Jennifer J.K. Peru Joins Blank Rome
WASHINGTON, D.C. - Blank Rome LLP is pleased to announce that Jennifer J.K. Peru* has joined the Firm as an Associate in the White Collar, Internal, and Government Investigations Practice Group. Ms. Peru will be based in Blank Rome's Washington, D.C. office.

Prior to joining Blank Rome, Ms. Peru served as a Trial Attorney in the Southern Criminal Enforcement Section of the United States Department of Justice Tax Division. Ms. Peru has experience investigating and prosecuting federal jury trials involving tax fraud, money laundering, and conspiracy. In addition, Ms. Peru analyzed criminal fraud matters submitted by the Internal Revenue Service and provided memoranda identifying evidentiary issues and recommending declination or authorization of prosecution or grand jury investigations. During this time, Ms. Peru was recognized for her work, receiving the Tax Division Outstanding Attorney Achievement Award in 2003 and 2004.

Ms. Peru received her law degree from Temple University School of Law and a Bachelor of Arts in Liberal Studies, with distinction, from the University of Hawaii at Manoa.

Favorable Verdict in Trial for KPMG LLP
A jury in the 164th Harris County District Court returned a favorable verdict for KPMG LLP on January 18, 2006. Plaintiffs were 41 investors and customers of a failed brokerage firm in the Turks and Caicos Islands.
KPMG Ltd., the KPMG International member firm in the Turks and Caicos Islands, audited the brokerage firm's financial statements in 2000. Plaintiffs asserted various common-law and securities claims against KPMG LLP for its concurring review of the audit. They also sought to hold KPMG LLP vicariously liable for KPMG Ltd.'s conduct.
Plaintiffs claimed actual damages totaling $10.9 million and sought punitive damages and attorneys' fees. Additionally, the brokerage firm brought cross claims against KPMG LLP and sought over $28.5 million in actual damages in addition to punitive damages and attorneys' fees. A former KPMG Ltd. employee also asserted a $1 million cross claim against KPMG LLP.
Before trial, the court granted summary judgment on various common-law claims and all securities claims against KPMG LLP. After the plaintiffs' case at trial, the court granted KPMG LLP's motion for directed verdict on plaintiffs' claims for knowing participation in a breach of fiduciary duty and all claims for damages resulting from plaintiffs' pre-audit report investments. The court also directed a verdict in favor of KPMG LLP on all claims by the brokerage firm.
The jury awarded zero damages to 25 of the 41 plaintiffs-including some of the larger million-dollar investors-and zero damages to the former KPMG Ltd. employee. The jury also found the plaintiffs responsible for 50 percent of their damages.
On the direct claims, the jury found KPMG LLP responsible for 5 percent of only nine plaintiffs' damages, totaling only $25,000. On the vicarious claims, an alternative theory of recovery, the jury found that KPMG LLP was responsible for only 10 percent of the plaintiffs' damages, amounting to a maximum award of approximately $150,000. Plaintiffs have no basis for an award of attorneys' fees.

Paul Carrubba Presents at Alabama Treasury Management Association Annual Meeting
Paul Carrubba, a member of the Banking and Finance Team of Adams and Reese, will present “Remote Imaging Legalities” to the Alabama Treasury Management Association at its annual meeting on Thursday, January 26, 2006, in Birmingham.

The topic of remote capture of deposit has gained considerable attention from banks and their corporate and retail business customers. Mr. Carrubba’s presentation will examine the regulatory, contract fraud and risk issues facing banks as they roll out this new service. The presentation will specifically address the impact of Regulation E, availability and holds under Regulation CC, as well as other branching regulations, important contract terms, fraud issues and risk reduction programs.

Mr. Carrubba has extensive experience with the legal and managerial aspects of the banking industry. He has also taught courses for the Bank Administration Institute on Principals of Banking, Demand Deposits, Savings Deposits, Trust Services, and Money and Banking. He frequently conducts training seminars on numerous banking topics. He is a member of the faculty of the Alabama School of Banking and the BAI’s Graduate School of Bank Operations and Technology and formerly taught at the Mississippi School of Banking.

Mr. Carrubba received his Juris Doctorate cum laude from Mississippi College School of Law in 1979, and in 1972, earned his Bachelor of Science degree in Banking and Finance from the University of Southern Mississippi.

Article: Rochester Democrat and Chronicle: John Woods Quoted on Non-American-made or -Owned Ferries Doing Business Between American Ports
John Woods was quoted in an article entitled "Law Limiting Ferry Confirmed: Foreign-built ship under Bahamas flag can't sail only to U.S. ports" regarding the federal law requiring that ships that are doing business between U.S. ports be American-made and -flagged. The ferry referred to in this article is neither, having been built in Australia and sailing under the Bahamian flag. John Woods said, "That's the problem. They've got to find a buyer that will take it [the ship] out of the U.S. - or another operator that will sail to Canada."

R&C Partner Discusses The Future of the The Buick Championship on CT's Face the State
Robinson & Cole Partner Bradford S. Babbitt appeared on Face The State, a Connecticut news and analysis program on the local CBS affiliate, on Sunday, January 22, 2006. As Tournament Chairman of the 2006 Buick Championship, Babbitt was interviewed about the PGA TOUR's recent reshuffling of its schedule starting in 2007 and the effect of those changes on professional golf in Connecticut. Buick's decision not to continue as title sponsor was also a topic discussed during the program.
