Hermes Sargent Bates Attains Another Victory at the Fifth Circuit!
The U.S. Court of Appeals for the Fifth Circuit affirmed the district court's dismissal of a breach of contract lawsuit filed against Lyford Cay Members Club.
Monte Hurst, a partner at Hermes Sargent Bates, represents the private club located in Nassau. Mr. Hurst successfully obtained at the district court a dismissal of the case, filed by a former member of the club, based upon the club’s lack of contacts with the United States. The plaintiff appealed the district court’s dismissal to the Fifth Circuit.
The panel assigned to this matter affirmed the district court's dismissal of this case based on the lack of personal jurisdiction.

Attys. Farley and Johnson Appointed to Appellate Advocacy Certification Task Force
Halloran & Sage Appellate Law Attorneys John B. Farley and Ralph W. Johnson, III have been recently appointed to the Connecticut Bar Association’s (CBA) "Task Force for the Creation of A Certification Program for Appellate Advocacy." The Task Force has been created to determine how the CBA should expand its certification program to include appellate advocacy. The Task Force will determine the nature, scope and content of an Appellate Advocacy certification program, the resources and procedures required to maintain such a program and how requirements for certification would be satisfied. Its final report is to be presented to the CBA's House of Delegates in November, 2006.

Foley & Lardner Adds Former Deputy General Counsel For Hewlett-Packard to Silicon Valley Office
Stephen P. Fox Brings 19 Years of Intellectual Property Management Experience to Firm's Electronics Industry Clients
SILICON VALLEY, CALIF. – Foley & Lardner LLP announced today that Stephen P. Fox, former vice president and deputy general counsel for intellectual property at The Hewlett-Packard Company (HP), joined the firm's Silicon Valley office as a member of the Intellectual Property Department. Fox, 64, is also a member of Foley's Electronics Practice Group.

“Steve's decades of experience managing one of the largest intellectual property divisions in the world will allow us to expand the strategic counseling services that we provide to our clients in Silicon Valley, as well as nationally and internationally, with focus on those seeking best practices for managing their assets,” said Sharon R. Barner, chair of Foley's Intellectual Property Department. “His extensive litigation, licensing and management experience is especially important as more companies seek to extract value from their portfolios. Steve's addition will greatly benefit both our clients and the firm.”

Fox is the latest addition to Foley's Silicon Valley office, which the firm opened in 2004 to serve its large client base in the life sciences and high-technology industries located in Palo Alto, Calif. He joins the office's strong group of intellectual property attorneys who have backgrounds in the biotech and pharmaceutical industries.

Fox recently retired from a 38-year career at HP where he was vice president and deputy general counsel of the intellectual property section. Fox joined HP in 1968 when the company only employed four patent attorneys. Before his retirement in October 2005, he supervised all aspects of the company's intellectual property legal work worldwide and managed 100 professionals in Europe, Asia and the United States. He also oversaw the intellectual property aspects of several HP acquisitions.

“Foley's reputation of having one of the preeminent intellectual property law practices in the world made joining the firm an ideal opportunity,” said Fox. “I am looking forward to providing strategic IP counseling to the firm's broad base of domestic and international clients.”

He will focus his practice on all aspects of strategic IP counseling including management and licensing, best practices in patent procurement, and patent litigation. In addition to his extensive experience in managing one of the largest patent portfolios in the world, he has specific expertise in defending patent infringement complaints brought by patent holding companies (trolls), companies that buy patent portfolios with the sole purpose of filing lawsuits. He also will counsel clients on how to align patent rights with business strategy; effective patent portfolio mining and categorization; and how to convert human capital to intellectual property assets. He will further counsel clients on best practices for effective patent procurement to maximize effective protection.

Fox is past president and a current member of the Association of Corporate Patent Counsel, a past board member of Intellectual Property Owners Inc., and a current board member of the National Inventors Hall of Fame. He has also served as a federal appointee to the USPTO Patent Public Advisory Committee and is a member of the Licensing Executives Society, the American Intellectual Property Law Association and the American Bar Association.

He received a bachelor's degree in electrical engineering from Northwestern University and a law degree from George Washington University Law School.

Foley & Lardner Adds HCCA Board Member and Former Chief Compliance Officer For Tenet Healthcare to Los Angeles Office
LOS ANGELES – Foley & Lardner LLP announced today that Cheryl L. Wagonhurst, former chief compliance officer for Tenet Healthcare Corporation, joined the firm's Los Angeles office as a partner in the Health Law Department. Wagonhurst is also a member of Foley's Health Care Industry Team.
“Cheryl has earned a national reputation for her knowledge of corporate health care legal issues, and she will further expand our strong capabilities in this area,” said Jody Root, chair of the firm's Health Law Department. “Her extensive background in corporate compliance program development, including investigations, auditing, monitoring, training and policy development, will be a valuable asset to both our health care and non-health care clients nationally and in California.”

Wagonhurst focuses her practice on corporate health care law and compliance, and has experience in healthcare regulatory law, fraud and abuse, and complex litigation. Her experience includes compliance, policies and training, reporting and auditing, investigations, billing, health information management, EMTALA, and patient privacy and security. In addition to health law work, she plans to grow her practice by designing compliance programs for clients in industries as diverse as energy, insurance, financial and travel.

Prior to joining Foley, Wagonhurst was a member of Tenet Healthcare Corporation's legal department for 11 years. In 2003, she was appointed the company's chief compliance officer, reporting directly to a committee of the company's board of directors. In that position, she designed, implemented and directed one of the nation's largest compliance programs and oversaw a multidisciplinary team of more than 100 compliance professionals. Wagonhurst, a long-time resident of California, decided to leave Tenet late last year when the company moved its corporate headquarters to Dallas from Santa Barbara.

“While the decision to leave Tenet was difficult for me, in the end I know that I made the right choice for my family to remain in California,” said Wagonhurst. “I am thrilled to be a part of Foley's robust health care and compliance practice. I am not aware of another firm in the country that has the depth and breadth of experienced health care lawyers as Foley.”

Wagonhurst also served as senior counsel in Tenet's law department, where she created processes and systems to assist the company in compliance with federal and state laws and regulations. Wagonhurst participated in the negotiation of settlements, handled investigation and resolution of regulatory and compliance matters, and participated in the development and implementation of the company's utilization review process.

She serves on the boards of directors of the Health Care Compliance Association, the Society of Corporate Compliance and Ethics, Court Appointed Special Advocates (SBC) and the Montecito Educational Foundation. She also serves on the board of governors of the Federation of American Hospitals, and is a member of the California and American Bar Associations, and the American Health Lawyers Association. Wagonhurst received a law degree from Whittier Law School and a bachelor's degree in journalism from the University of Minnesota.
