd.

Johnson & Bell is co-counsel for other cases asserting the same damages on behalf of legal American workers against Tyson Foods and Mohawk Industries. The Mohawk case will be heard by the U.S. Supreme Court in April.

NEPA: Potential Effect of Task Force’s Draft Recommendations on Oil & Gas Pipeline Infrastructure Expansion Projects
"On December 21, 2005, the U.S. House of Representatives Committee on Resources’ Task Force on Improving the National Environmental Policy Act (NEPA) and Task Force on Updating NEPA released a report of its initial findings and draft recommendations. The NEPA Task Force’s draft recommendations could impact the environmental review process for federal agencies that permit oil and gas pipeline infrastructure expansion projects. The NEPA Task Force is seeking public comments on the initial findings and draft recommendations until Monday, February 6, 2006. These initial findings and draft recommendations are summarized below. Background
When NEPA was passed by President Nixon in 1970, it established a national environmental policy and provided a framework for environmental planning and decision-making by federal agencies. NEPA requires federal agencies to conduct environmental reviews to consider the potential impacts that a proposed project may have on the environment and to consider alternatives to the project. Initial Findings and Draft Recommendations
The NEPA Task Force was formed by House Resources Committee Chairman Richard W. Pombo in April 2005, and has been led by Representative Cathy McMorris. Beginning in April 2005 and concluding in November 2005, the NEPA Task Force held seven field hearings with environmental groups, affected industries, government officials and others to obtain feedback on NEPA. The Task Force found two distinct views of the NEPA process — (1) the status quo is adequate (which was expressed by a majority of the environmental groups); and (2) NEPA is a landmark law, but could use some improvements (expressed by Federal agencies; tribal, state and local representatives; NEPA practitioners; applicants; and some citizen groups).
On December 21, 2005, the NEPA Task Force issued its initial findings and 22 draft recommendations for improving and updating NEPA, including several amendments to NEPA. At this time, none of the Task Force members have endorsed the findings and recommendations. The 22 recommendations are organized into the following nine groups:"

Marla Waiss accepted to Leadership Buffalo Rising Leaders program
