Ms. McBride practices in the areas of insurance defense, products liability, construction defects, and premises liability. Phoenix, Arizona - Gust Rosenfeld announced that Janet E. Jackim has joined the firm as a member and will focus her practice on real estate and business transactions. Jackim has practiced law for 20 years in the Valley, serving as both in-house counsel and in private practice. A graduate of Loyola University of Chicago School of Law, Jackim is active in a number of civic and professional organizations. She was a board member of AZ Commercial Real Estate Women and Enterprise Network, and is currently on the Board of Troon Mountain Community Home Owners Association. Fulbright Partner Leads the Charge for Art Center in $75M Fundraising Effort
Fulbright partner and Art Center trustee Harry Hathaway unveiled the Courtyard of Friends on the Pasadena, California campus of this prestigious design center. Marking the midpoint of a $75 million campaign, of which Hathaway is the chair, the courtyard showcases new donor pavers as well as the South Campus donor wall. So far, under Hathaway’s direction, Campaign for Art Center has raised $50.4 million since January 2001 for scholarships, education, faculty and campus development. A leader in art and design education for nearly 75 years, the College offers undergraduate and graduate degrees in a wide range of art disciplines.

Art Center is located in Pasadena, California, with classes held at its Hillside Campus and new South Campus in downtown Pasadena.

After serving 12 years as Fulbright’s Los Angeles partner-in-charge, Hathaway recently returned his primary focus to corporate legal matters. He is the Chair-Elect of the Art Center College of Design Board of Trustees from 2004 through 2006.

Fulbright Attorney Becomes Board Certified in Business Bankruptcy Law

Freshfields advises on $1.3bn Bahrain power deal
International Power Plc, Sumitomo Corp and Suez-Tractebel are acquiring and upgrading a state-owned power and desalination plant in Bahrain for a total cost of $1.3bn. Freshfields Bruckhaus Deringer advised the Government of Bahrain on the transaction, which marks a major step in the modernisation and privatisation of Bahrain's economy.

The consortium, which was appointed to the Al Hidd Independent Water and Power Project following a competitive tender process, will undertake the design and construction of a new desalination facility. The group will also operate and maintain the combined plant.

Joe Huse, the partner who led the Freshfields team from the Dubai office, commented, 'We are pleased to have been involved in this significant project, which is the first independent water and power project and first privatisation of an existing power generation asset in Bahrain.'

The Freshfields team included Ross Howard of the Paris office and Harnek Shoker of the Dubai office.

Legislature Passes Law Banning Discrimination on the Basis of Sexual Orientation
the Washington State legislature passed House Bill 2661 making it illegal in the State of Washington to discriminate on the basis of sexual orientation in employment, public accommodation, real estate, credit and insurance transactions, including union membership and activities. (House Bill 2661 will become law 90 days after the end of the current legislative session.) The Washington Law Against Discrimination (RCW 49.60 et seq.) ("WLAD") statutes were amended to add the phrase "sexual orientation" to the list of previously identified protected classifications (race, creed, color, national origin, families with children, sex, marital status, age, sensory, mental or physical disability, or the use of a trained dog guide or service animal). The legislature also amended the WLAD to include the following definition of "sexual orientation":

"Sexual orientation" means heterosexuality, homosexuality, bisexuality, and gender expression or identity. As used in this definition, "gender expression or identity" means having or being perceived as having a gender identity, self-image, appearance, behavior, or expression, whether or not that gender identity, self-image, appearance, behavior, or expression is different from that traditionally associated with the sex assigned to that person at birth.

This amendment creates a state wide ban on discrimination on the basis of sexual orientation for those entities that are subject to the requirements of the WLAD. Previously, only a handful of cities and counties in the state had any prohibitions of any sort for discrimination on the basis of sexual orientation. For instance, only King County and the cities of Burien, Seattle, Spokane, and Tacoma currently prohibit private employers from discriminating in employment on the basis of sexual orientation; and, of these five governmental bodies, only Seattle, Tacoma, and Burien include gender identity as part of sexual orientation.

So what does this mean for you? If you are located in the three cities identified above, the new legislation will be unlikely to affect your employment practices. For those of you who have policies that provide that you do not discriminate on the basis of sexual orientation, your policy now has the force of law. In addition, if your policy did not include gender identity within the definition of sexual orientation, you should amend your policy to include these new requirements.

We recommend that all employers review their policies and/or employee manuals immediately. If your policy does not state that you do not discriminate on the basis of sexual orientation, you should amend your policy or manual so that it aligns with the law. Even if your policy does include sexual orientation as a protected class, make sure that your practice includes not discriminating on the basis of gender expression or identity. Finally, you may want to consider some training for your employees. If you have not provided anti-sexual harassment training too your employees for some time, now would be the time to do it again-and include sexual orientation and gender identity as part of the training.
