CT Chapter of The Counselors of Real Estate Names R&C Real Estate Partner Vice-Chair

Reed Smith's Insurance Recovery Practice Continues to Grow -- Gary Thompson Joins DC Office
(February 1, 2006, Washington, DC) – Reed Smith LLP, a top 25 international law firm, announces the addition of Gary Thompson as the newest partner in its Insurance Recovery Practice Group, resident in the firm’s Washington, D.C. office, effective immediately.

Mr. Thompson comes to Reed Smith from Gilbert, Heintz & Randolph LLP, Washington, D.C., where he was a founding partner. A commercial litigator with a focus on policyholder insurance coverage disputes, Mr. Thompson represents large commercial policyholders seeking to secure insurance proceeds from their insurers. He has developed a national practice especially in the areas of hurricane and other property insurance, Director’s & Officers insurance, fidelity bond, and asbestos and other general liability insurance.

According to Doug Cameron, head of Reed Smith’s Insurance Recovery Practice Group, Mr. Thompson is the latest addition to a practice that already serves some of the largest corporate policyholders in the U.S. requiring counseling and representation in disputes with their insurers and for other insurance coverage matters. Daniel Winters, Matt Schlesinger, Jay Levin and Douglas Widen, four seasoned insurance recovery attorneys, joined this practice in the firm’s New York, Washington D.C. and Philadelphia offices respectively, in late 2004 and early 2005. “We have focused on adding highly skilled laterals in many of our markets and Gary definitely fits that description,” Mr. Cameron said. “Gary’s broad insurance coverage experience and extensive expertise and his focus on first-party commercial property insurance and Director’s and Officer’s insurance is very well-aligned with our strategic plan to continue to grow and strengthen this practice across the firm. Gary has high industry visibility which will be invaluable in further raising the profile of Reed Smith.” Gary also has a sterling reputation for his commitment to pro bono work and community service. He has won several awards for his pro bono achievements arising out of work on September 11 insurance issues and fair housing issues involving insurers. “We look forward to Gary adding his energy to Reed Smith’s longstanding public service commitment,” said Ira Lefton, the Reed Smith partner who chairs the firmwide pro bono committee.

Mr. Thompson participated in establishing Gilbert, Heintz & Randolph as a founding partner, following ten years in the Washington, D.C., offices of Howrey Simon LLP, where he was a partner, and at Kaye Scholer LLP, where he served in that firm’s New York and D.C. offices.

“Reed Smith has developed a great reputation and record in representing policyholders in insurance coverage disputes,” said Mr. Thompson. “I am very excited to be joining their Insurance Recovery Practice Group. I expect Reed Smith to provide a very solid foundation upon which to further develop my insurance recovery practice.”

Mr. Thompson is a 1990 graduate of Rutgers–Newark Law School and earned his undergraduate degree in 1987 from Georgetown University.

The American Lawyer Highlights Sidney Rosdeitcher's Successful Defense of Santa Fe's Living Wage
The February issue of The American Lawyer magazine features a story on Sidney Rosdeitcher's successful defense of Santa Fe's living wage ordinance.The article described the recent appellate court decision upholding the living wage ordinance. The article also discusses Sidney's pro bono work for the Brennan Center and quotes him as saying that focusing on living wage issues is "an ideal way to spend his retirement." Sidney is now working full-time at the Brennan Center.

Paul, Weiss Represents Landowner in Manhattan Mixed-Use Development
Yesterday’s New York Times Business section featured an article on a proposed mixed-use development for the intersection of Lexington Avenue and 86th Street in Manhattan, a project that is seen by many as the first step in a major transformation of the area's shopping district. Paul, Weiss represented the Goldman family, the owners of the land on which the new project is to be built. Characterizing the deal as "unusually complex" the developer noted that "the negotiations were somewhat innovative and extended." The proposed project is comprised of approximately 100,000 sq.ft. of retail space and 20 rental apartments subject to a long-term ground lease, with an additional 150 residential condominium units to be constructed within a column of air wholly-owned by the developer and lying directly above the leased parcel. The Goldmans are sharing in the profits of both the retail space, the sale of the condominium units and the leasing of the rental units. The Paul, Weiss team representing the Goldman family included real estate partner Steven Simkin, counsel Allen Wieder and former associate Manuel Lauredo. Tax advice was provided by partner Richard Bronstein.

Orrick Client Nikko Materials Awarded $4.3 Million in Patent Infringement Case
NEW YORK—Orrick, Herrington & Sutcliffe LLP announced today that firm client Nikko Materials USA, Inc. was awarded more than $4.3 million in damages, attorneys fees, and other costs in its patent infringement case against R.E. Service Co., Inc. (RES). The award was granted on January 17, 2006, following a two-week trial in early 2005 in which a Northern California jury unanimously found that RES had willfully infringed Nikko’s patents.

“This is a great Nikko success story,“ said Robert M. Isackson, an intellectual property partner at Orrick, Herrington & Sutcliffe LLP in New York, who was Nikko's lead outside counsel on the case. “This case demonstrates that Nikko values its intellectual property investments and has the courage to protect that technology and its business.”

“We are very pleased with this result and are thankful for the excellent work of our trial team,” said David P. Burgess, President of Gould US, which is Nikko's copper foil business entity in the U.S. “We are very happy to have this chapter behind us,” he said.

The case was filed in May 2003 when Nikko asserted two patent infringements against RES. In response, RES asserted that Nikko had infringed four RES patents. Prior to trial, the court granted Nikko's summary judgment motions, ruling Nikko did not infringe the RES patents. After the jury announced its verdict on April 11, 2005, the parties filed various post-trial motions and, on January 12, 2006, the court granted Nikko's post trial motions and entered an immediate permanent injunction against RES.

Ogletree Deakins Names Six New Shareholders
ATLANTA – February 1, 2006 – Ogletree, Deakins, Nash, Smoak & Stewart, P.C.

named shareholders. Brian D. Black, John C. Glancy, Matthew K. Johnson of the firm’s
Greenville, South Carolina office, James H. Fowles, III of the firm’s Columbia, South

Brian D. Black practices primarily in the field of employee benefits and joined Ogletree

2004. He received his undergraduate degree from George Mason University and his law
degree from Washington and Lee University School of Law.
James H. Fowles, III is experienced in employment and general litigation matters, union
campaigns, collective bargaining and related matters for employers in multiple jurisdictions
and industries. He received his undergraduate degree from the United States Naval
Academy and his law degree from the University of South Carolina School of Law.
John C. Glancy has been with the firm eight years and focuses his practice on labor and
employment law, including employee relations and related federal and state litigation. He
received his undergraduate degree, Magna Cum Laude, from the University of South
Carolina and his law degree, with honors, from the University of Florida.
Matthew K. Johnson practices primarily in the fields of employment litigation and labor law.
He joined Ogletree Deakins in the fall of 2004 after working in a general civil litigation
practice. He received his undergraduate degree from Rhodes College and his law degree
from the University of Memphis.
Cheryl M. Stanton defends employers in state and federal courts against allegations of
race, age, sex, and disability discrimination and harassment. She also represents
employers in ERISA litigation and labor arbitrations. She received her undergraduate
degree from Williams College and her law degree from The Law School at the University
of Chicago.
Alicia Sienne Voltmer represents clients in all aspects of labor and employment law
including counseling employers on employment issues such as FMLA compliance,
termination, drug testing, and unemployment claims. She received her undergraduate
degree from Southern Methodist University and her law degree from the California
Western School of Law.
