LAS VEGAS – The statewide law firm of Kummer Kaempfer Bonner Renshaw & Ferrario (KKBR&F) is pleased to announce that Thomas D. Amick, Allen D. Emmel and James E. Smyth II were recently elected to become members of the Board of Directors of the firm effective Jan. 1, 2006.
Thomas D. Amick has been practicing in the firm’s governmental affairs division specializing in zoning, land use and administrative law matters since he joined KKBR&F in 1998. Mr. Amick appears before all local jurisdictions in the Las Vegas metropolitan area. He also represents clients in liquor and gaming licensing matters and works with various planning and licensing agencies in Clark County and the cities of Las Vegas, North Las Vegas and Henderson.
Mr. Amick is a member of the Nevada Chapter of the American Planning Association and the Nevada Restaurant Association and a faculty member for CLE International's Land Use Law Conferences in Las Vegas. He is on the Board of Trustees for the Lied Discovery Children’s Museum and coaches competitive youth soccer with United States Youth Soccer-Nevada.
He received a bachelor’s degree from the University of California, Davis, and a law degree from the University of the Pacific, McGeorge School of Law.
Allen D. Emmel practices with the transactional group and has been with the firm since 2003. His practice involves all aspects of real estate, including commercial leasing, condominium projects, title insurance, acquisitions, sales, financing, development and environmental issues.
Mr. Emmel received a bachelor’s degree in microbiology from Pennsylvania State University and a law degree from California Western School of Law. Prior to joining KKBR&F, he was a shareholder at the law firm of Jolley Urga Wirth Woodbury & Standish. Mr. Emmel is also licensed in California and has practiced real estate and corporate law with a San Diego-based firm. Before entering law school, he worked as the environmental coordinator for a mining company with projects throughout the western U.S.
He is a member of the State Bars of Nevada and California, the Clark County Bar Association and the American Bar Association. He is currently on the Board of Directors of Habitat for Humanity Las Vegas and serves as its legal counsel.
James E. Smyth II practices in construction, commercial litigation, real estate, land use and zoning entitlement litigation matters. He has negotiated multiple construction and architectural contracts throughout his career.
M. Smyth has appeared and argued before the Supreme Court of the State of Nevada, the Eighth Judicial District Court, the United States District Court, District of Nevada, the State Contractors Board, the Clark County Board of County Commissioners and the city councils for the cities of Las Vegas, North Las Vegas and Henderson.
He is a native Nevadan, started working for the law firm as a runner while attending UNLV and returned to the firm as an associate with KKBR&F’s land use and government affairs department in 1997. Mr. Smyth graduated from the University of Nevada, Las Vegas and received a law degree from Washburn University School of Law in Topeka, Kansas.

David N. Bregman has been involved in all areas of General Civil Litigation. Mr. Bregman has represented clients in a wide variety of complex matters including business litigation, construction payment disputes, real estate matters, personal injury defense and the defense of developers, general contractors, subcontractors and material suppliers in construction defect litigation. Dayna L. Chmelka defends subcontractors and general contractors in claims involving construction defect, contract disputes, environmental issues, complex class-action lawsuits involving property damage, personal injury, and mold exposure. In addition, Ms. Chmelka represents companies in employment litigation. She counsels employers on affirmative action compliance, and helps draft employment policies. Mark H. Nys counsels corporations concerning business disputes, contract negotiations, and environmental litigation. Much of his experience is in the construction industry, defending developers and contractors against residential and commercial construction defect litigation. Mr. Nys' practice includes defending large California-based automobile dealerships in lemon law and auto financing disputes. Mr. Nys also defends homeowner's associations and mobile home parks in a variety of legal matters. Maurine P. Travis handles a variety of construction-related litigation matters in state and federal courts, including complex class-action lawsuits involving property damage, personal injury, and mold exposure, as well as claims for breach of contract and foreclosure of mechanic's liens. Her practice focuses primarily on the defense of various subcontractors and general contractors in connection with alleged construction defects, construction site accidents, contract disputes, environmental and real estate issues. Ms. Travis also litigates creditor's rights in bankruptcy court in both the Southern District and Central District of California, among others, and she recently won a case by defeating a debtor's preference claim, securing a dismissal for the client.

Natalie P. Vance is the managing shareholder of the Sacramento law office of Klinedinst PC. She originally opened the office in Northern California back in 2004. Gabe P. Wright has a broad range of civil litigation experience. His practice involves litigation and trial of complex disputes, commercial matters, and real estate related issues. Supreme Court Advocate Smith Elected as ACS Board Chair
Jenner & Block Partner Paul M. Smith was elected last week to be Chair of the American Constitution Society’s Board of Directors.

