Patent Attorney Raúl V. Fonte Joins Jones Walker as Special Counsel
BATON ROUGE – Raúl V. Fonte has joined Jones Walker’s Baton Rouge office
as a special counsel in its Intellectual Property Practice. Mr. Fonte is the
seventh registered patent attorney at Jones Walker.
Prior to joining Jones Walker, Mr. Fonte served as patent counsel and senior
engineer for environmental consulting company Crescent Technology, Inc.
since 1993. Before that, he worked for Freeport-McMoRan Inc. for more than
26 years. Mr. Fonte served in various positions there including chemical engineer,
assistant director of research and development, and patent counsel since
1977. Mr. Fonte brings to Jones Walker over 30 years of experience in patents,
copyrights, trademarks and other intellectual property matters as well as research
& development, technology transfer and licensing. He has over 10
years of experience as an environmental specialist, with emphasis on environmental
assessments, environmental audits and environmental regulatory matters.

Comprehensive IRS Guidance on Roth 401(k) and 403(b) Plans
The IRS recently issued proposed and final regulations that provide guidance on the requirements applicable to Roth contributions under Code section 402A. 71 Fed. Reg. 6 (Jan. 3, 2006) and 71 Fed. Reg. 4320 (Jan. 26, 2006). The final regulations provide guidance on the requirements applicable to Roth contributions to 401(k) plans. The proposed regulations provide guidance on the taxation of distributions from Roth accounts, Roth account recordkeeping and reporting requirements, and Roth contributions to 403(b) plans.


The final regulations apply on and after January 1, 2006. The general effective date of the proposed regulations would be January 1, 2007, although a number of provisions would apply as of January 1, 2006. Taxpayers may rely on the proposed regulations until final regulations go into effect. Comments on the proposed regulations should be submitted by April 26.

Congress Repeals the Byrd Amendment
Congress passed legislation on February 1, 2006 that
will repeal the controversial Continued Dumping and
Subsidy Offset Act of 2000 (the “Byrd Amendment”).
Once President Bush signs the legislation, which will be
effective October 1, 2007, the United States will be in
compliance with a World Trade Organization (“WTO”)
ruling that found the Byrd Amendment incompatible
with WTO rules.
I. Summary of the Byrd Amendment
Under the Byrd Amendment, United States producers
who supported a petition for import relief received
distributions of antidumping and countervailing duties
collected by United States Customs and Border
Protection (“CBP”). Prior to the Byrd Amendment, this
money was paid directly to the U.S. Treasury
Department.
Since the Byrd Amendment’s effective date, CBP has
distributed about $1 billion in antidumping and
countervailing duties to corporate petitioners. However,
a study revealed that over half of this money went to
only five companies, including approximately $476
million to The Timken Company and its subsidiaries.
II. WTO Action
In January 2003, several WTO members filed a
complaint with the WTO against the U.S. Byrd
Amendment. Ultimately, the WTO determined that the
Byrd Amendment breached the WTO Antidumping and
Subsidies Agreements as well as the 1994 General
Agreement on Tariffs and Trade (“GATT”). The WTO
granted the U.S. through 2003 to comply with its ruling.
At the end of 2004, the U.S. remained non-compliant
with the ruling, resulting in the WTO authorizing eight
WTO members to retaliate against the U.S. Since then,
Canada, the European Union, Japan, and Mexico have
imposed retaliatory measures against U.S. imports. For
instance, in May 2005, Canada began to impose
retaliatory tariffs of 15 percent on imports of particular
tariff items. Effective August 2005, Mexico began to
impose retaliatory tariffs on certain imported goods,
ranging from 9 to 30 percent.
III. Conclusion
President Bush is expected to sign the Deficit Reduction
Act of 2005 (S. 1932) into law, which contains a
provision repealing the controversial Byrd Amendment.
As a result of the Byrd Amendment’s repeal,
merchandise entered on or after October 1, 2007 will no
longer be distributed to U.S. producers but will once
again be paid to the U.S. Treasury Department.
