Two Partners Join Hunton & Williams' Global Technology and Sourcing Practice
ATLANTA, GA - Hunton & Williams LLP has expanded its Global Technology and Sourcing practice with the addition of James A. Harvey and James E. Meadows as partners in the firm’s Atlanta office.
“We are very pleased that Jim Harvey and Jim Meadows have joined us, adding to our growing technology and outsourcing capabilities,” said Thurston Moore, Chairman of the Executive Committee and Managing Partner of the firm. “Both gentlemen have outstanding track records in these dynamic areas and we are excited to introduce them to our clients. Demand for their services continues to expand and we plan to grow to meet that demand.”

Both Jim Meadows and Jim Harvey represent an exciting expansion of our knowledge of key industry players and deal structures, and significantly increase our ability to handle the largest and most complex sourcing and offshoring transactions undertaken by our clients around the globe.”
Mr. Harvey will co-chair the Global Technology and Sourcing practice group. He joins Hunton & Williams from Alston & Bird, where he founded and led the firm’s Privacy and Data Management Task Force and its Open Source Task Force. He maintains a very active practice advising customers in sophisticated outsourcing transactions, focusing on board level, enterprise-wide initiatives. He was ranked as one of America’s leading lawyers by Chambers USA for Business Process Outsourcing in 2005. Mr. Harvey also provides advice and counseling in matters related to digital and intangible infrastructure, including extensive leading edge work on open source software, and privacy and data management issues.
Mr. Meadows formerly practiced with Mr. Harvey at Alston & Bird and joins Hunton & Williams from Duane Morris. Mr. Meadows has had 20 years of experience in the technology and sourcing field, providing him with a deep understanding of the underlying technology, enabling him to provide realistic risk assessments and creative approaches to solving problems before they are encountered. His practice focuses on technology transactions and related legal matters. He advises clients on technology matters including structuring (or restructuring) long-term or strategic information technology or business process outsourcing relationships, creating Internet and e-Business strategic alliances, managing open source initiatives, investigating and building wireless electronic commerce offerings, and implementing data and information security solutions.

Mr. Harvey received his juris doctor degree, with honors, from the University of North Carolina at Chapel Hill and a B.A. in Economics from the University of Arkansas, where he was elected to Phi Beta Kappa. Mr. Meadows received his juris doctor degree from Wake Forest University School of Law and a B.S. in Mathematics from the University of North Carolina at Chapel Hill.
The Global Technology and Sourcing practice group at Hunton & Williams LLP consists of more than 30 professionals focused on large-scale, global outsourcing and technology transactions, with extensive experience in matters relating to intangible infrastructure. Wisconsin Appellate Court Upholds Insured's Waiver of Subrogation Clause in Construction Contract
Factory Mutual Ins. Co. v. Citizens Ins. Co. of America, No.2005AP872, slip op. (Wis.Ct.App. Dec. 4, 2005).
The Wisconsin Court of Appeals recently held that a waiver of subrogation clause was enforceable in a construction contract between two sophisticated commercial entities. In this case, two insureds were involved in a building renovation project. During the project, employees of one of the insureds triggered a fire causing damages to the other insured's property. The damaged insured submitted a claim to its insurer and filed suit against the other insured. The underlying damages case eventually settled. The insurer's subsequent subrogation claim was dismissed at the trial level due to the waiver of subrogation clause. The Appellate Court sustained this decision on appeal, finding that both commercial entities conducted a sophisticated negotiation of the allocation of risk.

California Appellate Court Denies Application of Revival Statute for Factually Insufficient Claims Relating to Earthquake Losses
Davaloo v. State Farm Insurance Co., 135 Cal.App.4th 409, 37 Cal.Rptr.3d 528 (2nd Dist. 2005).
The California Court of Appeals recently held that a California statute, which acts to revive certain time-barred claims relating to earthquake losses, is not applicable to sustain factually deficient pleadings. In this case, the plaintiff insureds filed a breach of contract and bad faith claim against their insurer for damages to their property caused by the Northridge earthquake in 1994. The original complaint contained only generic allegations and did not identify any particular dispute between the insurer and insureds. After the revival statute had expired, the plaintiff insureds attempted to amend their pleadings to state a proper cause of action but failed to provide facts pertaining to the property or policy at issue. In its ruling on the defendant's motion to dismiss, the Court held that an insured could not file a factually deficient complaint at the end of a statutory revival period in an attempt to use the relation-back doctrine to amend the original unsustainable complaint.