Mr. Smith is an “extraordinary lawyer, with an equally extraordinary commitment to meaningful justice under our legal system,” said outgoing Board Chair Teresa Wynn Roseborough. His experience, insight and dedication will prove invaluable to the ACS in coming years, she said.

Mr. Smith has served on the Board of the ACS for several years. He is Co-Chair of the Firm’s Appellate and Supreme Court and Media and First Amendment Practices. And he has argued eleven cases before the Supreme Court, including Vieth v. Jubelirer, a congressional redistricting case, Lawrence v. Texas, involving the constitutionality of the Texas sodomy statute, United States v. American Library Ass'n, involving a First Amendment challenge to the Children's Internet Protection Act and Mathias v. WorldCom, dealing with the Eleventh Amendment immunity of state commissions.

Firm Helps AmeriHost Inn Founder Sell its Assets to Sunburst Hotel Company
Jenner & Block recently helped Arlington Hospitality, Inc., creator of the AmeriHost Inn brand name, to complete the $28.1 million sale of its assets to Sunburst Hotel Holdings, Inc. and SJB Equities, Inc., thereby moving Arlington one step closer to ending its Chapter 11 proceedings.

The total consideration for the sale of assets included $9.5 million in cash and the assumption of approximately $18.6 million in mortgage debt on the purchased hotel assets.

Sunburst assumed nearly all of the hotel development and management company’s assets with the exception of two wholly-owned hotels, its corporate headquarters office building, and four hotel joint ventures purchased by SJB. Arlington is also in the process of relinquishing possession of twelve remaining hotel leases with its mortgage lender.

Arlington hopes to propose a liquidation plan to the U.S. Bankruptcy Court for the Northern District of Illinois as soon as practicable, according to a press release. In August 2005, the company had filed voluntary Chapter 11 restructuring bankruptcy petitions in that court as a result of challenging conditions in the lodging industry, including decreased cash flow and increased operating costs.

Sunburst Hospitality, based in Silver Spring, Maryland, is a diversified real estate owner and operator, with interests in hotels, golf course and residential developments. Including the former Arlington assets, the company’s hotel portfolio now includes more than 40 hotels nationwide.

Lisa Gretchko Named To Co-Chair Task Force
Bloomfield Hills, Michigan - January 26, 2006: Lisa S. Gretchko, an attorney with Howard & Howard Attorneys, P.C., was recently selected to co-chair the Preference Task Force of the American Bankruptcy Institute’s (ABI) Unsecured Trade Creditors’ Committee. Ms. Gretchko practices in the Bloomfield Hills Office.
The American Bankruptcy Institute is the largest multi-disciplinary, non-partisan organization dedicated to research and education on matters related to insolvency. Ms. Gretchko’s Task Force is responsible for keeping the ABI and its Unsecured Trade Creditors’ Committee apprised of important developments in preference law and litigation. The work of the Preference Task Force is especially important to suppliers to financially troubled customers.
Ms. Gretchko concentrates her practice in creditors’ rights and commercial litigation. She has represented nearly every constituency in bankruptcy courts around the country, including secured creditors, unsecured creditors’ committees, landlords, licensors of intellectual property, debtors and trustees, and has litigated many of the issues which arise in the context of bankruptcy law. She has lectured extensively for many organizations on various creditors’ rights issues. Ms. Gretchko also has experience in real estate litigation.
She received a B.A. degree with honors from the University of Michigan in 1976 and was a member of the Phi Beta Kappa Honor Society. She received her J.D. degree, cum laude, from the University of Detroit, where she was awarded the National Order of the Barrister and an elected member of the Justice Frank Murphy Honor Society. In addition, Ms. Gretchko was an associate editor of the Univeristy of Detroit's Journal of Urban Law. As an adjunct professor at Wayne State University Law School, she taught Bankruptcy Law and Creditors’ Rights.
Ms. Gretchko was a member of the Advisory Committee of the Bankruptcy Court for the Eastern District of Michigan. She is currently a member of the Business Law Advisory Board for the Institute of Continuing Legal Education, and a member of the American Bankruptcy Institute, where she is a contributing editor to “Last in Line,” a column in its monthly journal. She is a former council member and secretary of the Real Property Law Section of the State Bar of Michigan and was chair of the Oakland County Bar Association Creditors’ Rights Committee.
