Four Dykema Attorneys To Speak At Lorman Seminar
Marc D. Ginsberg, Kathrin E. Kudner, Tricia E. McVicker and Ian M. Sherman are presenting a seminar on the topic of "Medical Records Law In Illinois" sponsored by Lorman Education Services. This conference will take place on February 16, 2006 at the DoubleTree Guest Suites in Downers Grove, Illinois and is designed for medical records directors, health information directors, business managers, office managers, hospital administrators, nurses, social workers, release of records professionals and attorneys. This one-day seminar will instruct attendees on the basic concepts of confidentiality; deal with "special" problem areas like parent-child, mental health and communicable diseases; cover "involuntary" access to records by legal process and provide the basics of HIPAA privacy and security requirements.

Mr. Ginsberg concentrates his practice on trial and appellate cases. He is primarily involved in the defense of physicians in medical litigation, and also has experience in litigation pertaining to construction injuries, product liability, business disputes and insurance coverage. Mr. Ginsberg earned his B.A. degree, with honors, from the University of Illinois, his M.A. degree from Indiana University, his J.D., with highest distinction from John Marshall and his LL.M. from DePaul University.

Ms. Kudner’s practice is devoted to the representation of health care facilities, practitioners and managed care organizations in corporate, regulatory and compliance matters. She is chairperson of the firm’s HIPAA Task Force and a member of the firm’s Insurance and Biotechnology/Life Sciences Teams. Ms. Kudner earned her B.A. degree from the University of Colorado, her M.S. degree, summa cum laude, from the University of Missouri, and her J.D., cum laude, from the University of Toledo. Ms. Kudner is named in Best Lawyers in America.

Ms. McVicker is a registered nurse and practiced as an emergency room nurse prior to graduating from law school. She focuses her practice on the defense of medical malpractice cases. Ms. McVicker received her B.S. degree from the Lakeview College of Nursing and her J.D. from John Marshall Law School.

Mr. Sherman handles the defense of cases involving medical malpractice, disciplinary matters, commercial and other litigation. He is a past chairman of the medical-Legal Relations Committee of the Chicago Bar Association, as well as a member of the Society of Trial Lawyers, the Illinois Association of Healthcare Attorneys and the American Board of Trial Advocates. Mr. Sherman has served on a risk management subcommittee of a medical malpractice insurer and has contributed to various publications including the Illinois Bar Journal, Illinois Medicine, Medical Economics and OB-GYN Malpractice Prevention. Mr. Sherman received his A.B. degree, cum laude, from the University of Illinois at Urbana-Champaign and his J.D., cum laude, from Boston University.

Tiffany & Co.'s suit against eBay proceeds apace
The suit of Dorsey client, Tiffany & Co., against the online auctioneer eBay is expected to be tried by the end of this year, according to an article in the online magazine Red Herring. The case, described by one legal commentator as "a watershed case," could change the ground rules for how online merchants like eBay operate. eBay is charged with participating and faciliating the counterfeiting, false advertising, and trademark infringement of Tiffany items in violation of the Lanham Act, which enables trademark holders to recover damages

DLA Piper Representing Cyclades Corporation in Acquisition by Avocent Corporation
(E. PALO ALTO, Calif.) – DLA Piper Rudnick Gray Cary US LLP announced today that the firm is representing Cyclades Corporation, a privately held company, in its acquisition by Avocent Corporation (NASDAQ: AVCT) in a transaction that is valued at approximately $90 million.

Avocent announced they have entered into a definitive agreement to acquire Cyclades Corporation, a privately-held network infrastructure management company, for a total cash purchase price of approximately $90 million plus the assumption of liabilities and payment of certain transaction costs. Cyclades had unaudited revenues of approximately $60 million in 2005. The acquisition is expected to be completed in the first quarter of 2006.

Cyclades is a supplier of a comprehensive system of products that reduces IT operational costs and risks, while increasing the productivity of IT assets and personnel. Cyclades AlterPath solutions include console servers, KVM and KVM over IP switches, power control appliances, service processor managers, blade managers and a manager to control out-of-band infrastructure. More than 8,000 organizations, including 85 percent of the Fortune 100, utilize Cyclades products.

Avocent is the leading supplier of connectivity solutions for enterprise data centers, service providers and financial institutions worldwide. The company’s branded products include switching, extension, intelligent platform management interface (IPMI), remote access and video display solutions.

Von Thaden Joins DLA Piper's International Tax Practice in Los Angeles
(LOS ANGELES) – DLA Piper Rudnick Gray Cary has announced that Bernhard von Thaden has joined the firm’s International Tax practice as a Senior Economist in the Los Angeles office. He joins DLA Piper from KPMG LLP.

As an economist, von Thaden focuses in international transfer pricing, a topic of increasing significance to multinational companies doing business worldwide. He brings strong experience in managing global transfer pricing projects in transactions including cost sharing, licensing, intercompany services, and financing. International Tax Review has repeatedly named him one of the leading transfer pricing advisers in Los Angeles. His industry experience includes life sciences, information technology, capital equipment, national resources and power, and logistics industries.

"Multinational companies have consistently identified transfer pricing as their most significant international tax issue. Bernhard’s substantial experience handling international transfer pricing will play a key role as we continue to expand our international tax and transfer pricing practices around the world," said Michael Lebovitz, a partner in DLA Piper’s International Tax practice. "In addition to transfer pricing, Bernhard’s experience in purchase price allocation and business and asset valuation will add to the suite of services we can offer in our Corporate and M&A and litigation practices."

At KPMG, von Thaden was a partner in the international tax group in Los Angeles, which he joined after working with Roland Berger and Partner, a leading international management consulting firm in Europe.

von Thaden received an MBA with a focus on investment banking from Bocconi University in Milan and received a Master in Economic Geography from Ludwig-Maximillians University in Munich.

The two new partners are Chris P Sioufi, a banking and finance specialist, and Matthew Glynn, an IT and telecoms specialist, taking our United Arab Emirates capability to five partners and 10 associates.

Chris P Sioufi, former General Counsel and Chief Compliance Officer of Bahrain-based Islamic investment bank, Unicorn Investment Bank, will head DLA Piper's Dubai banking and funds practice. Chris advises on the full range of banking and finance matters, including private equity, corporate and Islamic finance, and asset and fund management. He is fluent in Arabic, French and English and was previously a partner at leading Canadian law firm Ogilvy Renault. Matthew Glynn, formerly with Linklaters, London and Singapore, where he was responsible for establishing and running their Asian Telecoms Group, will head DLA Piper's Dubai IT and telecoms practice.
